(Japanese Note) Tokyo, April 3, 2009 Excellency,
書簡をもって啓上いたします。本大臣は、ソマリアの地先沖合において海賊行為に対処する法執行措置をとるためにジブチ共和国に派遣される日本国の自衛隊、日本国海上保安庁及びこれらの要員その他日本国政府の職員並びに前記の派遣を容易にするために日本国政府によりジブチ共和国に設置される事務所の地位に関し、日本国政府の代表者とジブチ共和国政府の代表者との間で最近行われた討議に言及する光栄を有します。
I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Republic of Djibouti concerning the status of the Self-Defense Forces of Japan and the Japan Coast Guard as well as their personnel and other personnel of the Government of Japan sent to the Republic of Djibouti with the aim of taking law enforcement measures to counter acts of piracy off the Somali coast, as well as of the offices established by the Government of Japan in the Republic of Djibouti to facilitate the above-mentioned dispatch.
本大臣は、日本国の自衛隊、日本国海上保安庁及びこれらの要員その他日本国政府の職員のジブチ共和国の領域への派遣並びに日本国政府によるジブチ共和国における事務所の設置に対するジブチ共和国政府の同意並びに両政府間の緊密なかつ長年にわたる関係に考慮を払いつつ、次の取極を日本国政府に代わって提案する光栄を有します。
Having regard to the consent of the Government of the Republic of Djibouti to the dispatch of the Self-Defense Forces of Japan and the Japan Coast Guard as well as their personnel and other personnel of the Government of Japan to the territory of the Republic of Djibouti and the establishment of the offices by the Government of Japan in the Republic of Djibouti, and to the close and longstanding ties between our two Governments, I have the honour to propose on behalf of the Government of Japan the following arrangements:
１(a) 「部隊」とは、ジブチ共和国政府の同意を得てジブチ共和国に所在する日本国の自衛隊をいう。
1. (a) The ”Forces” means the Self-Defense Forces of Japan which are present in the Republic of Djibouti with the consent of the Government of the Republic of Djibouti.
(b) 「海上保安庁」とは、ジブチ共和国政府の同意を得てジブチ共和国に所在する日本国海上保安庁をいう。
(b) The ”Coast Guard” means the Japan Coast Guard which is present in the Republic of Djibouti with the consent of the Government of the Republic of Djibouti.
(c) 「連絡事務所」とは、この取極の効果的な実施を容易にするため、ジブチ共和国政府の同意を得て日本国政府がジブチ共和国に一時的に設置する事務所をいう。
(c) The ”Liaison Offices” means offices temporarily established by the Government of Japan in the Republic of Djibouti, with the consent of the Government of the Republic of Djibouti, to facilitate the effective implementation of the present arrangements.
(d) 「要員」とは、次の者をいう。
(d) The ”Personnel” means:
(i) 部隊の隊員（日本国の防衛省の自衛官以外の者を含む。）であって、この取極に関連してジブチ共和国に派遣され、かつ、ジブチ共和国政府の同意を得てジブチ共和国に適法に所在するもの（以下「部隊隊員」という。）
(i) the personnel of the Forces, including civilian persons of the Ministry of Defense of Japan who are sent to the Republic of Djibouti in connection with the present arrangements and, with the consent of the Government of the Republic of Djibouti, are lawfully present in the Republic of Djibouti (hereinafter referred to as the ”Personnel of the Forces”);
(ii) 海上保安庁の職員であって、この取極に関連してジブチ共和国に派遣され、かつ、ジブチ共和国政府の同意を得てジブチ共和国に適法に所在するもの（以下「海上保安庁職員」という。）
(ii) the personnel of the Coast Guard who are sent to the Republic of Djibouti in connection with the present arrangements and, with the consent of the Government of the Republic of Djibouti, are lawfully present in the Republic of Djibouti (hereinafter referred to as the ”Personnel of the Coast Guard”); and
(iii) (i)及び(ii)に掲げる者以外の日本国政府の職員であって、この取極に関連してジブチ共和国に派遣され、かつ、ジブチ共和国政府の同意を得てジブチ共和国に適法に所在するもの
(iii) the personnel of the Government of Japan other than those mentioned in (i) and (ii) above who are sent to the Republic of Djibouti in connection with the present arrangements and, with the consent of the Government of the Republic of Djibouti, are lawfully present in the Republic of Djibouti.
(e) 「活動」とは、ソマリアの地先沖合において海賊行為に対処する法執行措置をとるために日本国の法令に従って行われる部隊及び海上保安庁の任務の準備、設定、実施及び支援をいう。
(e) The ”activities” means the preparation, establishment, execution and support of the mission of the Forces and the Coast Guard pursuant to the laws and regulations of Japan with the aim of taking law enforcement measures to counter acts of piracy off the Somali coast.
(f) 「現地雇用職員」とは、ジブチ共和国国民である職員又はジブチ共和国に通常居住している職員であって、日本国政府が雇用するものをいう。
(f) The ”personnel employed locally” means personnel who are nationals of or permanently resident in the Republic of Djibouti and are employed by the Government of Japan.
(g) 「施設」とは、活動のため又はこの取極の効果的な実施のため、部隊、海上保安庁、連絡事務所又は要員が必要とするすべての建物、居住施設及び土地をいう。
(g) The ”facilities” means all premises, accommodations and land required for the Forces, the Coast Guard, the Liaison Offices or the Personnel for the purpose of the activities or for the effective implementation of the present arrangements.
(h) 「水域」とは、ジブチ共和国の内水及び領海をいう。
(h) The ”waters” means the internal waters and territorial sea of the Republic of Djibouti.
(i) 「公用通信」とは、活動及び部隊、海上保安庁又は連絡事務所の任務に関するすべての通信をいう。
(i) The ”official correspondence” means all correspondence relating to the activities and their functions or the functions of the Liaison Offices.
２(a) この取極は、部隊、海上保安庁、連絡事務所及び要員に適用される。
2. (a) The present arrangements shall apply to the Forces, the Coast Guard, the Liaison Offices and the Personnel.
(b) この取極は、ジブチ共和国の領域（水域及び空域を含む。）内においてのみ適用される。
(b) The present arrangements shall apply only within the territory of the Republic of Djibouti, including its waters and airspace.
３(a) 両政府は、この取極を、それぞれの国において施行されている法令の範囲内で実施する。
3. (a) Both Governments shall implement the present arrangements within the scope of the respective laws and regulations in force of each country.
(b) この取極に基づく特権及び免除を害することなく、要員はジブチ共和国の法令を尊重するものとし、ジブチ共和国の国内問題に介入しない義務を有する。
(b) Without prejudice to the privileges and immunities under the present arrangements, the Personnel shall respect the laws and regulations of the Republic of Djibouti, and shall have a duty not to interfere in the internal affairs of the Republic of Djibouti.
４ 部隊、海上保安庁及び連絡事務所は、ジブチ共和国政府によって次の特権及び免除を与えられる。
4. The Forces, the Coast Guard and the Liaison Offices shall be accorded by the Government of the Republic of Djibouti the following privileges and immunities:
(a) 施設並びに部隊、海上保安庁又は連絡事務所が使用する船舶及び航空機は、不可侵とする。ただし、ジブチ共和国政府の官吏は、日本国政府の権限のある代表者の同意を得てそれらに立ち入ることを許される。
(a) The facilities as well as the vessels and aircraft used by the Forces, the Coast Guard or the Liaison Offices shall be inviolable. However, agents of the Government of the Republic of Djibouti shall be allowed to enter them with the consent of an authorized representative of the Government of Japan.
(b) 部隊、海上保安庁及び連絡事務所並びにこれらの財産及び資産（所在地及び占有者のいかんを問わない。）は、あらゆる形式の訴訟手続からの免除を享有する。
(b) The Forces, the Coast Guard and the Liaison Offices as well as their property and assets, wherever located and by whomsoever held, shall enjoy immunity from every form of legal process.
(c) 施設、施設内にある用具類その他の資産及び部隊、海上保安庁又は連絡事務所の輸送手段は、捜索、徴発、差押え又は強制執行を免除される。
(c) The facilities, their furnishings and other assets therein as well as the means of transport of the Forces, the Coast Guard or the Liaison Offices shall be immune from search, requisition, attachment or execution.
(d) 部隊、海上保安庁及び連絡事務所の公文書及び書類は、いずれの時及びいずれの場所においても不可侵とする。
(d) The archives and documents of the Forces, the Coast Guard or the Liaison Offices shall be inviolable at any time, wherever they may be.
(e) 部隊、海上保安庁及び連絡事務所の公用通信は、不可侵とする。
(e) The official correspondence of the Forces, the Coast Guard or the Liaison Offices shall be inviolable.
５ 要員は、ジブチ共和国の領域内において、千九百六十一年四月十八日の外交関係に関するウィーン条約の関連規定に基づいて事務及び技術職員に与えられる特権及び免除と同様の特権及び免除をジブチ共和国政府により与えられる。
5. The Personnel shall be granted by the Government of the Republic of Djibouti within the territory of the Republic of Djibouti such privileges and immunities as those accorded to the administrative and technical staff in accordance with the relevant provisions of the Vienna Convention on Diplomatic Relations of 18 April 1961.
６(a) ジブチ共和国政府は、活動又は要員の個人的な使用のための物品の輸入を許可し、かつ、それらについてすべての関税、租税及びこれらに類似する課徴金を免除する。ただし、倉入れ、運搬及びこれらに類似する役務に対する課徴金は、この限りでない。要員の手荷物は、検査を免除される。ただし、手荷物中に要員の個人的な使用のためでない物品又は輸出入がジブチ共和国の法律によって禁止されており若しくはその検疫規則によって規制されている物品が含まれていると推定すべき十分な理由がある場合は、この限りでない。その場合には、検査は、当該要員又は日本国政府の権限のある代表者の立会いの下においてのみ行われなければならない。
6. (a) The Government of the Republic of Djibouti shall permit entry of articles for the activities or for the personal use of the Personnel and grant them exemption from all custom duties, taxes and similar charges other than charges for storage, cartage and similar services. The personal baggage of the Personnel shall be exempt from inspection, unless there are serious grounds for presuming that it contains articles that are not for their personal use, or articles the import or export of which is prohibited by the law or controlled by the quarantine regulations of the Republic of Djibouti. Such inspection shall be conducted only in the presence of the Personnel concerned or of an authorized representative of the Government of Japan.
(b) 部隊、海上保安庁及び連絡事務所は、購入し及び輸入する物品並びに提供される役務であって活動又はこの取極の効果的な実施のためのもの並びに施設について、ジブチ共和国及びその地方公共団体のすべての賦課金、租税及びこれらに類似する課徴金を免除される。部隊、海上保安庁及び連絡事務所は、手数料その他の料金であって、提供された役務に対する給付としての性質を有するものを免除されない。
(b) In respect of purchased and imported goods and services provided for the purpose of the activities or for the effective implementation of the present arrangements as well as the facilities, the Forces, the Coast Guard and the Liaison Offices shall be exempt from all national, regional and communal dues, taxes and charges of a similar nature of the Republic of Djibouti. The Forces, the Coast Guard and the Liaison Offices shall not be exempt from fees or other charges that represent payment for services provided.
７ 現地雇用職員は、いかなる特権又は免除も享有しない。もっとも、ジブチ共和国政府は、これらの職員に対して裁判権を行使するには、活動又は連絡事務所の任務の遂行を不当に妨げないような方法によるものとする。
7. The personnel employed locally shall enjoy no privileges or immunities. However, the Government of the Republic of Djibouti shall exercise its jurisdiction over these personnel in such a manner as not to interfere unduly with the performance of the functions of the activities or of the Liaison Offices.
８ 日本国の権限のある当局は、ジブチ共和国の領域内において、ジブチ共和国の権限のある当局と協力して、日本国の法令によって与えられたすべての刑事裁判権及び懲戒上の権限をすべての要員について行使する権利を有する。
8. The competent authorities of the Government of Japan shall have the right to exercise within the territory of the Republic of Djibouti, in cooperation with the competent authorities of the Republic of Djibouti, all the criminal jurisdiction and disciplinary powers conferred on them by the laws and regulations of Japan with regard to all Personnel.
９(a) 民間又は政府の財産の損害又は滅失に関する請求及び人の死亡又は傷害に関する請求は、当該請求の当事者間の協議を通じて友好的に解決する。
9. (a) Claims for damage to or loss of civilian or government property, as well as claims for death of or injury to persons, shall be settled amicably through consultation between the parties to the claims concerned.
(b) 友好的な解決に達することができない場合には、その紛争は、両政府による協議及び交渉を通じて解決する。
(b) Where no amicable settlement can be reached, the dispute shall be settled by the two Governments through consultations and negotiations.
10(a) ジブチ共和国の領土内に所在する要員は、有効な旅券、部隊の身分証明書、海上保安庁の身分証明書又は日本国政府の身分証明書を常に携帯しなければならない。
10. (a) The Personnel present on the land territory of the Republic of Djibouti must carry valid passports, identity cards of the Forces, identity cards of the Coast Guard or identity cards of the Government of Japan with them at all times.
(b) 部隊、海上保安庁、連絡事務所又は要員が使用する船舶、航空機、車両その他の輸送手段は、ジブチ共和国の法令に基づく免許又は登録に服さないものとし、日本国政府の明確な識別標識又は登録番号標を付されるものとする。ジブチ共和国の権限のある当局は、これらの識別標識又は登録番号標について事前に通報を受ける。
(b) The vessels, aircrafts, vehicles and other means of transport used by the Forces, the Coast Guard, the Liaison Offices or the Personnel shall not be subject to licensing or registration under the laws and regulations of the Republic of Djibouti and shall carry distinctive identification markings and/or registration plates of the Government of Japan, of which the competent authorities of the Republic of Djibouti shall be notified in advance.
(c) 部隊、海上保安庁及び連絡事務所は、それらの施設及び車両その他の輸送手段に日本国の国旗及び部隊の記章、名称、公の表象等の識別のための表示を掲げる権利を有する。
(c) The Forces, the Coast Guard and the Liaison Offices shall have the right to display the flag of Japan and distinctive markings such as insignia of the Forces, titles and official symbols on their facilities, vehicles and other means of transport.
11(a) 自衛官（部隊の船舶及び航空機の乗組員を除く。）は有効な旅券及び部隊の身分証明書を提示する場合にのみ、自衛官以外の要員は有効な旅券を提示する場合にのみ、ジブチ共和国の領域に入国する。要員は、ジブチ共和国への入国若しくは同国からの出国に当たり又は同国に所在する間、出入国審査及び税関検査を免除される。部隊の船舶及び航空機の乗組員、海上保安庁の航空機の乗組員並びに部隊の船舶に乗船する海上保安庁職員は、査証に関する規則の適用を免除される。
11. (a) Except for the crews of vessels and aircraft of the Forces, the Personnel of the Forces other than the civilian persons of the Ministry of Defense of Japan shall enter the territory of the Republic of Djibouti only on presentation of a valid passport and an identity card of the Forces and the other Personnel shall enter the territory of the Republic of Djibouti only on presentation of a valid passport. The Personnel shall be exempt from immigration inspections and customs control on entering, leaving or within the territory of the Republic of Djibouti. The crews of vessels and aircraft of the Forces, the crews of aircraft of the Coast Guard as well as the Personnel of the Coast Guard on board the vessels of the Forces shall be exempt from visa regulations.
(b) 要員は、外国人の登録及び管理に関するジブチ共和国の規則の適用を免除される。ただし、ジブチ共和国の領域内における永久的な居所又は住所を要求する権利を取得するものではない。
(b) The Personnel shall be exempt from the regulations of the Republic of Djibouti on the registration and control of aliens, but shall not acquire any right to permanent residence or domicile within the territory of the Republic of Djibouti.
(c) ジブチ共和国政府は、参考として、ジブチ共和国の領域に入る部隊、海上保安庁及び連絡事務所の資産の一覧表の提供を受ける。これらの資産は、日本国政府の識別標識を付されるものとする。部隊、海上保安庁及び連絡事務所は、他の税関書類を提出するいかなる義務も及びジブチ共和国の領域内におけるいかなる検査も免除される。
(c) The Government of the Republic of Djibouti shall be provided, for information purposes, with a general list of the assets of the Forces, the Coast Guard and the Liaison Offices entering the territory of the Republic of Djibouti. These assets shall carry identification markings of the Government of Japan. The Forces, the Coast Guard and the Liaison Offices shall be exempt from any requirement to produce other customs documentations, and from any inspection within the territory of the Republic of Djibouti.
(d) 要員は、場合に応じて日本国政府が発行した有効な国内の、国際的な又は部隊の運転免許証、船舶操縦免許証又は航空機操縦免許証を所持することを条件として、ジブチ共和国の領域内において自動車を運転し、並びに船舶及び航空機を操縦することができる。
(d) The Personnel may drive motor vehicles, navigate vessels and operate aircraft within the territory of the Republic of Djibouti provided they have valid national or international driving licenses, ship master’s certificates or pilot licenses or those of the Forces, as appropriate, issued by the Government of Japan.
(e) 活動のために、ジブチ共和国政府は、部隊、海上保安庁及び要員に対し、ジブチ共和国の領域（水域及び空域を含む。）内における移動の自由及び旅行の自由を認める。ジブチ共和国の領海内における移動の自由には、停船及び投びょうを含む。
(e) For the purpose of the activities, the Government of the Republic of Djibouti shall grant the Forces, the Coast Guard and the Personnel freedom of movement and freedom to travel within the territory of the Republic of Djibouti, including its waters and airspace. Freedom of movement within the territorial sea of the Republic of Djibouti shall include stopping and anchoring.
(f) 活動のために、部隊は、ジブチ共和国の水域内において、航空機又は軍事機器の発着又は積込みを行うことができる。
(f) For the purpose of the activities, the Forces may carry out, within the waters of the Republic of Djibouti, the launching, landing or taking on board of any aircraft or military device.
(g) 活動のために、部隊、海上保安庁及び連絡事務所並びにこれらが借り上げる輸送手段は、ジブチ共和国の領域内において、租税及びこれに類似する課徴金を支払うことなく、公道、橋、渡船施設、空港及び港を使用することができる。部隊、海上保安庁及び連絡事務所は、自らが要請して受けた役務に対する課徴金を免除されない。
(g) For the purpose of the activities, the Forces, the Coast Guard and the Liaison Offices as well as the means of transport that they charter may use public roads, bridges, ferries, airports and ports without the payment of taxes and similar charges within the territory of the Republic of Djibouti. The Forces, the Coast Guard and the Liaison Offices shall not be exempt from charges for services requested and received.
12 部隊隊員及び海上保安庁職員は、それぞれ、部隊の制服及び海上保安庁の制服を着用することができる。部隊隊員及び海上保安庁職員は、公務の遂行中に命令に基づきその使用が許可されることのある武器を所持し、又は携行することができる。
12. The Personnel of the Forces and the Personnel of the Coast Guard may wear the uniforms of the Forces and the uniforms of the Coast Guard, respectively. The Personnel of the Forces and the Personnel of the Coast Guard may possess and carry arms to be used in the performance of official duties when authorized to do so by their orders during their official duties.
13(a) ジブチ共和国政府は、要請がある場合には、適当な施設を見いだすことにつき、日本国政府を援助することに同意する。
13. (a) The Government of the Republic of Djibouti agrees, if requested, to assist the Government of Japan in finding suitable facilities.
(b) ジブチ共和国政府は、その有する手段及び能力の範囲内で、活動における準備、設定、実施及び支援を援助する。
(b) Within its means and capabilities, the Government of the Republic of Djibouti shall assist in the preparation, establishment, and execution of and support for the activities.
(c) 部隊、海上保安庁又は連絡事務所がジブチ共和国において締結する契約に適用される法令は、それぞれの契約によって決定される。
(c) The law applicable to contracts concluded by the Forces, the Coast Guard or the Liaison Office in the Republic of Djibouti shall be determined by the respective contracts.
(d) ジブチ共和国政府は、部隊、海上保安庁又は連絡事務所が活動のために商業的主体と締結する契約の実施を容易にする。
(d) The Government of the Republic of Djibouti shall facilitate the implementation of contracts concluded by the Forces, the Coast Guard or the Liaison Offices with commercial entities for the purpose of the activities.
14 部隊、海上保安庁及び連絡事務所は、ジブチ共和国政府の事前の許可を得て、活動及びこの取極の効果的な実施のための必要に応じ、施設を建造し、改造し、又はその他の方法によりこれを変更することが認められる。
14. The Forces, the Coast Guard and the Liaison Offices shall be authorized to construct, alter or otherwise modify facilities as requested for their requirements for the activities and for the effective implementation of the present arrangements, with prior permission of the Government of the Republic of Djibouti.
15(a) ジブチ共和国政府は、施設外において、部隊、海上保安庁、連絡事務所及び要員の安全を確保するためにすべての適当な措置をとる。
15(a) ジブチ共和国政府は、施設外において、部隊、海上保安庁、連絡事務所及び要員の安全を確保するためにすべての適当な措置をとる。
(b) 部隊、海上保安庁及び連絡事務所は、ジブチ共和国の領域（水域及び空域を含む。）内において、ジブチ共和国の権限のある当局と協力して、それらの施設、船舶及び航空機並びにそれらが保護する船舶を外部からの攻撃又は侵入から保護するために必要な措置をとることが認められる。
(b) The Forces, the Coast Guard and the Liaison Offices shall be authorized, within the territory of the Republic of Djibouti including its waters and airspace, to take the measures necessary to protect their facilities, vessels and aircraft, as well as the vessels that they protect, against any external attack or intrusion, in cooperation with the competent authorities of the Republic of Djibouti.
(c) 部隊は、その施設内の秩序を維持するため、警務隊を設置することができる。
(c) The Forces may establish a police unit in order to maintain order in their facilities.
(d) 部隊の警務隊は、また、ジブチ共和国の軍事警察又は警察と協議し及び協力して、部隊隊員の間の秩序及び規律の維持を確保するために施設外で行動することができる。
(d) The police unit of the Forces may also, in consultation and cooperation with the military police or the police of the Republic of Djibouti, act outside those facilities to ensure the maintenance of good order and discipline among the Personnel of the Forces.
(e) 部隊隊員及び海上保安庁職員が、逮捕した者を護送するためにジブチ共和国の領域を通過する場合には、当該者について必要な拘束の措置をとることが認められる。そのような通過は、ジブチ共和国の権限のある当局と緊密に協力して行われる。
(e) The Personnel of the Forces and the Personnel of the Coast Guard transiting through the territory of the Republic of Djibouti to escort persons arrested by them shall be authorized to apply the necessary measures of restraint with respect to these persons. Such transit shall be carried out in close cooperation with the competent authorities of the Republic of Djibouti.
16(a) 部隊及び連絡事務所は、無線送受信局及び衛星通信手段を設置し、及び運用することができる。部隊及び連絡事務所は、適当な周波数の使用に係る紛争を回避するため、ジブチ共和国の権限のある当局と協力する。ジブチ共和国政府は、周波数スペクトルへのアクセスを認める。
(e) The Personnel of the Forces and the Personnel of the Coast Guard transiting through the territory of the Republic of Djibouti to escort persons arrested by them shall be authorized to apply the necessary measures of restraint with respect to these persons. Such transit shall be carried out in close cooperation with the competent authorities of the Republic of Djibouti.
(b) 部隊及び連絡事務所は、無線（衛星、移動通信及び携帯用無線を含む。）、電話、電信、ファクシミリその他の手段による無制限の通信を行う権利並びにそれらの施設内及び施設間におけるそのような通信を維持するために必要な設備を設置する権利（活動のための電線及び地上通信線を敷設する権利を含む。）を享有する。
(b) The Forces and the Liaison Offices shall enjoy the right to unrestricted communication by radio (including satellite, mobile and hand-held radio), telephone, telegraph, facsimile and other means, as well as the right to install the equipment necessary for the maintenance of such communications within and between their facilities, including the laying of cables and land lines for the purpose of the activities.
(c) 部隊及び連絡事務所は、それらの施設内において、部隊、連絡事務所若しくは要員にあてられ、又は部隊、連絡事務所若しくは要員が差し出す郵便物を運送するために必要な措置をとることができる。
(c) Within their own facilities, the Forces and the Liaison Offices may take the measures necessary for the conveyance of mail addressed to or originating from them and/or the Personnel.
(d) 部隊とジブチ共和国の権限のある当局との間及び連絡事務所とジブチ共和国の権限のある当局との間で、この16の規定の実施手続を作成する。
(d) The implementing procedures for this paragraph shall be made between the Forces and the competent authorities of the Republic of Djibouti as well as the Liaison Offices and the competent authorities of the Republic of Djibouti.
17 両政府は、この取極の効果的な実施のために緊密に協力する。両政府は、ジブチ共和国の権限のある当局の海賊行為及び船舶に対する武装強盗に対処する法執行措置をとる能力の構築の必要性を認め、可能な二国間協力の分野を特定するために協力する。当該二国間協力に関し、両国の権限のある当局の間で別個の取決めを作成することができる。
17. The two Governments shall cooperate closely for the effective implementation of the present arrangements. The two Governments, recognizing the necessity of the capacity building of the competent authorities of the Republic of Djibouti in taking law enforcement measures to counter the acts of piracy and armed robbery against vessels, shall work together to identify areas for possible bilateral cooperation. Separate arrangements for the said bilateral cooperation may be made between the competent authorities of the two Governments.
18 この取極において部隊、海上保安庁、連絡事務所又は要員の特権、免除及び権利に言及がある場合には、ジブチ共和国政府は、その実施及びジブチ共和国の適当な地方公共団体によるその遵守について責任を負う。
18. Whenever the present arrangements refer to the privileges, immunities and rights of the Forces, the Coast Guard, the Liaison Offices or the Personnel, the Government of the Republic of Djibouti shall be responsible for their implementation and for compliance with them on the part of the appropriate local authorities of the Republic of Djibouti.
19 両政府は、特に連絡員を指定することにより、すべての適当な段階において、緊密なかつ相互の連絡を取るために適当な措置をとる。この取極の実施に関するすべての信書及び通信は、フランス語又は英語で行われる。
19. The two Governments shall take appropriate measures to establish a close and reciprocal liaison at all appropriate levels, in particular by designating liaison personnel. All correspondences and communications concerning the implementation of the present arrangements shall be made in French or English.
20 この取極の解釈又は実施から生ずる両政府間のいかなる紛争も、専ら両政府による協議及び交渉を通じて解決する。
20. Any dispute between the two Governments arising out of the interpretation or implementation of the present arrangements shall be settled exclusively by the two Governments through consultations and negotiations.
21(a) この取極は、十二箇月間効力を有するものとし、いずれか一方の政府が他方の政府に対し少なくとも六箇月の予告をもってこの取極を終了させる意思を通告しない限り、自動的に更に十二箇月ごとに更新される。
21. (a) The present arrangements shall remain in force for the period of twelve months and shall be automatically renewed for further periods of twelve months unless either Government notifies the other Government of its intention of terminating the present arrangements at least six months in advance.
(b) この取極は、両政府間の書面による合意によって改正することができる。
(b) The present arrangements may be amended by written agreement between the two Governments.
(c) この取極の終了は、当該終了の前にこの取極の実施から生じたいかなる権利及び義務にも影響を及ぼすものではない。
(c) The termination of the present arrangements shall not affect any rights or obligations arising out of the execution of the present arrangements before such termination.
この書簡は、ひとしく正文である日本語、フランス語及び英語により作成され、解釈に相違がある場合には、英語の本文によるものとします。
This Note is written in Japanese, French and English languages, each text being equally authentic, and in case of any divergences in interpretation, the English text shall prevail.
本大臣は、更に、この書簡及びジブチ共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that the present Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Djibouti the foregoing arrangements shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.
