地理空間情報の分野における協力に関する日本国政府とアメリカ合衆国政府との間の交換公文

(Japanese Note)
書簡をもって啓上いたします。本大臣は、地理空間情報の分野における協力に関し、日本国政府の代表者とアメリカ合衆国政府の代表者との間で行われた最近の討議に言及する光栄を有します。この討議の結果に関する日本国政府の了解は、次のとおりであります。
I have the honor to refer to the recent discussions between representatives of the Government of Japan and the Government of the United States of America concerning cooperation in the field of geospatial information. The following is the understanding of the Government of Japan regarding the results of the above-mentioned discussions:
１ 両政府の権限のある当局は、地理空間情報を相互に提供し、地理空間情報の共同研究活動及び共同作成を実施する。
1. The competent authorities of the two Governments will provide each other with geospatial information and carry out joint research activities and co-production of geospatial information.
２ この了解に基づいて提供され、又は作成されるすべての地理空間情報は、政府による使用のみを目的とする。各政府は、必要な場合には、この了解に基づいて提供され、又は作成される情報を当該政府の関係当局の間で移転することができる。
2. All geospatial information provided or generated pursuant to the present understanding shall be only for government use. Each Government may, where necessary, transfer the information provided or generated pursuant to the present understanding among the authorities concerned of such Government.
３ 各政府は、この了解に基づいて秘密のものとして提供され、又は作成されるいかなる地理空間情報についても、その秘密を保持する。
3. Each Government shall maintain the confidentiality of any geospatial information provided or generated in confidence pursuant to the present understanding.
４ 各政府は、この了解に基づいて提供され、又は作成される地理空間情報に課することができる使用及び公表に係る制限を遵守する。
4. Each Government shall honor the use and release restrictions which may be placed on the geospatial information provided or generated pursuant to the present understanding.
５ いずれの一方の政府も、他方の政府の書面による事前の同意を得ることなく、この了解に基づいて提供され、又は作成される地理空間情報を第三者に販売し、又は所有権若しくは占有権を移転してはならない。
5. Neither Government shall sell, transfer title to, or transfer possession of the geospatial information provided or generated pursuant to the present understanding, to third parties without the prior written consent of the other Government.
６ この了解を実施するための細目取極は、両政府の権限のある当局の間で作成される。各政府は、当該政府のいかなる当局が細目取極を作成する権限を与えられているかを外交上の経路を通じて他方の政府に通報する。
6. Detailed arrangements to implement the present understanding shall be made between the competent authorities of the two Governments. Each Government shall notify the other Government through diplomatic channels of which authority within the Government is authorized to make such detailed arrangements.
７ 両政府の権限のある当局は、この了解の実施から又はそれに関連して生ずるいかなる問題についても相互に協議を行う。問題がそのような協議を通じて解決することができない場合には、相互に受け入れることのできる解決を図るため、両政府間で協議を行う。
7. The competent authorities of the two Governments shall consult with each other regarding any matter that may arise from or in connection with the implementation of the present understanding. If the matter cannot be resolved through such consultations, consultations between the two Governments shall be held with a view to finding a mutually acceptable solution.
８ この了解及びこれに基づき作成されるすべての細目取極は、それぞれの国の関係法令及び予算に従って実施される。
8. The present understanding and all detailed arrangements to be made hereunder shall be implemented in accordance with the relevant laws and regulations and budgetary appropriations of the respective countries.
本大臣は、更に、前記の了解がアメリカ合衆国政府により受諾し得るものである場合には、この書簡及び受諾する旨の貴官の返簡が両政府間の合意を構成し、その合意が貴官の返簡の日付の日に効力を生じ、かつ、いずれか一方の政府による書面による終了の通告の受領の日の後六箇月が経過する時まで効力を有するものとすることを提案する光栄を有します。
I have further the honor to propose that, if the above understanding is acceptable to the Government of the United States of America, the present Note and your Note in reply of acceptance shall constitute an agreement between the two Governments which shall enter into force on the date of your Note in reply and shall remain in force until six months after the date of the receipt of written notice of termination by either Government.

I have the honor to acknowledge the receipt of Your Excellency’s Note of today’s date, which reads as follows:

本官は、更に、前記の了解がアメリカ合衆国政府にとって受諾し得るものであることを同政府に代わって確認し、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日に効力を生じ、かつ、いずれか一方の政府による書面による終了の通告の受領の日の後六箇月が経過する時まで効力を有するものとすることを確認する光栄を有します。
I have further the honor to confirm on behalf of the Government of the United States of America that the foregoing understanding is acceptable to the Government of the United States of America and to confirm that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments which shall enter into force on the date of this Note in reply and shall remain in force until six months after the date of the receipt of written notice of termination by either Government.
