債務救済措置（債務免除方式）に関する日本国政府とイエメン共和国政府との間の交換公文 
（訳文）
  　書簡をもって啓上いたします。本使は、日本国の借款に関してこの書簡の付表に掲げる日に日本国政府とイエメン共和国政府との間で交換された書簡（以下「従前の書簡Ⅰ」という。）、債務免除方式による債務救済措置に関して二千四年九月十五日に日本国政府とイエメン共和国政府との間で交換された書簡（以下「従前の書簡Ⅱ」という。）並びに開発途上国の債務及び開発の問題について千九百七十八年三月十一日に国際連合貿易開発会議第九回特別貿易開発理事会第三会期において採択された決議第百六十五号に関し、次の了解を日本国政府に代わって提案する光栄を有します。

Excellency, 

	With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of Yemen on the dates enumerated in the List attached hereto concerning Japanese loans (hereinafter referred to as “the Previous Notes I”),to the Notes exchanged between the Government of Japan and the Government of the Republic of Yemen on September 15, 2004 concerning a debt relief measure in the form of cancellation (hereinafter referred to as “the Previous Notes II”), and to the resolution 165 adopted at the Third Part of the Ninth Special Session of the Trade and Development Board of the United Nations Conference on Trade and Development on March 11, 1978 regarding debt and development problems of developing countries, I have the honour to propose on behalf of the Government of Japan the following understanding:


１　債務免除方式による債務救済措置が、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従ってとられることになる。
1.	A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by Japan Bank for International Cooperation (hereinafter referred to as “the Bank”).

２　免除される債務は、従前の書簡Ⅰに従って締結された借款契約に基づく次の債務（以下「債務」という。）から成る。
2.	(1)	The debts to be cancelled consist of the following debts under the loan agreements concluded in accordance with the Previous Notes I (hereinafter referred to as “the Debts”):

(a)　二千八年四月一日現在で償還されていないすべての元本
(b)　二千八年三月三十一日以前に生じた未払のすべての利子
(a)	all the principal outstanding as of April 1, 2008; and

(b)	all the interest having accrued on or before March 31, 2008 and not paid.


(2)　債務の総額は、十八億四千九百十七万七千二百二十円（一、八四九、一七七、二二〇円）になる。
(2)	The total amount of the Debts will be one billion eight hundred and forty-nine million one hundred and seventy-seven thousand two hundred and twenty yen (\1,849,177,220).

(3)　(2)に規定する総額は、日本国政府及びイエメン共和国政府の権限のある当局間の同意により修正することができる。日本国政府の権限のある当局は、外務省及び財務省であり、イエメン共和国政府の権限のある当局は、計画・国際協力省である。
(3)	Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of the Government of the Republic of Yemen.  The competent authorities of the Government of Japan will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authority of the Government of the Republic of Yemen will be the Ministry of Planning and 
International Cooperation.


  ３　債務は、イエメン共和国政府に対して銀行が行う免除の通告により免除されることになる。二千八年四月一日から当該通告の日までの間（両期日を含む。）における債務に対する利子は、課されない。

3.	The Debts will be cancelled by notification to that effect to be made by the Bank to the Government of the Republic of Yemen.  No interest will be charged on the Debts between April 1, 2008 and the date of such notification, both dates inclusive.

  ４　イエメン共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、イエメン共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。

4.	The Government of the Republic of Yemen shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and promote social and economic development of the Republic of Yemen, taking into account the fact that the Debts will be cancelled.

  ５　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

5.	The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.

６　従前の書簡Ⅱに述べられた了解は、この了解が効力を生ずる日からこの了解によって代替され、無効となる。
6.	The understanding contained in the Previous Notes II is superseded by the present understanding and shall be null and void from the date of entry into force of the present understanding.

　従前の書簡Ⅱに述べられた了解に基づき、一定の債務が、二千三年四月一日から二千四年三月三十一日までの二千三年度、二千四年四月一日から二千五年三月三十一日までの二千四年度、二千五年四月一日から二千六年三月三十一日までの二千五年度、二千六年四月一日から二千七年三月三十一日までの二千六年度及び二千七年四月一日から二千八年三月三十一日までの二千七年度の各事業年度における免除の日程に従って既に免除された。
(1)	The certain debts have been cancelled, pursuant to the understanding contained in the Previous Notes II, according to the schedule of cancellation for the fiscal years 2003, 2004, 2005, 2006, and 2007, which is respectively from April 1, 2003 to March 31, 2004, from April 1, 2004 to March 31, 2005, from April 1, 2005 to March 31, 2006, from April 1, 2006 to March 31, 2007, and from April 1, 2007 to March 31, 2008.

(2)　に規定する免除された債務の総額は、四十五億七百八十万千三百一円（四、五〇七、八〇一、三〇一円）であった。
(2)	The total amount of the debts cancelled referred to in sub-paragraph (1) above was four billion five hundred and seven million eight hundred and one thousand three hundred and one yen (\4,507,801,301).

本使は、更に、この書簡及び前記の了解をイエメン共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
  　本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
  　　二千八年八月三十日にサヌアで
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Yemen the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.

	I avail myself of this opportunity to renew to Your Excellency the assurance of my highest consideration.

I have further the honour to confirm on behalf of the Government of the Republic of Yemen the foregoing understanding and to agree that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this Note in reply.
