日本国政府とモンゴル人民共和国政府との間の貿易協定
Trade Agreement between the Government of Japan and the Government of the Mongolian People's Republic
日本国政府及びモンゴル人民共和国政府は、平等互恵の原則に基づいて両国間の貿易関係を一層促進し、かつ、、発展させることを希望して、次のとおり協定した。
The Government of Japan and the Government of the Mongolian People's Republic, being desirous of promoting and developing further the trade relations between the two countries on the principle of equality and mutual benefit, have agreed as follows:
第一条 両政府は、両国間の貿易の量をできる限り高い水準に引き上げるよう努力する。
Article 1 Both Government will endeavour to increase the volume of trade between the two countries to the highest level practicable.
第二条 両政府は、両国間で取引される商品の輸出及び輸入に対する必要な許可の発給を容易にするよう努力する。
Article 2 Both Governments will endeavour to facilitate the granting of the necessary permissions for exportation and importation of goods to be traded between the two countries.
第三条 1 両国間で取引されることが予想される商品の表は、この協定に附属する。
Article 3 1. Lists of goods which are expected to be traded between the two countries are annexed to this Agreement.
2 1の表は、単に例示的である。したがって、その表は、いかなる意味においても、それに含まれない商品の取引を制限するものと解してはならない。
2. These lists are only indicative and, therefore, shall not be construed in any way as restricting trade in goods not included Therein.
第四条 関税その他これと同等の効果を有する課徴金、これらの関税及び課徴金の徴収の方法並びに通関に関連する規則及び手続に関し、いずれの一方の国の政府も、他方の国の産品に対し、自国の関係法令の範囲内で、第三国に与える待遇よりも不利でない待遇を与える。
Article 4 In respect of customs duties and other charges with an effect equivalent thereto, and in respect of the methods of levying such duties and charges, as well as in respect of rules and formalities connected with the clearance through customs, the Government of either country shall accord, within the scope of the relevant laws and regulations of such country, to the products of the other country a treatment no less favourable than that accorded to any third country.
第五条 いずれの一方の国の政府も、一時的にその領域に持ち込まれ、かつ、その領域から持ち出される他方の国の次の物品に対し、自国の関係法令の範囲内で、関税、内国税その他の課徴金の免除に関して第三国に与える待遇よりも不利でない待遇を与える。
Article 5 The Government of either country shall accord, within the scope of the relevant laws and regulations of such country, a treatment no less favourable than that accorded to any third country with respect to exemption from customs duties, internal taxes and other charges to the following articles of the other country which are brought into temporarily and taken out of its territory:
(a)商品見本
(a) samples of commodities;
(b)試験用及び実験用の物品
(b) articles destined for tests and experiments;
(c)展覧会、見本市及び共進会に出品される物品
(c) articles destined for exhibitions, fairs and contests;
(d)組立工が設備の組立て及び取付けに用いる器具
(d) tools and appliances to be used by assemblers in assembling and installing equipment;
(e)加工され又は修理される物品及び加工又は修理に必要な材料
(e) articles to be processed or repaired and materials required for processing or repairing;
(f)輸出され又は輸入される貨物の容器
(f) containers of exported or imported goods.
第六条 いずれの一方の国の政府も、自国の関係法令の範囲内で、その領域内における他方の国の商品の貿易見本市及び展覧会の開催に必要な便宜を与える。
Article 6 The Government of either country shall grant, within the scope of the relevant laws and regulations of such country, necessary facilities for holding trade fairs and exhibitions for goods of the other country in the territory of the former country.
第七条 両国間のすべての支払は、それぞれの国の外国為替管理に関する関係法令に従って、交換可能な通貨で行う。
Article 7 All payments between the two countries shall be effected, in accordance with the relevant laws and regulations concerning foreign exchange control of the respective countries, in convertible currencies.
第八条 1 いずれの一方の国の政府も、この協定の実施に関連して他方の国の政府が行う提案に対して好意的な考慮を払う。
Article 8 1. The Government of either country shall give favourable consideration to the proposal which the Government of the other country may make concerning the implementation of this Agreement.
2 両政府の代表者で構成される混合委員会は、この協定の実施から生ずる問題を検討すること及び両国間の貿易の発展に有益な情報を交換することを目的として、いずれか一方の政府の要請に基づき会合する。
2. A Mixed Commission composed of the representatives of the two Governments shall meet at the request of either Government in order to examine the problems arising from the implementation of this Agreement and to exchange information useful for the develop- ment of trade between the two countries.
第九条 両政府は、両国間で取引される商品の輸送を容易にするため、とることができるすべての措置をとる。
Article 9 Both Governments shall take every practicable measure to facilitate transportation of the goods to be traded between the two countries.
第十条 両政府は、両国間の経済及び貿易関係を一層発展させることを目的として、可能な範囲内で、かつ、それぞれの国の関係法令に従って、平等互恵の原則に基づいて工業技術の交換を容易にする。
Article 10 Both Governments will facilitate, within their capability and in accordance with the relevant laws and regulations of their respective countries, the exchange of industrial technology on the principle of equality and mutual benefit with a view to developing further the economic and trade relations between the two countries.
第十一条 両政府は、日本国の国民又は法人とモンゴル人民共和国の外国貿易機関との間で締結される契約から又はこれに関連して生ずることのある紛争の解決のため、両国の仲裁機関の利用をあらゆる可能な方法により奨励する。
Article 11 Both Governments will encourage by every possible means the use of arbitration boards in both countries for the settlement of disputes which may arise out of or in connection with the contracts concluded between nationals or legal persons of Japan and foreign trade organizations of the Mongolian People's Republic.
第十二条 この協定の終了は、この協定の有効期間中に日本国の国民又は法人とモンゴル人民共和国の外国貿易機関との間で締結される契約の履行に影響を与えるものではない。両政府は、この協定の終了の後においても、これらの契約がそれぞれの国の関係法令に従って、かつ、この協定に定められた原則を指針として履行されるべきであることに意見の一致をみている。
Article 12 The termination of this Agreement shall not affect the fulfillment of any contracts Concluded between nationals or legal persons of Japan and foreign trade organizations of the Mongolian People's Republic during the period of validity of this Agreement. The two Governments agree that the fulfillment of such contracts should be guided after the termination of this Agreement by the principles embodied in this Agreement subject to the relevant laws and regulations of their respective countries.
第十三条 この協定は、署名の日に効力を生じ、一年間効力を有する。この協定は、いずれか一方の国の政府が、この協定を終了させる意思を少なくとも三箇月前に他方の国の政府に対し書面により予告しない限り、次の一年間について毎年自動的に更新される。
Article 13 This Agreement shall come into force on the date of its signature and shall be valid for a period of one year. It shall be automatically renewed every year for the next one year period, unless the Government of either country has previously given to the Government of the other country at least three months ' written notice of its intention to terminate this Agreement.
