（円借款の供与に関する日本国政府とインドネシア共和国政府との間の交換公文）
（訳文） 書簡をもって啓上いたします。本使は、インドネシア共和国の経済の安定及び開発努力を促進するために供与される日本国の借款に関して日本国政府の代表者とインドネシア共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Jakarta, March 18, 2008 Excellency, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Republic of Indonesia concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the Republic of Indonesia:
１ 二百二十億八千万円（二二、〇八〇、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、国際復興開発銀行による第四次開発政策借款及びアジア開発銀行による第三次開発政策支援計画の下での改革計画（以下「改革計画」という。）においてインドネシア共和国政府を支援することを目的として、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。
1. A loan in Japanese yen up to the amount of twenty-two billion eighty million yen (\22,080,000,000) (hereinafter referred to as “the Loan”) will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by Japan Bank for International Cooperation (hereinafter referred to as “the Bank”) for the purpose of supporting the Government of the Republic of Indonesia in its reform program under the Fourth Development Policy Loan by the International Bank for Reconstruction and Development and the Third Development Policy Support Program by the Asian Development Bank (hereinafter referred to as “the Reform Program”).
２(1) 借款は、インドネシア共和国政府と銀行との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規律される。
2. (1) The Loan will be made available by a loan agreement to be concluded between the Government of the Republic of Indonesia and the Bank. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:
(a) 償還期間は、五年の据置期間の後十年とする。 (b) 利子率は、年〇・七パーセントとする。 (c) 支出期間は、前記の借款契約の発効の日の後三年とする。
(a) The repayment period will be ten (10) years after the grace period of five (5) years; (b) The rate of interest will be nought point seven per cent (0.7%) per annum; and (c) The disbursement period will be three (3) years after the date of coming into force of the said loan agreement.
(2) (1)(c)に規定する支出期間は、両政府の関係当局の同意を得て延長することができる。
(2) The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.
３(1) 借款は、インドネシアの実施機関及びインドネシア共和国内の輸入者が調達適格国の供給者、請負業者又はコンサルタントに対して既に行ったか又は行う支払で、生産物（両政府の関係当局間で合意する表に掲げる生産物を除く。）の購入又は当該生産物の購入に付随する役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3. (1) The Loan will be made available to cover payments already made and/or to be made by the Indonesian executing agencies and importers in the Republic of Indonesia to suppliers, contractors and/or consultants of eligible source countries under such contracts as have been and/or may be entered into between them for purchases of products, except such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, and/or for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(2) (1)に規定する表は、両政府の関係当局間の合意によって修正することができる。
(2) The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.
(3) (1)に規定する調達適格国の範囲は、両政府の関係当局間で合意される。
(3) The scope of eligible source countries mentioned in sub-paragraph (1) above shall be agreed upon between the authorities concerned of the two Governments.
４ インドネシア共和国政府は、インドネシア共和国政府の名義でインドネシア銀行に開設される国家予算勘定に借款の円貨による支出額に等しい額をインドネシアの通貨で振り替えるようにするための措置をとる。このようにして振り替えられた額は、インドネシア共和国政府の国家予算に編入され、インドネシア共和国政府による改革計画の実施を支援するために使用される。
4. The Government of the Republic of Indonesia shall take measures to have the equivalent in Indonesian currency of the amount of yen disbursements of the Loan transferred to the state budget account opened in the name of the Government of the Republic of Indonesia at Bank Indonesia. The amount thus transferred shall be included in the state budget of the Government of the Republic of Indonesia, and shall be used to support the implementation of the Reform Program by the Government of the Republic of Indonesia.
５ 借款の元本の償還並びに利子及びその他いかなる課徴金の支払の責任も、インドネシア共和国政府が負う。
5. The Government of the Republic of Indonesia shall bear the responsibility for the repayment of principal of the Loan, as well as the payment of interest and any other charges thereon.
６ インドネシア共和国政府は、３(1)に規定する生産物又は役務が銀行の調達のためのガイドライン（国際競争入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際競争入札の手続をなかんずく定める。）に従って調達されることを確保する。
6. The Government of the Republic of Indonesia shall ensure that the products and/or services mentioned in sub-paragraph (1) of paragraph 3. are procured in accordance with the guidelines for procurement of the Bank, which set forth, inter alia, the procedures of international competitive bidding to be followed except where such procedures are inapplicable or inappropriate.
７ インドネシア共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限を課することも差し控える。
7. With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of the Republic of Indonesia shall refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.
８ インドネシア共和国政府は、銀行について、借款及びそれから生ずる利子に対して又はそれらに関連して課されるインドネシアの財政課徴金及び租税を免除する。
8. The Government of the Republic of Indonesia shall exempt the Bank from Indonesian fiscal levies and taxes on and/or in connection with the Loan as well as interest accruing therefrom.
９ インドネシア共和国政府は、借款が適正にかつ専ら３(1)に規定する生産物又は役務の購入のために使用されることを確保するために必要な措置をとる。
9. The Government of the Republic of Indonesia shall take necessary measures to ensure that the Loan be used properly and exclusively for purchases of the products and/or services mentioned in sub-paragraph (1) of paragraph 3.
10 インドネシア共和国政府は、要請に応じ、日本国政府及び銀行に対し、借款の使途及び改革計画の進(ちよく)状況についての情報及び資料を提供する。
10. The Government of the Republic of Indonesia shall, upon request, furnish the Government of Japan and the Bank with information and data concerning the use of the Loan and the progress of the implementation of the Reform Program.
11 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
11. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.
本使は、更に、この書簡及び前記の了解をインドネシア共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Indonesia the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply. I avail myself of this opportunity to renew to Your Excellency the assurance of my highest consideration.
