（地球規模の降水観測（ＧＰＭ）計画の開発及び運用活動に係る協力に関する日本国政府とアメリカ合衆国政府との間の交換公文）
（訳文） 書簡をもって啓上いたします。本使は、日本国政府の「宇宙開発に関する長期的な計画」の一部として独立行政法人宇宙航空研究開発機構（以下「機構」という。）が実施するマイクロ波放射計を搭載した国際副衛星群とともに降水観測を行うための二周波降水レーダー及び多周波マイクロ波放射計を搭載した主衛星の開発、打上げ及び運用並びにこれに関連する科学的及び利用活動のための地球規模の降水観測（ＧＰＭ）計画（以下「計画」という。）の開発及び運用活動に係る機構とアメリカ合衆国航空宇宙局（以下「ＮＡＳＡ」という。）との間の協力に関し日本国政府の代表者とアメリカ合衆国政府の代表者との間で行われた最近の討議に言及する光栄を有します。
Washington, December 19, 2008 Excellency: I have the honor to refer to the recent discussions between representatives of the Government of Japan and representatives of the Government of the United States of America concerning the cooperation between the Japan Aerospace Exploration Agency (hereinafter referred to as “JAXA”) and the National Aeronautics and Space Administration of the United States of America (hereinafter referred to as “NASA”) on the Development and Operations Activity of the Global Precipitation Measurement (GPM) mission for the development, launch and operation of a core observatory, carrying a dual frequency precipitation radar and a multi-channel passive microwave radiometer, to measure precipitation with an international constellation of satellites carrying passive microwave radiometers, and related science and application activities (hereinafter referred to as “the Program”), of which JAXA’s contribution will be undertaken as a part of the “Japanese Long-Term Program of Space Activities” of the Government of Japan. I have the further honor to request that Your Excellency confirms the understanding of the Government of the United States of America that the Development and Operations Activity of the Program corresponds to the activity in the Development Phase and Operations Phase as defined by JAXA, and to the activity in Phase C, Phase D, Phase E and Phase F as defined by NASA.
本使は、更に、計画の開発及び運用活動が、機構によって開発段階及び運用段階と明確にされる活動並びにＮＡＳＡによってＣ段階、Ｄ段階、Ｅ段階及びＦ段階と明確にされる活動にそれぞれ対応することについてアメリカ合衆国政府の理解の確認を要請する光栄を有します。 本使は、更に、宇宙空間の平和的な探査及び利用の分野において両政府の間に引き続いて存在する相互に有益な関係を考慮し、並びに千九百八十八年六月二十日にトロントで署名された科学技術における研究開発のための協力に関する日本国政府とアメリカ合衆国政府との間の協定であってその後、延長され、及び改正されたものに留意し、また、千九百九十五年四月二十四日にワシントンで署名された平和的目的のための宇宙の探査及び利用における協力のための損害賠償責任に係る相互放棄に関する日本国政府とアメリカ合衆国政府との間の協定及び代位請求に関する両政府間の同日付けの交換公文が計画に適用されることを再確認して、日本国政府に代わって次の取極を提案する光栄を有します。
In consideration of the continuing mutually beneficial relationship between the two Governments in the field of peaceful exploration and use of outer space; and taking into account the Agreement between the Government of Japan and the Government of the United States of America on Cooperation in Research and Development in Science and Technology, signed at Toronto, on June 20, 1988, as extended and amended; and reaffirming that the provisions of the Agreement between the Government of Japan and the Government of the United States of America Concerning Cross-Waiver of Liability for Cooperation in the Exploration and Use of Space for Peaceful Purposes, signed at Washington on April 24, 1995, and the Exchange of Notes of the same date between the two Governments concerning subrogated claims shall apply to the Program, I have the further honor to propose on behalf of the Government of Japan the following arrangements:
１ 計画の開発及び運用活動に係る機構とＮＡＳＡとの間の協力（以下「協力」という。）は、機構とＮＡＳＡとの間において合意される実施取決め（了解覚書）の条件に従って実施されることとなる。
1. The cooperation between JAXA and NASA on the Development and Operations Activity of the Program (hereinafter referred to as “the Cooperation”) will be conducted in accordance with the terms and conditions of implementing arrangements (Memorandum of Understanding) to be agreed upon by JAXA and NASA.
２ 協力は、それぞれの国において施行されている法令及び利用可能な予算に従って実施される。
2. The Cooperation will be conducted in accordance with the laws and regulations in force in each country and subject to the availability of appropriated funds.
３ 機構及びＮＡＳＡは、協力から又はそれに関連して生ずることのあるいかなる問題についても、相互に受け入れることのできる解決を図るために協議する。問題がそのような協議を通じて解決できない場合には、相互に受け入れることのできる解決を図るために外交上の経路を通じて両政府間の協議が行われる。
3. JAXA and NASA will consult with each other on any matter that may arise from or in connection with the Cooperation with a view to finding a mutually acceptable solution. If the matter cannot be resolved through such consultations, consultations between the Government of Japan and the Government of the United States of America shall be held through diplomatic channels with a view to finding a mutually acceptable solution.
４ この取極は、十年間効力を有するものとし、その後は、最初の十年の期間の終わりに、又はその後いつでもいずれか一方の政府が他方の政府に対しこの取極を終了させる意思を少なくとも六箇月の事前の通告をもって書面により外交上の経路を通じて表明することによって終了させない限り、引き続き効力を有する。この取極は、両政府間の相互の書面による合意により改正することができる。
4. The present arrangements shall remain in force for ten years and shall continue in force thereafter unless terminated by either Government at the end of the initial ten-year period or at any time thereafter by giving to the other Government at least six months’ written advance notice of its intention to terminate them through diplomatic channels. The present arrangements may be amended by mutual written agreement of the two Governments.
本使は、前記の取極がアメリカ合衆国政府にとって受諾し得るものであるときは、この書簡及び閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力が生ずるものとすることを提案する光栄を有します。 本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。 二千八年十二月十九日にワシントンで
I have the further honor to propose that, if the foregoing arrangements are acceptable to the Government of the United States of America, this Note and Your Excellency’s Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply. I have the further honor to confirm the understanding of the Government of the United States of America that the Development and Operations Activity of the Program corresponds to the activity in Phase C, Phase D, Phase E and Phase F as defined by NASA, and to the activity in the Development Phase and Operations Phase as defined by JAXA. I have the further honor to confirm on behalf of the Government of the United States of America that the foregoing arrangements are acceptable to the Government of the United States of America and to agree that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this Note in reply.
