  　書簡をもって啓上いたします。本使は、二千七年四月二十日にパリで開催された中央アフリカ共和国政府の代表者と関係債権諸国（以下「債権諸国」という。）政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者と中央アフリカ共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認する光栄を有します。

Excellency,

	I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Central African Republic that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Central African Republic and of the Governments of the creditor countries concerned (hereinafter referred to as “the Creditor Countries”) held in Paris on April 20, 2007.  I have further the honour to confirm the following understanding reached in the course of the said negotiations:


１　債務支払猶予方式による債務救済措置が、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従ってとられることになる。
1.	A debt relief measure in the form of deferral will be taken in accordance with the relevant laws and regulations of Japan by Japan Bank for International Cooperation (hereinafter referred to as “the Bank”).

２　支払を猶予される債務（以下「支払猶予債務」という。）は、中央アフリカ共和国政府が銀行に対して負う次の債務から成る。
  円借款の供与に関して中央アフリカ共和国政府と海外経済協力基金（以下「基金」という。）との間で千九百八十八年六月十七日に締結された借款契約に基づいて支払われるべき債務に関し、千九百九十年十二月二十日から二千二年十二月二十日までの間（両期日を含む。）に弁済期限の到来した未払の元本及び契約上の利子（遅延利子を含む。）の百パーセント（それらの内訳は、この書簡の付表に掲げられる。）
(2)　支払猶予債務の総額は、二億五千九百二十四万四千百九十円（二五九、二四四、一九〇円）になる。
(3)　(2)に規定する総額及びこの書簡の付表は、中央アフリカ共和国政府の関係当局及び銀行が行う最終的照合の後に、日本国政府及び中央アフリカ共和国政府の関係当局間の合意により修正されることがある。
2.	(1)	The debts to be deferred (hereinafter referred to as “the Deferred Debts”) consist of the following debts which the Government of the Central African Republic owes to the Bank:

	For the debts payable under the Loan Agreement concluded on June 17, 1988 between the Government of the Central African Republic and the Overseas Economic Cooperation Fund （hereinafter referred to as “the Fund”）on the extension of Yen Loan, a hundred per cent (100%) of the principal and contractual interest (including late interest) having fallen due between December 20, 1990 and December 20, 2002 and not paid, both dates inclusive, the breakdown of which is shown in the List attached hereto.

(2)	The total amount of the Deferred Debts will be two hundred and fifty-nine million two hundred and forty-four thousand one hundred and ninety yen (\259,244,190).

(3)	Modifications may be made to the total amount referred to in sub-paragraph (2) above and to the List attached hereto by mutual consent between the authorities concerned of the Government of Japan and of the Government of the Central African Republic, after the final verification to be made by the authorities concerned of the Government of the Central African Republic and the Bank.


３　債務支払猶予の条件は、中央アフリカ共和国政府と銀行との間で締結される債務支払猶予契約であって、なかんずく次の原則を含むものにおいて規定される。
3.	The terms and conditions of the deferral will be stipulated in a deferral agreement to be concluded between the Government of the Central African Republic and the Bank which will contain, inter alia, the following principles:

(1)  支払猶予債務の総額は、二千十年十二月一日に始まる五回の均等年賦払によって支払われる。
(1)	The total amount of the Deferred Debts will be paid in five (5) equal annual installments beginning on December 1, 2010.

(2)  支払猶予債務に対する利子率は、年〇・〇一パーセントとし、二千六年十二月一日から適用される。
(2)	The rate of interest on the Deferred Debts will be nought point nought one per cent (0.01%) per annum and it will be applied from December 1, 2006.

４　中央アフリカの債務（この了解が対象とする債務を含む。）の再編に関連して中央アフリカ共和国政府の代表者及び債権諸国政府の代表者が新たな結論に到達した場合には、日本国政府と中央アフリカ共和国政府は、この了解の継続又は修正について討議するための協議を行う。
4.	If the representative of the Government of the Central African Republic and the representatives of the Governments of the Creditor Countries come to a new conclusion in connection with reorganization of the Central African debts including the debts covered by the present understanding, the Government of Japan and the Government of the Central African Republic shall hold consultations in order to discuss the matter of continuation or modification of the present understanding.

本使は、更に、この書簡及び前記の了解を中央アフリカ共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
  　本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Central African Republic the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.

	I avail myself of this opportunity to extend to Your Excellency the assurance of my highest consideration.
