AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE REPUBLIC OF KOREA ON MARITIME SEARCH AND RESCUE AND EMERGENCY REFUGE OF VESSELS

　The Government of Japan and the Government of the Republic of Korea,

　Recalling the Agreed Minutes concerning the Agreement on Fisheries between Japan and the Republic of Korea signed at Tokyo, on June 22, 1965, and the development in international cooperation for maritime search and rescue,

　Recognizing the need to provide any person in distress as sea adjacent to the respective countries with the most appropriate assistance available in an expeditious and effective manner, and also the need to provide the vessel of the other country having taken emergency refuge with appropriate protection available to the extent possible,

　Have agreed as follows:

Article I
　Either Party, on receiving information of any person in distress at sea adjacent to its own country, shall take urgent measures for searching for and rescuing such a person to provide that person with the most appropriate assistance available.

Article II
　In either Party's taking the urgent measures provided for in Article I, both Parties, when necessary, shall cooperate with each other to the extent possible by means of providing related information, holding consultations and so on.

Article III
　To promote mutual cooperation concerning maritime search and rescue, the Parties shall endeavor to exchange information and opinions as may be necessary, in addition to implementing the cooperation provided for in Article II.

Article IV
1. Either Party shall provide appropriate protection to the extent possible in cases where any vessel of the other country has taken emergency refuge due to storm and other emergent situations.

2. Any vessel of either country intending to take refuge will give notification to the competent authorities of the other country, unless such notification is impossible due to inevitable exceptional circumstances such as a breakdown of the vessel's communication facilities. The vessel of either country having taken refuge shall, in the internal or territorial water s of the other country, observe the relevant laws and regulations of, and follow the instructions of the competent authorities concerned of, such other country.

Article V
1. Communications between the Parties necessary for the implementation of this Agreement shall be done in the manners stipulated in the ANNEX, and in any subsequent amendment thereof made in accordance with the provisions of paragraph 2 of the present Article, which form an integral part of this Agreement.

2. The Parties may amend the ANNEX attached to this Agreement by an exchange of notes.

Article VI
1. The Parties shall implement this Agreement in accordance with the laws and regulations in force in the respective countries.

2. Nothing in this Agreement shall affect in any way the rights and obligations of the respective countries based upon other international agreements including treaties.

Article VII
1. This Agreement shall enter into force on the date of signature.

2. This Agreement shall remain in force for a period of three years, and shall continue in force thereafter subject to termination on the date of expiration of one year after written notice by either Party to the other of its intention to terminate this Agreement.

　IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed this Agreement.

　Done in duplicate at Tokyo, this twenty-fifth day of May, 1990 in the Japanese, Korean, and English languages, each text being equally authentic. In case of any divergence of interpretation, the English text shall prevail.

ANNEX
MANNER OF COANUNICATION BETWEEN THE PARTIES

1. The communication referred to in paragraph 1 of Article V of this Agreement shall be done in the manner stipulated as follows:

(b) Radio Station open to radio communication for the Government of the Republic of Korea

　Radio Station of the Pusan Branch of the Korean National Maritime Police Call Sign: DSK 50

　In this case, the frequency used for call and respanse shall be 2,091KHz, and for the transmission thereafter, the Radio Station of the Seventh Regional Maritime Safety Head-quarters shall use 2,260KHz, and the Radio Station of the Pusan Brach of the Korean National Maritime Police shall use 3,342.5KHz respectively,in principle.

　In order to facilitate and ensure the mutual comunication, the Radio Station of the Seventh Reqional Maritime Safety Headquarters and the Radio Station of the Pusan Branch of the Korean National Maritime Police shall constantly keep watch on 2,091KHz.

2. In principle, communication shall be done in English language.
