原子力の平和的利用の分野における協力のための日本国政府と大韓民国政府との間の交換公文

Tokyo, May 25, 1990
書簡をもって啓上いたします。本大臣は、原子力の平和的利用の分野における日本国と大韓民国との間の協力の強化に関して日本国政府の代表者と大韓民国政府の代表者との間で最近行われた討議に言及するとともに、千九百八十五年十二月二十日に署名された科学技術の分野における協力に関する日本国政府と大韓民国政府との間の協定の下で行われてきた原子力の平和的利用の分野における協力を想起して、次の取極を日本国政府に代わって提案する光栄を有します。
Excellency, I have the honour to refer to the recent discuss ions held between the representatives of the Government of Japan and of the Government of the Republic of Korea concerning intensification of cooperation between Japan and the Republic of Korea in the field of peaceful uses of nuclear energy, and recalling the cooperation of that kind carried out under the Agreement between the Government of Japan and the Government of the Republic of Korea on Cooperation in the Field of Science and Technology, signed on December 20, 1985, to propose on behalf of the Government of Japan the following arrangement:
1 日本国政府及び大韓民国政府は、それぞれの国において効力を有する法令の範囲内で、かつ、関係する国際約束に基づくそれぞれの権利及び義務に従い、原子力の平和的利用に関する次の分野における協力を発展させ又は容易にするよう努力する。
1. The Government of Japan and the Government of the Republic of Korea shall endeavour to develop and facilitate, within the scope of the laws and regulations in force in their respective countries and in accordance with their respective rights and obligations under applicable inter national agreements, cooperation concerning peaceful uses of nuclear energy in the following fields:
(a) 原子力発電所の活動における安全性
(a) Safety in nuclear Power stations activities;
(b) 放射線防護及び環境監視
(b) Radiation protection and environmental monitoring:
(c) 放射性同位元素及び放射線の研究及び応用
(c) Study on and application of radioisotopes and radiation;
(d) 両政府が合意するその他の分野
(d) Other fields as may be agreed between the two Governments.
2 1にいう協力は、両国の政府、政府の権限のある当局、企業又は研究機関の間で次の方法により行われる。
2. The cooperation mentioned in paragraph 1 above will be undertaken between the Governments, competent authorities thereof, enterprises or research institutes of the two countries, through the following means:
(a) 安全性に関連する規制に関する情報の交換
(a) Exchange of information on safety related regulations;
(b) 科学的及び技術的情報の交換
(b) Exchange of scientific and technological information:
(c) 科学者、技術者その他の専門家の文流
(c) Exchange of scientists, technical personnel and other experts;
(d) 共同研究
(d) Joint research:
(e) 両政府が合意するその他の形態
(e) Other forms as may be agreed between the two Governments.
3 このような協力のそれぞれの形態に関する条件は、必要な場合にはそれぞれの政府の承認を条件として、関係当事者間で取り決められる。
3. The terms and conditions for each form of such cooperation will be worked out among the parties concerned, subject to approval by the respective Governments where required.
4 両政府は、この取極の下での協力を促進するため、原則として毎年交互に日本国及び大韓民国において、協議を行う。
4. With a view to promoting cooperation under this arrangement, the two Governments will consult, in principle, annually in Japan and in the Republic of Korea alternately.
5 日本国政府及び大韓民国政府は、それぞれの国が原子力事故の早期通報に関する条約及び原子力事故又は放射線緊急事態の場合における援助に関する条約(以下「条約」と総称する。)の締約国である限り、原子力事故又は放射線緊急事態の場合において条約に従って行動することが確認される。
5. It is confirmed that the Government of Japan and the Government of the Republic of Korea will act in accordance with the Convention on Early Notification of a Nuclear Accident and with the Convention on Assistance in the Case of a Nuclear Accident or Radiological Emergency (hereinafter jointly referred to as "the Conventions"), in the event of a nuclear accident or radiological emergency, so long as the respective countries are State Par ties to the Conventions.
本大臣は、更に、この書簡及び大韓民国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Republic of Korea the foregoing arrangement shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.
本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

本長官は、更に、大韓民国政府に代わって前記の取極を確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生することに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of the Republic of Korea the foregoing arrangement and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.
本長官は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。
