８ この取極は、いずれの一方の国の法令に定める条件であって、年齢、並びに身体及び精神の健康上の要件に関するものにも影響を及ぼすものではない。
8. The present arrangement shall not affect the conditions set out by the laws and regulations of either country regarding age, physical and mental health requirements.
訳文） 書簡をもって啓上いたします。本大臣は、相手国の権限のある当局が付与した運転免許を有する者に対して自国の権限のある当局が運転免許を付与する際の手続に関して、日本国政府の代表者とハンガリー共和国政府の代表者との間で行われた最近の協議に言及する光栄を有します。本大臣は、更に、次の取極を日本国政府に代わって提案する光栄を有します。
Tokyo,17 March, 2008 Excellency, I have the honour to refer to the recent consultations between the representatives of the Government of Japan and of the Government of the Republic of Hungary concerning the procedures for the competent authorities of one country to issue a driving permit to a person holding a driving permit issued by the competent authorities of the other country. I have further the honour to propose on behalf of the Government of Japan the following arrangement:
１ この取極の適用上、「運転免許」とは、日本国の権限のある当局が付与する第一種運転免許及びハンガリー共和国の権限のある当局が付与する国際区分運転免許（仮運転免許及び旅客自動車運送事業において旅客を運送する目的で自動車を運転することを許可するための運転免許を除く。）をいう。
1. For the purpose of the present arrangement, the term “Driving Permit” shall mean the “basic-class” driving permit issued by the competent authorities of Japan, and the driving permit “validated in international category” issued by the competent authorities of the Republic of Hungary other than the temporary driving permit as well as the permit for driving motor vehicles for the purpose of transporting passengers in the passenger motor vehicle transportation business.
２ いずれの国の権限のある当局も、他方の国の権限のある当局が付与した運転免許を有する者からの運転免許の申請を受けて次のことを行うに際し、自国の法令に従い実技試験及び筆記試験を免除する。
2. In accordance with its laws and regulations, the competent authorities of either country shall, in taking the following measures, exempt from examination of technical skill and that of knowledge for a Driving Permit when they issue a Driving Permit equivalent in kind to a Driving Permit issued by the competent authorities of the other country upon relevant requests submitted by interested persons:
(a) 日本国の権限のある当局に関しては、ハンガリー共和国の権限のある当局が付与した運転免許の種類と同等の日本国の運転免許の付与
a) With regard to the competent authorities of Japan, the issuance of the Driving Permit of Japan whose category is equivalent to the corresponding category of the Driving Permit issued by the competent authorities of the Republic of Hungary.
(b) ハンガリー共和国の権限のある当局に関しては、非職業用のハンガリー共和国の運転免許を、当該運転免許の種類と同等の運転免許であって日本国の権限のある当局が付与したものと交換すること。その交換は、ハンガリー共和国の権限のある当局が付与した滞在許可を有する者についてのみ行うことができる。
b) With regard to the competent authorities of the Republic of Hungary, the exchange of the non-professional Driving Permit whose category is equivalent to the corresponding category of the Driving Permit issued by the competent authorities of Japan. The exchange may apply only to persons who have a residence permit issued by the competent authorities of the Republic of Hungary.
３ いずれの国の権限のある当局も、英語、ハンガリー語及び日本語により作成され、両国政府が外交上の経路を通じて交換する運転免許の種類対照表に従って、他方の国の権限のある当局が付与した運転免許により運転することができる車両の種類を、自国の法令の下で対応する車両の種類と同等のものであるとみなし、及びこの取極の規定に基づき当該運転免許の種類と同等の運転免許を付与する。 いずれの政府も、当該表に影響を与える法令の改正について、できる限り速やかに、外交上の経路を通じて他方の政府に通報する。
3. The competent authorities of either country, according to the “Table of equivalent categories/classes of Driving Permit” which is written in English, Hungarian and Japanese languages and is exchanged between the two Governments through diplomatic channels, deem the categories of vehicles which can be driven by a Driving Permit issued by the competent authorities of the other country as equivalent to the corresponding categories of vehicles under the laws and regulations of the former country, and issue the equivalent Driving Permit under the provisions of the present arrangement. Either Government shall, as promptly as possible, notify the other Government of any modification of the laws and regulations affecting the above-mentioned Table through diplomatic channels.
４ いずれの国の権限のある当局も、当該国の運転免許を申請する者に対し、他方の国の権限のある当局が交付した運転免許証の原本を認証された翻訳文と共に提出することを求めることができる。いずれの国の権限のある当局も、他方の国の外交使節団又は領事使節団が作成する認証された翻訳文を受け入れる。
4. The competent authorities of either country may ask the person who applies for a Driving Permit of that country to submit the original Driving Permit issued by the competent authorities of the other country, accompanied by a certified translation. The competent authorities of either country shall accept the certified translation made by the diplomatic or consular mission of the other country.
５ いずれの政府も、他方の国の権限のある当局が交付した運転免許証が真正なものであるかどうかにつき自国の権限のある当局が疑義を有する場合には、他方の政府に対し確認を要請することができる。
5. Either Government may seek confirmation from the other Government when the competent authorities of the former country have a doubt about the authenticity of the Driving Permit issued by the competent authorities of the latter country.
６ いずれの政府も、他方の政府の要請に基づき、自国の運転免許証の様式、自国の運転免許と他方の国の運転免許との同等性及び運転免許に係る制度に関する情報を提供する。
6. Either Government shall, upon the request of the other Government, provide information on the form of the Driving Permit of the country of the former Government, the equivalence of such Driving Permit to the Driving Permit of the other country and the system concerning Driving Permit.
７ この取極の規定は、運転免許を申請する者に対し、それぞれの国の法令に従い行政上の手続のために必要とされる健康証明書を含む書類の提出、手数料の支払等の手続を免除するものではない。
7. The provisions of the present arrangement do not exempt a person who applies for a Driving Permit from such procedures as the submission of documents including the health certificate and the payment of fees, which may be required for administrative process under the laws and regulations of each country.
８ この取極は、いずれの一方の国の法令に定める条件であって、年齢、並びに身体及び精神の健康上の要件に関するものにも影響を及ぼすものではない。
8. The present arrangement shall not affect the conditions set out by the laws and regulations of either country regarding age, physical and mental health requirements.
９ ハンガリー共和国の権限のある当局は、この取極に基づく運転免許の交換の後、日本国の運転免許証を在ハンガリー日本国大使館に送付することができる。
9. After the exchange of the Driving Permit under the present arrangement, the competent authorities of the Republic of Hungary may forward the Japanese Driving Permit to the Embassy of Japan in the Republic of Hungary.
10 この取極は、千九百四十九年の道路交通に関する条約に基づくいずれの国のいかなる権利及び義務並びに千九百六十八年の道路交通に関する条約に基づくハンガリー共和国のいかなる権利及び義務にも影響を及ぼすものではない。
10. The present arrangement shall not affect any rights and obligations of either country under the Convention on Road Traffic of 1949, and of the Republic of Hungary under the Convention on Road Traffic of 1968.
11 この取極は、それぞれの国において効力を有する法令に従って実施される。
11. The present arrangement shall be implemented in accordance with the laws and regulations in force in each country.
12 いずれの政府も、他方の政府に対し三十日前に文書による通告を与えることにより、この取極を終了させることができる。
12. Either Government may terminate the present arrangement by giving thirty days’ written notice to the other Government.
本大臣は、更に、この書簡及びハンガリー共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意がそれぞれの政府がこの取極の効力発生のために必要な国内手続を完了したことを確認する外交上の経路を通じた文書による通告を行った日であっていずれか遅い方の日付の日の後三十日目の日に効力を生ずるものとすることを提案する光栄を有します。 本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。 二千八年三月十七日に東京で
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming the foregoing arrangement on behalf of the Government of the Republic of Hungary shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the thirtieth day after the latter of the dates of the written notifications through diplomatic channels by which the two Governments confirm that their respective internal procedures required for its entry into force have been completed. I avail myself of this opportunity to renew to Your Excellency the assurances of my highest consideration.

I have further the honour to inform Your Excellency, on behalf of the Government of the Republic of Hungary, that the arrangement set forth in Your Excellency’s Note is acceptable to the Government of the Republic of Hungary and to confirm that Your Excellency’s Note and this Note in reply shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the thirtieth day after the latter of the dates of the written notifications through diplomatic channels by which the two Governments confirm that their respective internal procedures required for its entry into force have been completed.
