（資金洗浄に関して没収された資産の分配に関する日本国政府とスイス連邦政府との間の交換公文）
（訳文） 書簡をもって啓上いたします。本使は、梶山進による資金洗浄に関して没収された資産であって、スイス連邦チューリッヒ州が保管するものの日本国政府とスイス連邦政府との間における分配に関し、両政府の代表者の間で最近行われた討議に言及するとともに、次の取極を日本国政府に代わって提案する光栄を有します。
Berne, April 22, 2008 Excellency, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Swiss Confederation concerning the sharing between the two Governments of the confiscated assets held by the Canton of Zurich, the Swiss Confederation, in the case of money laundering by Susumu Kajiyama, and propose on behalf of the Government of Japan the following arrangements:
１ スイス連邦政府は、日本国政府に対し、この取極の効力発生の日の後一箇月以内に、前記の資産の約五十パーセントに相当する二千八百九十七万九千七百三十八・八八スイス・フランを譲与する。
1. The Government of the Swiss Confederation shall transfer to the Government of Japan CHF 28,979,738.88, which represents approximately 50 percent of the abovementioned assets, within 1 month after the date of entry into force of the present arrangements.
２ 前記の梶山進による資金洗浄と同様の犯罪が行われた場合において、いずれの政府も、相互主義に基づき、かつ、自国の法令に従って、自国で没収された資産を他方の政府との間において分配するものとする。
2. Each Government will share the assets confiscated in its country with the other Government on a reciprocal basis and in accordance with its laws and regulations, when an offence similar to the abovementioned case takes place.
本使は、更に、この書簡及びスイス連邦政府に代わって前記の取極を確認する閣下の返簡が両政府間の合意を構成するものとし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Swiss Confederation the foregoing arrangements shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply. I avail myself of this opportunity to extend to Your Excellency the assurances of my highest consideration.
