（原子力の平和的利用における協力のための日本国政府と中華人民共和国政府との間の協定についての合意された議事録に規定する相互に受諾可能な取極に関する交換公文） 
書簡をもって啓上いたします。本使は、千九百八十五年七月三十一日に東京で署名された原子力の平和的利用における協力のための日本国政府と中華人民共和国政府との間の協定（以下「協定」という。）及び協定についての合意された議事録に言及する光栄を有します。
  　本使は、更に、前記の合意された議事録の規定に従って両政府間で行われた最近の協議に言及するとともに、前記の合意された議事録に規定する相互に受諾可能な取極として、次の取極を日本国政府に代わって提案する光栄を有します。
Beijing, June 6, 2008

Excellency,

	I have the honour to refer to the Agreement between the Government of Japan and the Government of the People’s Republic of China for Cooperation in the Peaceful Uses of Nuclear Energy signed at Tokyo on July 31, 1985 (hereinafter referred to as “the Agreement”) and the Agreed Minutes to the Agreement.

	I have further the honour to refer to the recent consultations held between the two Governments in accordance with the said Agreed Minutes and to propose on behalf of the Government of Japan the following arrangements as mutually acceptable arrangements referred to in the said Agreed Minutes:


  １　両政府は、両国における原子力活動を妨げ若しくは遅延させ、又はこれに対して不当に干渉することを回避する必要性を認識して、協定の規定に従って原子力の平和的利用のために協力することが確認される。

1.	It is confirmed that the two Governments, recognizing the need to avoid hampering, delay or undue interference in the nuclear activities in the two countries, shall cooperate for the peaceful uses of nuclear energy in accordance with the provisions of the Agreement.

２　協定第四条に関し、協定の効果的な実施のため、両政府は、相互に合意した形式を用い、協定の適用を受ける核物質、資材、設備及び施設の最新の在庫目録を一年単位で交換することが確認される。
2.	With reference to Article IV of the Agreement, it is confirmed that, for the effective implementation of the Agreement, the two Governments shall exchange on an annual basis the then current inventories of nuclear material, material, equipment and facilities subject to the Agreement, using the format as mutually agreed.

３　中華人民共和国政府の管轄内において、協定に基づき日本国から受領された核物質、資材、設備及び施設が置かれる施設は、千九百八十八年九月二十日に署名された中国における保障措置の適用のための中華人民共和国と国際原子力機関（以下「機関」という。）との間の協定に基づく機関による保障措置の適用について適格性を有する施設として、中華人民共和国政府より機関に対して通報される。
3.	Within the jurisdiction of the Government of the People’s Republic of China, facilities at which nuclear material, material, equipment and facilities received from Japan pursuant to the Agreement are located, shall be notified to the International Atomic Energy Agency (hereinafter referred to as “the Agency”) by the Government of the People’s Republic of China as facilities which are eligible for the application of safeguards by the Agency pursuant to the Agreement between the People’s Republic of China and the Agency for the Application of Safeguards in China, signed on September 20, 1988.

４　協定の適用を受ける回収され又は副産物として生産された特殊核分裂性物質であって中華人民共和国政府の管轄内にあるものは、機関による保障措置の適用について適格性を有する施設以外の施設に置かれないことが確認される。
4.	It is confirmed that special fissionable material recovered or produced as a by-product subject to the Agreement within the jurisdiction of the Government of the People’s Republic of China will not be located at facilities other than facilities which are eligible for the application of safeguards by the Agency.

５　協定の適用を受ける核物質、資材、設備又は施設が、機関による保障措置の適用について適格性を有するが機関が保障措置の適用上選択していない施設に置かれることとなる場合には、中華人民共和国政府は、次の補助的措置をとる。
5.	When any nuclear material, material, equipment or facilities subject to the Agreement is to be located at facilities which are eligible for the application of safeguards by the Agency but not selected by the Agency for the application of safeguards, the Government of the People’s Republic of China shall take supplementary measures as follows:

(a)　協定の適用を受けるすべての核物質は、中華人民共和国において効力を有する関係法令に従って、協定及びこの取極の実施のための適当な国内の核物質計量管理制度の対象とされる。
(b)　中華人民共和国政府は、日本国政府に対し、機関による保障措置の適用について適格性を有する施設の一覧表を毎年提供する。
(c)　中華人民共和国政府は、日本国政府に対し、相互に合意した形式を用い、協定の適用を受ける核物質、資材、設備及び施設の在庫、払出し及び受入れに関する報告書を施設ごとに一年単位で提供する。
(d)　中華人民共和国政府は、実施可能な範囲内で、機関が保障措置の適用上選択している施設にある同量の核物質であって核分裂性同位元素の含有量が同等以上のものによる代替を実施することができるものとし、この場合には、日本国政府に対し、当該核物質に代わる核物質の在庫を含む関連情報を一年単位で提供する。
(a)	All nuclear material subject to the Agreement shall be covered by the appropriate national system of accounting for and control of nuclear material for the implementation of the Agreement and these arrangements in accordance with relevant laws and regulations in force in the People’s Republic of China;

(b)	The Government of the People’s Republic of China shall provide to the Government of Japan annually the list of facilities which are eligible for the application of safeguards by the Agency;

(c)	The Government of the People’s Republic of China shall provide to the Government of Japan a report by facility on an annual basis of inventories, shipments and receipts of nuclear material, material, equipment and facilities subject to the Agreement, using the format as mutually agreed; and

(d)	The Government of the People’s Republic of China may implement, to the extent practicable, the substitution of nuclear material of the same quantity and equivalent or higher isotopic content in the fissionable isotopes at facilities which the Agency has selected for the application of safeguards and, in such a case, shall provide on an annual basis the Government of Japan with relevant information including the inventories of nuclear material substituted for such nuclear material.


６　この取極の解釈又は適用に関して問題が生じた場合には、両政府は、いずれか一方の政府の要請に基づき、協定についての合意された議事録４の規定に従って相互に協議する。
6.	The two Governments shall, at the request of either of them, consult with each other, subject to paragraph 4 of the Agreed Minutes to the Agreement, if any question arises out of the interpretation or application of these arrangements.



本使は、更に、この書簡及び中華人民共和国政府に代わって前記の取極を確認する閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
  　この書簡は、ひとしく正文である日本語、中国語及び英語により作成され、解釈に相違がある場合には、英語の本文によるものとします。
  　本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the People’s Republic of China the foregoing arrangements shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.

	This Note is written in the Japanese, Chinese and English languages, all three texts being equally authentic.  In case of any divergence of interpretation, the English text shall prevail.

	I avail myself of this opportunity to extend to Your Excellency the assurance of my highest consideration.
