ワーキング・ホリデー制度に関する日本国政府とアイルランド政府との間の口上書

欧西欧第二四〇九号 口上書 外務省は、在本邦アイルランド大使館に敬意を表するとともに、日本国政府が、日本国とアイルランドとの間の一層緊密な協力関係を促進するとの精神の下に、日本国とアイルランドとの間の相互理解を促進するためアイルランド市民、特にアイルランドの青少年に対し日本国の文化及び一般的な生活様式を経験するための一層広範な機会を提供することを希望し、また、アイルランド市民が長期にわたり主として休暇を過ごすために日本国に入国し、かつ、旅行資金を補うために休暇の付随的側面として仕事に従事することを可能にする目的を有するワーキング・ホリデーのための制度を設けることを希望して、アイルランド市民の日本国への入国に関し、二千七年一月一日から日本国の関係法令の範囲内で相互主義に基づき次の措置をとる用意を有することを同大使館に通報する光栄を有する。
No. M22/06 NOTE VERBALE The Embassy of Ireland presents its compliments to the Ministry of Foreign Affairs of Japan and has the honour to inform the Ministry that the Government of Ireland, in a spirit of promoting closer co-operative relations between Ireland and Japan, desirous of providing wider opportunities for citizens of Japan, particularly the young people of Japan, to experience the culture and general way of life of Ireland for the purpose of promoting mutual understanding between Ireland and Japan, and wishing to provide arrangements for working holidays which are intended to make it possible for citizens of Japan to enter Ireland primarily for a holiday for an extended period and also engage in employment as an incidental aspect of their holiday in order to supplement their travel funds, is prepared to take, on a reciprocal basis, from the first of January 2007 the following measures with respect to the entry of citizens of Japan into Ireland, subject to the relevant laws and regulations of Ireland:
１ 日本国政府は、次の各要件を満たす者に対し、発給日から一年間有効なワーキング・ホリデー査証を発給する。
1. The Government of Ireland will issue a working holiday visa valid for a period of one (1) year from the date of issue to a person who satisfies each of the following requirements:
(i) 査証申請時にアイルランドに居住するアイルランド市民であること。
(i) is a citizen of Japan who is ordinarily resident in Japan at the time of the application;
(ii) 入国の日から一年を超えない期間日本国において主として休暇を過ごす意図を有すること。
(ii) intends primarily to holiday in Ireland for a period of up to one (1) year from the date of entry;
(iii) 査証申請時の年齢が十八歳以上二十五歳以下であること（日本国政府の権限のある当局が年齢の制限を三十歳まで延長することに同意する場合を除く。）。
(iii) is aged between eighteen (18) and twenty-five (25) years both inclusive at the time of application for the said visa, except in those cases where the competent authorities of the Government of Ireland agree to extend the limitation of age up to thirty (30) years;
(iv) 被扶養者を同伴しないこと（被扶養者が前記又はその他の査証を有する場合を除く。）。
(iv) is not accompanied by dependants unless those dependants are in possession of the said visa or otherwise;
(v) 有効なアイルランド旅券及び帰国のための旅行切符又はこのような切符を購入するための十分な資金を所持すること。
(v) possesses a valid Japanese passport and a return travel ticket or sufficient funds with which to purchase such a ticket;
(vi) 日本国における滞在の当初の期間に生計を維持するための相当な資金を所持すること。
(vi) possesses reasonable funds for their maintenance during the period of initial stay in Ireland;
(vii) 滞在終了時に日本国を出国する意図を有すること。
(vii) intends to leave Ireland at the end of their stay;
(viii) 以前に前記の査証の発給を受けていないこと。
(viii) has not previously been issued the said visa;
(ix) 健康であり、健全な経歴を有し、かつ、犯罪経歴を有しないこと。
(ix) has good health, a sound background and no criminal record; and
(x) 十分な健康保険に加入していること。
(x) has sufficient medical insurance.
２ １にいう査証の申請は、この制度に特有の手続に従い、在アイルランド日本国大使館に対して行われることが必要とされる。申請者は、必要なときは、資格決定のため、同大使館の代表者による面接を受ける。
2. Application for the visa mentioned in paragraph 1 above will be required to be made to the Embassy of Ireland in Japan, in accordance with procedures specific to this scheme. Applicants will be interviewed, where necessary, by the representatives of the Embassy to determine their eligibility.
３ 申請者は、日本語の知識の欠如のみを理由として１にいう査証の発給を拒否されない。
3. Applicants will not be refused the visa mentioned in paragraph 1 above solely on the grounds of their lack of knowledge of the Irish or English languages.
４ 日本国政府は、１にいう査証を有するアイルランド市民に対し、当該査証が有効となる日から最長一年の期間日本国に滞在する許可を与える。アイルランド市民は、許可された期間を超えて滞在を延長すること及びその滞在期間中に滞在資格を変更することは認められない。
4. The Government of Ireland will grant citizens of Japan who have the visa mentioned in paragraph 1 above permission to stay in Ireland for up to one year from the date on which the visa becomes valid. They may not extend their stay beyond the period authorized, or alter their immigration status during their stay.
５ この制度に参加するアイルランド市民は、日本国における旅行資金を補うために休暇に付随的な就労を行うことができる。
5. Participants from Japan in this scheme will, during their stay in Ireland, be able to take work incidental to their holiday in order to supplement their travel funds.
６ 日本国政府は、この制度により日本国に入国したアイルランド市民が日本国の法令を遵守し、かつ、この制度の目的に反する仕事に従事しないことを要請する。
6. The Government of Ireland will require citizens of Japan who have entered Ireland under this scheme to comply with the laws and regulations of Ireland and not to engage in employment that is contrary to the purpose of this scheme.
７ 日本国政府は、日本国における関連の青少年団体、文化団体及び地域社会団体がワーキング・ホリデー査証により日本国に入国したアイルランド市民のため適切な相談の便宜を与えることを奨励する。
7. The Government of Ireland will encourage relevant youth, cultural and community organizations in Ireland to provide appropriate counseling facilities for citizens of Japan who have entered Ireland on the working holiday visa.
８ 日本国政府は、アイルランド市民に対し発給する１にいう査証の数を毎年決定する。日本国政府は、この数を変更することを決定した場合には、アイルランド政府に対し外交上の経路を通じて通報する。
8. The Government of Ireland will determine annually the number of the visas mentioned in paragraph 1 above. The Government of Ireland will notify the Government of Japan through diplomatic channels if it decides to alter the number.
９ 日本国政府は、公の政策上の理由により前記の諸措置の全部又は一部を一時的に停止することができる。このような停止は、アイルランド政府に対し、外交上の経路を通じて直ちに通告される。
9. The Government of Ireland may suspend the foregoing measures in whole or in part temporarily for reasons of public policy. Any such suspension will be notified immediately to the Government of Japan through diplomatic channels.
10 日本国政府は、アイルランド政府に対し、書面による三箇月の予告をもって前記の諸措置を終了させることができる。
10. The Government of Ireland may terminate the foregoing measures by giving three months’ written notice to the Government of Japan.

１ アイルランド政府は、次の各要件を満たす者に対し、発給日から一年間有効なワーキング・ホリデー査証を発給する。
(i) 査証申請時に日本国に通常居住する日本国民であること。
(ii) 入国の日から一年を超えない期間アイルランドにおいて主として休暇を過ごす意図を有すること。

(ix) 健康であり、健全な経歴を有し、かつ、犯罪経歴を有しないこと。
