（日本側書簡） （訳文） 書簡をもって啓上いたします。本使は、日本国の借款に関してこの書簡の付表一に掲げる日に日本国政府とマラウイ共和国政府との間で交換された書簡（以下「従前の書簡Ⅰ」という。）、債務救済措置に関してこの書簡の付表二に掲げる日に日本国政府とマラウイ共和国政府との間で交換された書簡（以下「従前の書簡Ⅱ」という。）、債務免除方式による債務救済措置に関して二千四年九月二日に日本国政府とマラウイ共和国政府との間で交換された書簡（以下「従前の書簡Ⅲ」という。）、重債務貧困国の政府開発援助債務の完全な免除に関する日本国、カナダ、フランス共和国、ドイツ連邦共和国、イタリア共和国、グレートブリテン及び北アイルランド連合王国及びアメリカ合衆国の元首及び政府の長により千九百九十九年六月十八日にケルンで発出された声明並びにマラウイ共和国が拡大重債務貧困国イニシアティブの下で包括的な債務救済を受けるために必要な条件を満たしたことについて国際開発協会及び国際通貨基金により二千六年八月三十一日になされた承認に関し、次の了解を日本国政府に代わって提案する光栄を有します。
(Japanese Note) Lilongwe, March 28, 2007 Honourable Minister, With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of Malawi on the dates enumerated in the List 1 attached hereto concerning Japanese loans (hereinafter referred to as “the Previous Notes I”), to the Notes exchanged between the Government of Japan and the Government of the Republic of Malawi on the date enumerated in the List 2 attached hereto concerning a debt relief measure (hereinafter referred to as “the Previous Notes II”),to the Notes exchanged between the Government of Japan and the Government of the Republic of Malawi on September 2, 2004 concerning a debt relief measure in the form of cancellation (hereinafter referred to as “the Previous Notes III”), to the statement issued at Cologne on June 18, 1999 by the heads of State and Government of Japan, Canada, the French Republic, the Federal Republic of Germany, the Republic of Italy, the United Kingdom of Great Britain and Northern Ireland and the United States of America regarding the full cancellation of official development assistance debt of the Heavily Indebted Poor Countries and to the approval given by the International Development Association and the International Monetary Fund on August 31, 2006 that the Republic of Malawi has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative, I have the honour to propose on behalf of the Government of Japan the following understanding:
１ 債務免除方式による債務救済措置が、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by Japan Bank for International Cooperation (hereinafter referred to as “the Bank”).
２(1) 免除される債務は、従前の書簡Ⅰに従って締結された借款契約及び従前の書簡Ⅱに従って締結された債務繰延契約に基づく次の債務（以下「債務」という。）から成る。
2. (1) The debts to be cancelled consist of the following debts under the loan agreements concluded in accordance with the Previous Notes I and the rescheduling agreements concluded in accordance with the Previous Notes II (hereinafter referred to as “the Debts”):
(a) 二千六年八月一日現在で償還されていないすべての元本
(a) all the principal outstanding as of August 1, 2006; and
(b) 二千六年七月三十一日以前に生じた未払のすべての利子（遅延利子を含む。）
(b) all the interest (including late interest) having accrued on or before July 31, 2006 and not paid.
(2) 債務の総額は、二百十五億千五百七十一万七千三百十七円（二一、五一五、七一七、三一七円）になる。
(2) The total amount of the Debts will be twenty-one billion five hundred and fifteen million seven hundred and seventeen thousand three hundred and seventeen yen (\21,515,717,317).
(3) (2)に規定する総額は、日本国政府及びマラウイ共和国政府の権限のある当局間の同意により修正することができる。日本国政府の権限のある当局は、外務省及び財務省であり、マラウイ共和国政府の権限のある当局は、財務省である。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of the Government of the Republic of Malawi. The competent authorities of the Government of Japan will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authority of the Government of the Republic of Malawi will be the Ministry of Finance.
３ 債務は、マラウイ共和国政府に対して銀行が行う免除の通告により免除されることになる。二千六年八月一日から当該通告の日までの間（両期日を含む。）における債務に対する利子は、課されない。
3. The Debts will be cancelled by notification to that effect to be made by the Bank to the Government of the Republic of Malawi. No interest will be charged on the Debts between August 1, 2006 and the date of such notification, both dates inclusive.
４ マラウイ共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、マラウイ共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。
4. The Government of the Republic of Malawi shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and promote social and economic development of the Republic of Malawi, taking into account the fact that the Debts will be cancelled.
５ 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
5. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.
６ 従前の書簡Ⅲに述べられた了解は、この書簡が交換された日からこの了解によって代替され、無効となる。
6. The understanding contained in the Previous Notes III is superseded by the present understanding and shall be null and void from the date of exchange of the present Notes.
(1) 従前の書簡Ⅲに述べられた了解に基づき、一定の債務が、二千三年四月一日から二千四年三月三十一日までの二千三年度、二千四年四月一日から二千五年三月三十一日までの二千四年度及び二千五年四月一日から二千六年三月三十一日までの二千五年度の各事業年度における免除の日程に従って既に免除された。
(1) The certain debts have been cancelled, pursuant to the understanding contained in the Previous Notes III, according to the schedule of cancellation for the fiscal years 2003, 2004, and 2005, which is respectively from April 1, 2003 to March 31, 2004, from April 1, 2004 to March 31, 2005, and from April 1, 2005 to March 31, 2006.
(2) (1)に規定する免除された債務の総額は、四十九億六千三百五十一万五千二百七円（四、九六三、五一五、二〇七円）であった。
(2) The total amount of the debts cancelled referred to in sub-paragraph (1) above was four billion nine hundred and sixty-three million five hundred and fifteen thousand two hundred and seven yen (\4,963,515,207).
本使は、更に、この書簡及び前記の了解をマラウイ共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Honourable Minister’s Note in reply confirming on behalf of the Government of the Republic of Malawi the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Honourable Minister’s Note in reply.

Lilongwe, March 28, 2007 Honourable Minister, With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of Malawi on January 30, 1990 concerning a debt relief measure (hereinafter referred to as “the Previous Notes”), to the statement issued at Okinawa on July 21, 2000 by the heads of State and Government of Japan, Canada, the French Republic, the Federal Republic of Germany, the Republic of Italy, the United Kingdom of Great Britain and Northern Ireland and the United States of America regarding one hundred per cent cancellation of eligible commercial debts of the Heavily Indebted Poor Countries, to the approval given by the International Development Association and the International Monetary Fund on August 31, 2006 that the Republic of Malawi has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative and to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Malawi that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Malawi and of the Government of the creditor countries concerned held in Paris on October 19, 2006, I have the honour to propose on behalf of the Government of Japan the following understanding:
１(1) この了解に定める条件は、一方においてマラウイ共和国政府、その公の機関又はマラウイ共和国の居住者である関係債務者と他方において日本国の居住者である関係債権者との間で千九百九十七年一月一日より前に締結された契約に基づきマラウイ共和国政府が保証していた次の商業上の債務の元本、繰延利子及び遅延利子であって、弁済期間が一年を超え、かつ、日本国政府が保険を引き受けたもの（以下「債務」という。）の総額に適用される。
1. (1) The terms and conditions prescribed in the present understanding will apply to the total amount of the following principal, rescheduling interest and late interest of the commercial debts with a repayment period of more than one year insured by the Government of Japan, which were contracted before January 1, 1997 between the Government of the Republic of Malawi, its public sectors or other debtors concerned resident in the Republic of Malawi on the one hand and the creditors concerned resident in Japan on the other, and which were covered by the guarantee of the Government of the Republic of Malawi (hereinafter referred to as “the Debts”):
従前の書簡に述べられた了解に従って過去に繰り延べられた商業債務に関し、
For the commercial debts previously rescheduled pursuant to the understanding contained in the Previous Notes;
(a) 二千六年八月一日現在で償還されていないすべての元本
(a) all the principal outstanding as of August 1, 2006; and
(b) 二千六年七月三十一日以前に生じた未払のすべての繰延利子及び遅延利子
(b) all the rescheduling interest and the late interest having accrued on or before July 31, 2006 and not paid.
(2) (1)(a)及び(b)に規定する債務の総額は、十二億六千三百七十六万二千三百八十二円（一、二六三、七六二、三八二円）と見積もられる。
(2) The total amount of the debts referred to in (a) and (b) of sub-paragraph (1) above is estimated at one billion two hundred and sixty-three million seven hundred and sixty-two thousand three hundred and eighty-two yen (\1,263,762,382).
(3) (2)に規定する総額は、日本国政府及びマラウイ共和国政府の関係当局間の同意により修正することができる。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the authorities concerned of the Government of Japan and the Government of the Republic of Malawi.
２ １(1)(a)及び(b)に規定する債務は、この了解に関する両政府間の合意が効力を生ずる日に免除されることになる。二千六年八月一日からこの書簡の交換の日の前日までの間（両期日を含む。）における債務に対する利子は、課されない。
2. The debts referred to in (a) and (b) of sub-paragraph (1) of paragraph 1. will be cancelled upon the date of entry into force of an agreement between the two Governments on the present understanding. No interest will be charged on the Debts between August 1, 2006 and the day preceding the date of exchange of the present Notes, both dates inclusive.
３ マラウイ共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、マラウイ共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。
3. The Government of the Republic of Malawi shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and to foster economic and social development of the Republic of Malawi, taking into account the fact that the Debts will be cancelled.
４ 関係する契約の条件のうちこの了解において特に言及されていないものは、関係する契約の当事者間で別段の合意がある場合を除くほか、引き続き適用されることが確認される。
4. It is confirmed that the terms and conditions of the contracts concerned not mentioned in the present understanding will remain applicable, unless otherwise agreed upon by the parties to the contracts concerned.
５ 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
5. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.
