青年海外協力隊の派遣に関する日本国政府とキリバス共和国政府との間の交換公文

  Tokyo, February 1, 2007

  書簡をもって啓上いたします。本官は、キリバス共和国の経済的及び社会的発展に寄与するため、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により実施される青年海外協力隊計画（以下「計画」という。）に基づき協力隊員をキリバス共和国に派遣することに関し、日本国政府の代表者とキリバス共和国政府の代表者との間で行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わって確認する光栄を有します。
  Sir,
  I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Republic of Kiribati concerning the dispatch of volunteers to the Republic of Kiribati under the Japan Overseas Cooperation Volunteers Programme (hereinafter referred to as the “Programme”) which will be carried out by the Japan International Cooperation Agency (hereinafter referred to as “JICA”) 
with a view to contributing to the economic and social development of the Republic of Kiribati, and to confirm 
on behalf of the Government of Japan the following understandings reached between them:

１　青年海外協力隊員（以下「協力隊員」という。）は、キリバス共和国政府の要請に基づき、日本国の現行法令に従い、両政府の権限のある当局の間で別個に合意される派遣計画に従い、ＪＩＣＡにより派遣される。日本国政府の権限のある当局は外務省であり、キリバス共和国政府の権限のある当局は外務省である。
1. At the request of the Government of the Republic of Kiribati, Japan Overseas Cooperation Volunteers (hereinafter referred to as the “Volunteers”) will be dispatched to the Republic of Kiribati by JICA in accordance with the laws and regulations in force in Japan, according to schedules to be separately agreed upon between the competent authorities of the two Governments.  The competent authority of the Government of Japan is the Ministry of Foreign Affairs, and the competent authority of the Government of the Republic of Kiribati is the Ministry of Foreign Affairs.

２　予算措置がとられることを条件として、協力隊員の日本国とキリバス共和国との間の渡航費及びキリバス共和国における生活手当はＪＩＣＡにより負担され、また、協力隊員の任務の遂行に必要な設備、機械、自動車、資材及び医薬品についてもＪＩＣＡにより使用に供される。
2. Subject to budgetary appropriations, the cost of international travel between Japan and the Republic of Kiribati and living allowances in the Republic of Kiribati for the Volunteers will be borne by JICA, and equipment, machinery, motor vehicles and materials and medical supplies as may be necessary for the performance of their duties will be also made available by JICA.

３　キリバス共和国政府は、計画の結果としてキリバス共和国の国民が取得した技術及び知識並びに供与された設備、機械、自動車及び資材がキリバス共和国の経済的及び社会的発展に寄与し、かつ、軍事目的に使用されないことを確保する。 
3. The Government of the Republic of Kiribati shall ensure that the techniques and knowledge acquired by Kiribati nationals as well as the equipment, machinery, motor vehicles and materials provided as a result of the Programme contribute to the economic and social development of the Republic of Kiribati, and are not utilized for military purposes.

４　キリバス共和国政府は、協力隊員に対し、次の特権、免除及び便宜を与える。
4. The Government of the Republic of Kiribati shall accord the Volunteers the following privileges, exemptions and benefits:

(1)　２に規定する設備、機械、自動車、資材及び医薬品の輸入に関する領事手数料、関税、租税及び通関に係る課徴金並びに輸入許可証の取得要件の免除
(1) exemption from consular fees, customs duties, taxes and other customs charges, as well as from the requirements of obtaining import license, in respect of the importation of the equipment, machinery, motor vehicles, materials and medical supplies mentioned in paragraph 2;

(2)　協力隊員の着任後六箇月以内に行われる身回品及び家財の輸入に関する領事手数料、関税、租税及び通関に係る課徴金（保管、運搬及び類似の役務に関するものを除く。）並びに輸入許可証の取得要件の免除
(2) exemption from consular fees, customs duties, taxes and other customs charges other than those for storage, cartage and similar services, as well as from the requirements of obtaining import license, in respect of the importation of their personal and household effects within six months of their arrival;

(3)　２に規定する生活手当等協力隊員に対して国外から送金される報酬又は手当に対して課される所得税を含む租税の免除
(3) exemption from taxes including income tax on any emoluments or allowances to be remitted to them from abroad such as the living allowances mentioned in paragraph 2 above;

(4)　協力隊員のキリバス共和国における任期中の同国内での無料診療（個室病棟の使用料の負担を除く。）
(4) free medical care in Kiribati during the term of their assignment in the Republic of Kiribati other than private ward fees;


(5)　キリバス共和国政府により与えられる任務を遂行するために協力隊員が所在する場所における無料の基本的家具付住居施設
(5) free housing with basic furnishings at places where they are to perform their functions to be assigned to them by the Government of the Republic of Kiribati;

(6)　キリバス共和国の関係法令に基づく協力隊員の任務の遂行のために必要な無線通信機の設置及び使用の許可。キリバス共和国は、現行の関係法令を協力隊員による無線通信機の設置及び使用を制限するようなものに改正しようとする場合には、日本国政府と事前の協議を行うものとする。
(6) in accordance with the relevant laws and regulations of Kiribati, permission to the Volunteers to install and use radio-communication sets, necessary for the performance of their duties.  If the Government of 
the Republic of Kiribati intends to amend existing laws 
and regulations such that the installation and use by Volunteers of radio-communication sets may be restricted, it will have prior consultation with the Government of Japan;

(7)　キリバス共和国による協力隊員に対するその任務の遂行を容易にするための身分証明書の交付
(7) issuance of identification cards from the Government of the Republic of Kiribati to the Volunteers 
to facilitate the performance of their functions;

(8)　２に規定する設備、機械、自動車及び資材の現地購入に対して課されるあらゆる種類の租税及びその他の政府の課徴金の免除
(8) exemption from taxes of any kind and other governmental charges in respect of the local purchase 
of the equipment, machinery, motor vehicles and materials mentioned in paragraph 2;

(9)　協力隊員がその任期中、キリバス共和国に入国し、同国から出国し及び同国に滞在することに対する許可、外国人登録要件に係る手続のための便宜並びに領事手数料の免除
(9) permission to enter, leave and sojourn in the Republic of Kiribati for the duration of their assignment therein, convenience for procedures of alien registration requirements, and exemption from consular fees;

(10)　任務の遂行のため自動車を運転する必要のある協力隊員に対する自動車運転免許証の取得のための便宜
(10) convenience for acquisition of car driving license for the Volunteers who need to drive a car for 
the performance of their duties; and


(11)　協力隊員の任務の遂行のために必要なその他の措置
(11) other measures necessary for the performance of the duties of the Volunteers.

５(1)　キリバス共和国政府は、ＪＩＣＡがキリバス共和国において事務所（以下「事務所」という。）を開設することを認め、また、日本国から派遣され、計画に基づく活動に関連してＪＩＣＡにより与えられる任務をキリバス共和国において遂行する駐在調整員（以下「調整員」という。）を受け入れる。
5.(1) The government of the Republic of Kiribati shall admit JICA to open its office in the Republic of Kiribati（hereinafter referred to as the “Office”） and shall accept resident Co-ordinators (hereinafter referred to 
as the “Co-ordinators”) to be dispatched from Japan who perform the duties to be assigned to them by JICA in the Republic of Kiribati relative to the activities of the Programme.

(2)　キリバス共和国政府は、調整員及びその家族並びに事務所に対し、次の特権、免除及び便宜を与える。
(2) The Government of the Republic of Kiribati shall accord the Co-ordinators and their families as well as the Office the following privileges, exemptions and benefits:

(a)　調整員及びその家族に対し、
(a) for the Co-ordinators and their families:

(i)　調整員の着任後六箇月以内に行われる携行荷物、身回品、家財、消費財（食料及び飲料を除く。）並びに調整員一名につき一台の自動車の輸入に関する領事手数料、関税、租税及び通関に係る課徴金並びに輸入許可証及び為替証明書の取得要件の免除
(i) exemption from consular fees, customs duties, taxes and other customs charges, as well as from the requirements of obtaining import license, in respect of the importation of their luggage, personal effects, household effects, consumer goods, excluding foodstuff and beverages, and one motor vehicle per Co-ordinator within six months of his/her initial arrival;

(ii)　調整員に対して国外から送金される報酬及び手当に対して又はこれらに関連して課される所得税を含む租税及びその他の政府の課徴金の免除
(ii) exemption from taxes including income tax and other governmental charges imposed on or in connection with salaries and any allowances remitted to them from abroad;

(iii)　キリバス共和国に自動車を輸入しない調整員及びその家族が調整員の着任後六箇月以内に自動車を現地購入する場合には、調整員一名につき一台及びその家族につき一台の自動車に対して課されるあらゆる種類の租税及びその他の政府の課徴金の免除
(iii) exemption from taxes of any kind and other governmental charges in respect of the local purchase of one motor vehicle per Co-ordinator and per family of the Co-ordinator within six months of his/her initial arrival, who do not import any motor vehicle into the Republic of Kiribati;

(iv)　自動車運転免許証の取得のための便宜
(iv) convenience for acquisition of car driving license;

(v)　キリバス共和国の関係法令に基づく調整員の任務の遂行のために必要な無線通信機の設置及び使用の許可。キリバス共和国は、現行の関係法令を調整員による無線通信機の設置及び使用を制限するようなものに改正しようとする場合には、日本国政府と事前の協議を行うものとする。
(v) in accordance with the relevant laws and regulations of Kiribati, permission to the Co-ordinators to install and use radio-communication sets, necessary for the performance of their duties.  If the Government of the Republic of Kiribati intends to amend existing laws and regulations such that the installation and use by the Co-ordinators of radio-communication sets may be restricted, it will have prior consultation with the Government of Japan;

(vi)　キリバス共和国による調整員の任務の遂行を容易にするための身分証明書の交付
(vi) issuance of identification cards from the Government of the Republic of Kiribati to the Co-ordinators to facilitate the performance of their duties;

(vii)　調整員の任期中、キリバス共和国に入国し、同国から出国し及び同国に滞在することに対する許可、外国人登録要件に係る手続のための便宜並びに領事手数料の免除
(vii) permission to enter, leave and sojourn in the Republic of Kiribati for the duration of their assignment therein, convenience for procedures of alien registration requirements, and exemption from consular fees; and

(viii)　調整員の任務の遂行のために必要なその他の措置
(viii) other measures necessary for the performance of the duties of the Co-ordinators.

(b)　事務所に対し、
(b) for the Office:

(i)　事務所の活動に必要な設備、機械、自動車、資材及び医薬品の輸入に関する領事手数料、租税（関税を含む。）及びその他の政府の課徴金並びに輸入許可書の取得要件の免除
(i) exemption from consular fees, taxes including customs duties and other governmental charges, as well as from the requirements of obtaining import license, in respect of the importation of the equipment, machinery, motor vehicles, materials and medical supplies, necessary for the activities of the Office;

(ii)　事務所の活動に必要な設備、機械、自動車及び資材の現地購入に関するあらゆる種類の租税及びその他の政府の課徴金の免除
(ii) exemption from taxes of any kind and other governmental charges in respect of the local purchase of the equipment, machinery, motor vehicles and materials necessary for the functions of the Office; and

(iii)　海外から送金される事務所の経費に対して又はこれに関連して課される所得税を含む租税及びその他の政府の課徴金の免除
(iii) exemption from taxes including income tax and other governmental charges imposed on or in connection with the expenses of the Office remitted from abroad.

    (3)　(2)に規定する自動車が、その後キリバス共和国内において租税（関税を含む。）の免除又は同様の特権を有しない個人又は団体に売却され又は譲渡される場合には、当該自動車に係る租税（関税を含む。）は支払われなければならない。
(3) The motor vehicles mentioned in sub-paragraph (2) shall be subject to payment of taxes including customs duties if they are subsequently sold or transferred within the Republic of Kiribati to individuals or organizations not entitled to exemption from such taxes or similar privileges.

６　キリバス共和国政府は、協力隊員、調整員及びその家族並びに事務所に対し、キリバス共和国において同様の任務を遂行しているいかなる第三国又は国際機関の協力隊員、調整員及びその家族並びに事務所に与えられているものよりも不利でない特権、免除及び便宜を与える。
6. The Government of the Republic of Kiribati shall accord the Volunteers, Co-ordinators and their families as well as the Office such privileges, exemptions and benefits as are no less favourable than those accorded to the volunteers, the co-ordinators and their families as well 
as the office of any third country or of any international organization performing a similar mission in the Republic of Kiribati.

７　キリバス共和国政府は、キリバス共和国に滞在する協力隊員、調整員及びその家族の安全を確保するために必要な措置をとる。
7. The Government of the Republic of Kiribati shall take necessary measures to ensure security of the Volunteers, the Co-ordinators and their families staying in the Republic of Kiribati.

８　キリバス共和国政府は、協力隊員の任務の遂行に起因し、その任務の遂行中に発生し、又はその任務の遂行に関連する当該協力隊員に対する請求について責任を負う。ただし、そのような請求が協力隊員の重大な過失又は故意から生じたことについて両政府が合意する場合には、この限りでない。
8. The Government of the Republic of Kiribati shall bear claims, if any arises, against the Volunteers resulting from, occurring in the course of, or otherwise connected with, the performance of their duties, except when the two Governments agree that such claims arise from gross negligence or willful misconduct on the part of the Volunteers.

９　両政府は、キリバス共和国における計画の実施を成功させるため随時協議する。
9. The two Governments shall hold consultations from time to time for the successful implementation of the Programme in the Republic of Kiribati.

10　この了解は、両政府間の相互の書面による合意により修正することができ、また、いずれかの政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によって通告することにより終了させることができる。
10. The understandings set out above may be amended by mutual written agreement of the two Governments and terminated by either Government by giving to the other six months’ written advance notice of its intention to terminate the understandings.

  本官は、更に、この書簡及び前記の了解をキリバス共和国政府に代わって確認される貴官の返簡が両政府間の合意を構成し、その合意が貴官の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
  I have further the honour to propose that this Note and your Note in reply confirming on behalf of the Government of the Republic of Kiribati the foregoing understandings shall constitute an agreement between the two Governments, which shall enter into force on the date of your Note in reply.
