国際運輸業の所得に対する課税の相互免除に関する日本国政府とルクセンブルグ大公国との間の交換公文

Luxembourg, February 7, 1990
書簡をもって啓上いたします。本大臣は、船舶又は航空機を国際運輸に運用することに係る所得又は財産に対する二重課税の回避に関し、両政府の代表者の間で最近到達した次の取極をルクセンブルグ大公国政府に代わって確認する光栄を有します。
Sir, I have the honour to confirm, on behalf of the Government of the Grand-Duchy of Luxembourg the following agreement recently reached between the representatives of the two Governments concerning the avoidance of double taxation on income and/or on capital in respect of the operation of ships or aircraft in international traffic.
1 ルクセンブルグ大公国は、日本国の居住者が営む企業に対し、船舶又は航空機を国際運輸に運用することについて、ルクセンブルグで課される個人及び法人に対する所得税並びに商業利得に対する地方税を免除する。
1. The Grand-Duchy of Luxembourg shall exempt from income taxes on individuals and corporations and from communal tax on commercial profits chargeable in Luxembourg, an enterprise carried on by a resident of Japan, in respect of the operation of ships or aircraft in international traffic.
ルクセンブルグ大公国は、船舶又は航空機を国際運輸に運用することにつき、日本国の居住者が営む企業の所有する船舶若しくは航空機又はこれらの船舶若しくは航空機の運用に係る動産である財産に対して、ルクセンブルグで課される資産税及び投資財産に対する地方税を免除する。
The Grand-Duchy of Luxembourg shall exempt from wealth tax and communal tax on invested capital chargeable in Luxembourg, capital represented by ships or aircraft and by movable property pertaining to the operation of such ships or aircraft, owned by an enterprise carried on by a resident of Japan, in respect of the operation of ships or aircraft in international traffic.
2 日本国政府は、千九百六十二年の日本国法律第百四十四号に従い、相互主義に基づき、ルクセンブルグの居住者が営む企業に対し、船舶又は航空機を国際運輸に運用することについて、日本国で課される所得税、法人税、住民税及び事業税を免除する。
2. The Government of Japan shall, in accordance with the Japanese Law No. 144 of 1962 exempt, on a basis of reciprocity, from income tax, corporation tax, local inhabitant taxes and enterprise tax chargeable in Japan, an enterprise carried on by a resident of Luxembourg, in respect of the operation of ships or aircraft in international traffic.
3(a) 1にいう「日本国の居住者」とは、日本国の租税に関して日本国の居住者であり、かつ、ルクセンブルグの租税に関してルクセンブルグの居住者でない個人又は日本国内に本店若しくは主たる事務所を有する法人(日本国の租税に関して法人として取り扱われる団体を含む。)をいう。
3. (a) The term "resident of Japan" referred to in paragraph 1 means any individual who is resident in Japan for the purposes of Japanese tax and not resident in Luxembourg for the purposes of the Luxembourg tax or any corporation (including any entity treated as a corporation for the purposes of Japanese tax) which has its head or main office in Japan.
(b) 2にいう「ルクセンブルグの居住者」とは、ルクセンブルグの租税に関してルクセンブルグの居住者であり、かつ、日本国の租税に関して日本国の居住者でない個人又はルクセンブルグの法律に基づいて設立された法人であってその実質的管理の場所がルクセンブルグ内にある者をいう。
(b) The term "resident of Luxembourg" referred to in paragraph 2 means any individual who is resident in Luxembourg for the purposes of the Luxembourg tax and not resident in Japan for the purposes of Japanese tax or any corporation constituted under the laws of Luxembourg and whose place of effective management is situated in Luxembourg
4 この取極は、日本国政府が、ルクセンブルグ大公国政府から、この取極の効力発生のために必要なすべての国内手続を完了した旨の書面による通告を受領した日に効力を生ずるものとし、１及び２に定める租税の免除は、千九百八十八年一月一日以後に開始する各課税年度について適用する。
4. This agreement shall enter into force at the date of receipt by the Government of Japan of the written notification by the Government of the Grand-Duchy of Luxembourg indicating that all necessary internal procedures for then entry into force of such agreement have been completed and the exemption from taxes as provided for in paragraphs 1 and 2 shall be applied in respect of the taxable years beginning on or after the first day of January 1988.
5 この取極は、いずれか一方の政府が、他方の政府に対し書面による六箇月の予告を与えることによりこの取極を終了させる場合に効力を失う。
5. This agreement shall cease to have effect if either Government terminates it by giving to the other Government six months written notice.
本大臣は、貴官が前記の取極を日本国政府に代わって確認されれば幸いであります。
I should be grateful if you would confirm the foregoing agreement on behalf of the Government of Japan.
本大臣は、以上を申し進めるに際し、ここに重ねて貴官に向かって敬意を表します。
