航空業務に関する日本国とグレート･ブリテン及び北部アイルランド連合王国との間の協定の付表の修正に関する交換公文

(BRITISH NOTE)

　Tokyo, September 10, 1990

　　書簡をもって啓上いたします。本大臣は、千九百五十二年十二月二十九日に東京で署名された航空業務に関するグレート･ブリテン及び北部アイルランド連合王国と日本国との間の協定に言及するとともに、この書簡に添付されている前記の協定の新たな付表が、千九百六十七年八月二十二日、千九百六十九年六月十七日、千九百七十年五月二十六日、千九百七十七年四月十五日及び千九百八十八年九月十六日に修正された現行の付表に代わるべきことをグレート･ブリテン及び北部アイルランド連合王国政府に代わって提案する光栄を有します。

　Excellency,
I have the honour to refer to the Agreement between the United Kingdom of Great Britain and Northern Ireland and Japan for Air Services, signed at Tokyo on 29 December 1952, and to propose on behalf of the Government of the United Kingdom and Northern Ireland that the new Schedule of the aforementioned Agreement as set out in the Attachment shall replace the existing Schedule amended on 22 August 1967, 17 June 1969, 26 May 1970, 15 April 1977 and 16 September 1988.

　　本大臣は、更に前記の提案が日本国政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡が両国政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　If the foregoing proposal is acceptable to the Government of Japan, I have further the honour to propose that this Note and Your Excellency's Note in reply indicating such acceptance shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the date of Your Excellency's reply.

　　本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

SCHEDULE SECTION I

　Routes to be operated by the designated airline or airlines of Japan:-

(1)　日本国内の地点－中国本土における協定地点及び(又は)台湾における地点－香港又はマニラーヴィエトナム、ラオス及びカンボディア内の地点－バンコック－ミャンマー内の地点－コロンボ－バングラデシュ、インド及びパキスタン内の地点－中東内の地点－ローマ－チューリッヒ又はジュネーヴ－フランクフルト･アム･マイン又はデュッセルドルフ－パリ－ロンドン－プレストウィック

(1) Points in Japan - points on the mainland of China to be agreed and/or on Taiwan - Hong Kong or Manila - points in Vietnam, Laos and Cambodia - Bangkok - points in Burma (Myanmar) - Colombo - points in Bangladesh, India and Pakistan - points in the Middle East - Rome - Zurich or Geneva - Frankfurt on Main or Dusseldorf - Paris - London - Prestwick.

注1　日本国の一又は二以上の指定航空企業が前記の路線において提供する協定業務は、日本国の領域内の一地点をその起点とするものでなければならないが、路線(5)以外の前記の路線上の他の地点は、いずれかの又はすべての飛行に当たり、当該指定航空企業の選択によって省略することができる。路線(5)上の他の地点は、両国の航空当局が合意した場合を除くほか、いずれかの又はすべての飛行に当たり、当該指定航空企業の選択によって省略することができる。

Note 1 The agreed services provided by the designated airline (s) of Japan on these routes shall begin at a point in the territory of Japan, but other points on the routes except Route (5) may at the option of the designated airline be omitted on any or all flights. As for Route (5), other points may at the option of the designated airline be omitted on any or all flights unless otherwise agreed between the aeronautical authorities.

注2　路線(2)の「ヨーロッパ内の三地点」に関しては、日本国の一又は二以上の指定航空企業は、ロンドンと三地点の内の一地点との間でストップオーヴァーの運輸権を含め第五の自由の運輸権を行使することができる。日本国の航空当局は、三地点を選択することができるものとし、また、その三地点の内運輸権を行使することができる一地点を選択することができる。この三地点の選択と一地点の選択は、両国の航空当局の合意によって変更することができる。

Note 2 As for the "three points in Europe" on Route (2) the designated airline (s) of Japan may exercise fifth freedom traffic rights including stopover traffic rights between London and one out of the three points. The aeronautical authorities of Japan may select the three points and may choose at which one of the three points the traffic rights may be exercised: these selections and this choice may be changed by agreement.

　路線(2)では、ロンドンに寄航する便でマンチェスターに寄航してはならない。

　On Route (2), Manchester shall not be served the same flight with London.

注3　路線(4)では、香港においてはマニラで積み卸される貨客を積み込むことができず、また、マニラで積み込まれた貨客を積み卸すことができない。この制限は、いずれかの地点から発し又はいずれかの地点でストッブオーヴァーを行う貨客にひとしく適用される。

Note 3 On Route (4), no traffic to be discharged in Manila may be taken on board in Hong Kong and no traffic taken on board in Manila may be discharged in Hong Kong. This limitation shall apply equally to traffic originating in or stopping over at either Point.

第二部

SECTION II

　連合王国の一又は二以上の指定航空企業が運営する路線

注1　連合王国の一又は二以上の指定航空企業が前記の路線において提供する協定業務は、連合王国の領域内の一地点をその起点とするものでなければならないが、路線(4)以外の前記の路線上の他の地点は、いずれかの又はすベての飛行に当たり、当該指定航空企業の選択によって省略することができる。路線(4)上の他の地点は、両国の航空当局が合意した場合を除くほか、いずれかの又はすペての飛行に当たり、当該指定航空企業の選択によって省略することができる。

Note 1 The agreed services provided by the designated airline (s) of the United Kingdom on these routes shall begin at a point in the territory of the United Kingdom, but other points on the routes except Route (4) may at the option of the designated airline be omitted on any or all flights. As for Route (4), other points may at the option of the designated airline be omitted on any or all flights unless otherwise agreed between the aeronautical authorities.

注2　路線(2)では、日本国内の地点においてはソウルで積み卸される貨客を積み込むことができず、また、ソウルで積み込まれた貨客を積み卸すことはできない。この制限は、いずれかの地点から発し又はいずれかの地点でストップオーヴァーを行う貨客にひとしく適用される。

Note 2 On Route (2), no traffic to be discharged in Seoul may be taken on board at points in Japan and no traffic taken on board at Seoul may be discharged at points in Japan. This limitation shall apply equally to traffic originating in or stopping over at either point.

　路線(2)では、東京又は大阪に寄航する便で名古屋に寄航してはならない。

　 On Route (2), Nagoya shall not be served on the same flight with either Tokyo or Osaka.

(日本側書簡)

　　書簡をもって啓上いたします。本大臣は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

(連合王国則書簡)

　　本大臣は、更に前記の書簡の内容が日本国政府にとって受諾し得るものであり、閣下の書簡及びこの返簡が閣下の書簡の別添とともに両国政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生ずることを確認する光栄を有します。
