Agreement between 
the Government of Japan
and the Government of the Arab Republic of Egypt 
concerning the Establishment of 
Egypt–Japan University of Science and Technology (E-JUST)

  　日本国政府及びエジプト・アラブ共和国政府は、

The Government of Japan and the Government of the Arab Republic of Egypt,

  　日本国とエジプト・アラブ共和国との間に存在する経済的、科学的及び技術的な分野における協力関係を一層強化することを希望し、また、千九百五十七年三月二十日に署名された日本国とエジプトとの間の文化協定及び千九百八十三年六月十五日に署名された技術協力に関する日本国政府とエジプト・アラブ共和国政府との間の協定を想起し、

	DESIRING to strengthen further the cooperative relations in economic, scientific and technological fields that exist between Japan and the Arab Republic of Egypt, and recalling the Cultural Agreement between Japan and Egypt signed on March 20, 1957 and the Agreement on Technical Cooperation between the Government of Japan and the Government of the Arab Republic of Egypt signed on June 15, 1983; and

    アラブ及びアフリカ地域における科学技術を促進することの重要性を確認して、
  　次のとおり協定した。

AFFIRMING the importance of promoting science and technology in the Arab and African regions;

	HAVE AGREED as follows:

        　　　第一条
  　両締約国政府は、それぞれの国内法令に従い、かつ、それぞれの毎年の予算の範囲内で、エジプト・アラブ共和国政府の主体性の原則及び両締約国政府間の協同の原則に基づき、エジプト・日本科学技術大学（以下「大学」という。）の設置を通じ、両国間の経済的、科学的及び技術的な協力を促進する。

Article 1

	The Contracting Parties, in accordance with their respective national laws and regulations and within the limits of their respective annual budgetary appropriations, shall promote economic, scientific and technological cooperation between the two countries through the establishment of Egypt–Japan University of Science and Technology (E-JUST) (hereinafter referred to as the “University”), based on the principles of the ownership of the Government of the Arab Republic of Egypt and of the partnership between the Contracting Parties.

  　　　　第二条
  １　エジプト・アラブ共和国政府は、この協定に従って大学を設置する。日本国政府は、大学がエジプト・アラブ共和国並びにアラブ及びアフリカ地域における高等教育及び科学研究のための卓越した拠点となるべきであることを考慮して、大学の設置を支援するためにあらゆる努力を払う。

Article 2

1.	The Government of the Arab Republic of Egypt shall establish the University, pursuant to this Agreement.  The Government of Japan shall make every effort to support the establishment of the University, taking into consideration that the University should be a center of excellence for higher education and scientific research in the Arab Republic of Egypt and in the Arab and African regions.

  ２　大学は、日本式の教育、研究及び訓練の手法を導入することを通じて、エジプト・アラブ共和国において科学技術分野での人的資源の開発に係る能力の構築を強化し、もって両国間の経済的、科学的及び技術的な相互関係の発展に寄与することを目的とする。

2.	The purpose of the University shall be to strengthen the capacity building of human resources development in science and technology in the Arab Republic of Egypt through the introduction of Japanese education, research and training methods, and hence to contribute to improving the economic, scientific and technological linkages between the two countries.

  　　　　第三条
  　エジプト・アラブ共和国政府は、アレクサンドリア県ニュー・ボルグ・エル・アラブ市にある二百フェダーン（約八十四万平方メートル）の敷地を大学に割り当てる。大学は、当該敷地内の建物及び施設の建設が完了するまでの間、同市のムバラク科学研究・技術応用都市に一時的に置かれる。

Article 3

	The Government of the Arab Republic of Egypt shall allocate for the University an area of 200 feddans (about 840,000 square meters) in New Borg El-Arab City, Alexandria Governorate.  Until the completion of the construction of buildings and facilities in that area, the University shall be located temporarily in Mubarak City for Scientific Research and Technology Applications at the New Borg El-Arab City.

  　　　　第四条
  １　大学の運営機関は、理事会とする。

Article 4

1.	The governing body of the University shall be the Board of Trustees.

２　大学の学長は、エジプト・アラブ共和国又は日本国のいずれかの国籍を有する者とし、理事会によって指名される。副学長の一人又は首席顧問は、他方の国の国籍を有する者とする。

2.	The President of the University, who shall be nominated by the Board of Trustees, shall possess the nationality of either the Arab Republic of Egypt or Japan, and one of his/her deputies or the principal advisor shall possess the nationality of the other country.

３　大学は、あらゆる国籍の学生、特にエジプト・アラブ共和国その他アラブ及びアフリカ地域の諸国から　の学生に対して開放される。

3.	The University shall be open to students of all nationalities, especially those from the Arab Republic of Egypt and other countries in the Arab and African regions.

４　大学における教育、研究及び訓練並びに大学の運営に係る計画は、日本の最良の慣行に従う。

4.	The University schemes in education, research, training and governance shall follow Japanese best practices.

  　　　　第五条
  １　大学は、次の学部及び研究所を含むが、これらに限定されない。
    (a)　工学部
    (b)　国際ビジネス・人文科学部
    (c)　両締約国政府間で合意される研究所

Article 5

1.	The University will include, but is not limited to, the following:

	a)	Faculty of Engineering;

	b)	Faculty of International Business and Humanities; and 

	c)	Research Centers to be agreed upon between the Contracting Parties.

  ２　各学部及び研究所の詳細は、両締約国政府間の協議を通じて決定する。

2.	The details of each faculty and research center shall be determined through consultation between the Contracting Parties.

  　　　　第六条
    両締約国政府は、それぞれの国の科学、大学及び実業の分野の関係者が大学の活動を支援することを奨励する。

Article 6

	The Contracting Parties will encourage their respective scientific, academic and business communities to support the activities of the University.

  　　　　第七条
    両締約国政府は、いずれか一方の締約国政府の要請に基づき、この協定の効果的な実施を確保するために相互に協議する。

Article 7

	The Contracting Parties shall consult with each other, upon request of either Contracting Party, with a view to ensuring the effective implementation of this Agreement.

  　　　　第八条
    この協定の解釈又は適用に関して両締約国政府間に生ずるいかなる紛争も、交渉その他の平和的手段を通じて解決する。

Article 8

	Any dispute that may arise between the Contracting Parties concerning the interpretation or application of this Agreement shall be settled through negotiation or other peaceful means.

  　　　　第九条
  １　この協定は、それぞれの締約国政府がこの協定の効力発生のために必要なそれぞれの憲法上の手続を完了したことを確認する書面による通告を外交上の経路を通じて行った日のうち、いずれか遅い方の日の後三十日目の日に効力を生ずる。

Article 9

1.	This Agreement shall enter into force on the thirtieth day after the latter of the dates of the written notifications through diplomatic channels by which the Contracting Parties confirm that their respective constitutional procedures required for its entry into force have been completed.

  ２　この協定は、五年間効力を有するものとし、さらにそれぞれ五年の期間、自動的に効力を延長されるものとする。ただし、いずれか一方の締約国政府がそれぞれの五年の期間が満了する百八十日以上前に他方の締約国政府に対してこの協定を終了させる意思を書面により通告した場合は、この限りでない。

2.	This Agreement shall remain in force for a period of five years, and shall be automatically extended for successive periods of five years each, unless either Contracting Party notifies the other of its intention in writing to terminate this Agreement more than 180 days before the end of each period of five years.

  ３　この協定は、両締約国政府間の書面による合意により改正することができる。

3.	This Agreement may be amended by written agreement between the Contracting Parties.

  　以上の証拠として、下名は、各自の政府から正当に委任を受けてこの協定に署名した。

	IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Agreement.

  　二千九年三月二十六日にカイロで、ひとしく正文である日本語、アラビア語及び英語により本書二通を作成した。解釈に相違がある場合には、英語の本文による。

DONE in duplicate, in the Japanese, Arabic and English languages each of which shall have equal authenticity, at Cairo, this twenty-sixth day of March, 2009.  In case of any divergence of interpretation, the English text shall prevail.
