    書簡をもって啓上いたします。本使は、日本国とブルガリア共和国との間の文化交流を促進するため日本文化ボランティア・プログラム（以下「プログラム」という。）に基づきボランティアをブルガリア共和国に派遣することに関し、日本国政府の代表者とブルガリア共和国政府の代表者との間でソフィアにおいて行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わって確認する光栄を有します。

Excellency,

	I have the honour to refer to the recent discussions held in Sofia between the representatives of the Government of Japan and the Government of the Republic of Bulgaria concerning the dispatch of volunteers to the Republic of Bulgaria under the Japan Culture Volunteers Program (hereinafter referred to as “the Program”) with a view to promoting cultural exchange between the two countries, and to confirm on behalf of the Government of Japan the following understanding reached between them:


１　日本国政府は、日本国の現行法令に従い、ブルガリア共和国における日本語及び日本国の文化の普及に寄与するため、両政府の関係当局間で個別に合意される計画に従いボランティアをブルガリア共和国に派遣するために必要な措置をとる。日本国政府は、また、日本国の現行法令に従い、ブルガリア共和国におけるボランティアの活動に関連する任務を遂行するプログラムのための調整員を在ブルガリア日本国大使館の事務及び技術職員としてブルガリア共和国に派遣するために必要な措置をとる。当該調整員は、在ブルガリア日本国大使館の事務及び技術職員としてブルガリア共和国政府に通告される。
1.	The Government of Japan will, in accordance with the laws and regulations in force in Japan, take necessary measures to dispatch the volunteers to the Republic of Bulgaria for the purpose of contributing to the diffusion of Japanese language and Japanese culture in the Republic of Bulgaria, according to the schedules to be separately agreed upon between the authorities concerned of the two Governments.  The Government of Japan will, in accordance with the laws and regulations in force in Japan, also take necessary measures to dispatch the coordinators for the Program to the Republic of Bulgaria as members of the administrative and technical staff of the Embassy of Japan in the Republic of Bulgaria, who will discharge the functions related to the activities of the volunteers in the Republic of Bulgaria.  Such coordinators will be notified to the Government of the Republic of Bulgaria as members of the administrative and technical staff of the Embassy of Japan in the Republic of Bulgaria.

２　日本国政府は、予算措置がとられることを条件として、ボランティアの日本国とブルガリア共和国との間の渡航費及びブルガリア共和国における生活手当を負担し、また、ボランティアの任務の遂行に必要な装備、機器及び資材並びに個人的な使用のための医薬品を供与するために必要な措置をとる。
2.	The Government of Japan will, subject to budgetary appropriations, take necessary measures to bear the cost 
of international travel between Japan and the Republic of Bulgaria and living allowances in the Republic of Bulgaria for the volunteers, and to make available such equipment, machinery, materials as may be necessary for the performance of their functions as well as medical supplies for their personal use.


３　ブルガリア共和国政府は、ボランティア及び調整員に対し、その任期中、ブルガリア共和国に入国し、同国から出国し、及び同国に滞在することを許可し、並びに同国に入国し、同国から出国し、及び同国に滞在するために必要な登録が行われるように取り計らう。
3.	The Government of the Republic of Bulgaria shall permit the volunteers and the coordinators to enter, leave and sojourn in the Republic of Bulgaria for the duration 
of their assignment therein and arrange their registration necessary to enter, leave and sojourn in the Republic of Bulgaria.


４　ブルガリア共和国政府は、ボランティアに対し、次の特権、免除及び便宜を与えるために必要な措置をとる。
4.	The Government of the Republic of Bulgaria shall take necessary measures to grant the volunteers the following privileges, exemptions and benefits:

(i)　所得に対する租税に関する二重課税の回避及び脱税の防止のための日本国とブルガリア共和国との間の条約第十九条１(a)の規定に従って、２に規定する生活手当等のボランティアに対して日本国政府から送付される報酬又は手当に関して、所得税その他の課徴金を免除すること。
(ii)　ブルガリア共和国の受入機関に対する予算措置がとられることを条件として、ボランティアがブルガリア共和国政府により与えられる任務を遂行する場所における無料の基本家具付住居施設を提供すること。
(iii)　ボランティアの任務の遂行を容易にするためボランティアに対しブルガリア共和国政府による身分証明書を交付すること。
(i)	Exemption, in accordance with paragraph 1 (a) of Article 19 of the Convention between Japan and the Republic of Bulgaria for the Avoidance of Double Taxation and the Prevention of Fiscal Evasion with respect to Taxes on Income, from income taxes and charges of any kind on any emoluments or allowances to be remitted to them from the Government of Japan such as the living allowances mentioned in paragraph 2 above;

(ii)	Free housing with basic furnishings at places where they are to perform their functions to be assigned to them by the Government of the Republic of Bulgaria, subject to the budgetary appropriations of the recipient Bulgarian institutions; and

(iii)	Issuance of identification cards from the Government of the Republic of Bulgaria to the volunteers to facilitate the performance of their functions.


５　ブルガリア共和国政府は、調整員に対し、千九百六十一年四月十八日の外交関係に関するウィーン条約に基づいて事務及び技術職員が享受する特権及び免除を与える。
5.	The Government of the Republic of Bulgaria shall accord the coordinators the privileges and immunities enjoyed by members of the administrative and technical staff pursuant to the Vienna Convention on Diplomatic Relations of 18 April 1961.

６　ブルガリア共和国政府は、調整員に対し、その任務の遂行を容易にするため身分証明書を交付する。
6.	The Government of the Republic of Bulgaria shall issue identification cards to the coordinators to facilitate the performance of their functions.

７　両政府は、いずれか一方の政府の要請により、ブルガリア共和国におけるプログラムの実施を成功させるため、適当なレベルで協議する。

7.	The two Governments will hold consultations at appropriate levels at the request of either of them for the successful implementation of the Program in the Republic of Bulgaria.

８　この了解は、両政府間の書簡の交換によって修正することができ、かつ、いずれか一方の政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によって通告することにより終了させることができる。
8.	The understanding set out above may be amended by an exchange of notes between the two Governments and terminated by either Government by giving to the other six months’ written notice of its intention to terminate it.  

本使は、更に、この書簡及び前記の了解をブルガリア共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
    本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Bulgaria the foregoing understanding shall constitute an agreement between the two Governments, which will enter into force on the date of Your Excellency’s reply.

	I avail myself of this opportunity to renew to Your Excellency the assurance of my highest consideration.

I have further the honour to confirm on behalf of the Government of the Republic of Bulgaria the foregoing understanding and to agree that Your Excellency’s Note and this Note shall constitute an agreement between the two Governments, which will enter into force on the date of this reply.
