(Japanese Note)

　Madrid, June 21, 1990

　書簡をもって啓上いたします。本使は、千九百八十年三月十八日にマドリッドで署名された航空業務に関する日本国とスペインとの間の協定(以下「協定」という。)に関し千九百九十年二月十四日及び十五日に東京において日本及びスペインの航空当局の間で行われた協議に言及し、別添の修正された附属書が協定の現行の附属書に代わるべきことを提案する光栄を有します。

　Excellency,
  I have the honour to refer to the consultations held in Tokyo on 14 and 15 February 1990 between the aeronautical authorities of Japan and Spain concerning the Agreement between Japan and Spain for Air Services, signed at Madrid on 18 March 1980 (hereinafter referred to as the "Agreement"), and to propose that the revised Annex as set out in the Attachment shall replace the existing Annex to the Agreement.

　本使は、更に、前記の提案がスペイン政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡を両国政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　If the above proposal is acceptable to the Government of Spain, I have further the honour to propose that this Note and Your Excellency's Note in reply shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the date of Your Excellency's reply.

　本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

I have the honour to refer to Your Excellency's Note of today's date, which reads as follows:

　I have further the honour to inform Your Excellency that the Government of Spain accepts the above proposal of the Government of Japan and to confirm that Your Excellency's Note and this Note shall constitute an agreement between the two Governments, which shall enter into force on the date of this reply.

注1　一地点は後に特定され、他の一地点は後に合意される(後に特定される一地点及びバンコックの双方の地点に、同一便で寄航することはできない。)。香港は、特定される地点及び合意される地点の対象としない。

3　いずれの締約国の一又は二以上の指定航空企業が提供する協定業務も、当該締約国の領域内の一地点をその起点としなければならないが、当該路線上の他の地点は、いずれかの又はすべての飛行に当たり当該指定航空企業の選択によって省略することができる。

3. The agreed services provided by the designated airline or airlines of either Contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the route may at the option of the designated airline be omitted on any or all flignts.
