AGREEMENT ON TECHNICAL COOPERATION AND THE JAPAN OVERSEAS COOPERATION VOLUNTEERS PROGRAM BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF TIMOR-LESTE
日本国政府及び東ティモール民主共和国政府は、 両国間に存在する友好関係を東ティモール民主共和国における技術協力及び青年海外協力隊の活動の促進により一層強化することを希望し、 また、両国の経済的及び社会的発展の促進によりもたらされる相互の利益を考慮して、 次のとおり協定した。
The Government of Japan and the Government of the Democratic Republic of Timor-Leste, Desiring to strengthen the friendly relations between the two countries by the promotion of technical cooperation and activities of Japan overseas cooperation volunteers in the Democratic Republic of Timor-Leste, and Considering mutual benefits derived from promoting the economic and social development of their respective countries, Have agreed as follows:
第一条
ARTICLE I
両政府は、両国間の技術協力及び青年海外協力隊の事業を促進するよう努力する。
The two Governments will endeavour to promote technical cooperation and Japan overseas cooperation volunteers program between the two countries.
第二条
ARTICLE II
両政府は、この協定に基づき、両政府間で合意する個別の技術協力計画を実施するための別途の取極を文書により行う。
On the basis of this Agreement, the two Governments will enter into separate arrangements in written form to carry out specific technical cooperation programs to be agreed upon between the two Governments.
第三条
ARTICLE III
１ 次の形態による技術協力が、独立行政法人国際協力機構（以下「ＪＩＣＡ」という。）により、日本国の現行法令に従い、かつ、前条に規定する取極に基づき、自己負担で行われることになる。
1. The following forms of technical cooperation will be carried out by the Japan International Cooperation Agency (hereinafter referred to as “JICA”) at its own expense in accordance with the laws and regulations in force in Japan as well as with the arrangements referred to in Article II:
(a) 技術訓練を東ティモール国民に提供すること。
(a) providing technical training to Timorese nationals;
(b) 専門家を東ティモール民主共和国に派遣すること（以下、派遣された専門家を「専門家」という。）。
(b) dispatching experts (hereinafter referred to as the “Experts”) to the Democratic Republic of Timor-Leste;
(c) 幅広い技術と豊かな経験を有する日本人ボランティア（以下「シニア海外ボランティア」という。）を東ティモール民主共和国に派遣すること。
(c) dispatching Japanese volunteers with a wide range of technical skills and abundant experience (hereinafter referred to as the “Senior Volunteers”) to the Democratic Republic of Timor-Leste;
(d) 東ティモール民主共和国の経済及び社会開発計画の調査を行うため、日本国の調査団（以下「調査団」という。）を東ティモール民主共和国に派遣すること。
(d) dispatching Japanese missions (hereinafter referred to as the “Missions”) to the Democratic Republic of Timor-Leste to conduct surveys of economic and social development projects of the Democratic Republic of Timor-Leste;
(e) 設備、機械及び資材を東ティモール民主共和国政府に供与すること。
(e) providing the Government of the Democratic Republic of Timor-Leste with equipment, machinery and materials; and
(f) 両政府間で相互に合意するその他の形態の技術協力を東ティモール民主共和国政府に対して行うこと。
(f) providing the Government of the Democratic Republic of Timor-Leste with other forms of technical cooperation as may be mutually agreed upon between the two Governments.
２ 青年海外協力隊の隊員（以下「協力隊員」という。）が、ＪＩＣＡにより、日本国の現行法令に従い、かつ、両政府の権限のある当局間で合意する別途の派遣計画に基づいて派遣されることになる。また、協力隊員の任務の遂行に必要な設備、機械及び資材が、ＪＩＣＡにより、その使用に供されることになる。
2. Japan Overseas Cooperation Volunteers (hereinafter referred to as “JOCV”) will be dispatched to the Democratic Republic of Timor-Leste by JICA in accordance with the laws and regulations in force in Japan, according to schedules to be separately agreed upon between the competent authorities of the two Governments, and equipment, machinery and materials necessary for the performance of their duties will be also made available by JICA.
第四条
ARTICLE IV
東ティモール民主共和国政府は、前条に規定する日本国の技術協力及び青年海外協力隊の事業が東ティモール民主共和国の経済的及び社会的発展のためのみに活用され、かつ、軍事目的に利用されないことを確保する。
The Government of the Democratic Republic of Timor-Leste will ensure that the Japanese technical cooperation and JOCV program as set forth in Article III are used exclusively for economic and social development of the Democratic Republic of Timor-Leste, and are not utilized for military purposes.
第五条
ARTICLE V
ＪＩＣＡが専門家、シニア海外ボランティア、調査団及び協力隊員を派遣する場合には、東ティモール民主共和国政府は、自己の負担で次の措置をとる。
In case JICA dispatches the Experts, the Senior Volunteers, the Missions and JOCV, the Government of the Democratic Republic of Timor-Leste will take at its own expense the following measures:
(a) 専門家、シニア海外ボランティア、調査団及び協力隊員の任務の遂行に必要な適当な事務所その他の施設（電話及びファクシミリの役務を含む。）を提供し、かつ、それらの運営費及び維持費を負担すること。
(a) to provide suitable office and other facilities including telephone and facsimile services necessary for the performance of the duties of the Experts, the Senior Volunteers, the Missions and JOCV, as well as to bear the expenses for their operation and maintenance;
(b) 専門家、シニア海外ボランティア及び調査団の任務の遂行に必要な現地要員（必要な場合には、適当な通訳を含む。）並びに専門家、シニア海外ボランティア及び調査団の相手方となる当該任務の遂行に必要な東ティモール人の要員を提供すること。
(b) to provide the local staff (including adequate interpreters, if necessary) as well as Timorese counterparts to the Experts, the Senior Volunteers and the Missions necessary for the performance of their duties;
(c) 現地の条件及び東ティモール民主共和国政府の権限のある当局の財政事情が許す限り、専門家及びシニア海外ボランティアに係る次の諸経費を負担すること。
(c) to bear expenses of the Experts, the Senior Volunteers for, whenever local conditions and financial possibilities of competent authorities of the Government of the Democratic Republic of Timor-Leste may permit;
(i) 通勤費
(i) daily transportation to and from their place of work;
(ii) 東ティモール民主共和国内の公用出張旅費
(ii) their official travels within the Democratic Republic of Timor-Leste; and
(iii) 公用通信費
(iii) their official correspondence;
(d) 専門家及びシニア海外ボランティア並びにそれらの家族並びに協力隊員に対し、適当な住宅の確保につき便宜を提供すること。
(d) to provide the convenience for acquisition of appropriate housing accommodation for the Experts, the Senior Volunteers and their families as well as JOCV; and
(e) 専門家及びシニア海外ボランティア並びにそれらの家族、調査団の構成員並びに協力隊員に対し、医療上の便宜を提供すること。
(e) to provide the convenience for receiving medical care and facilities for the Experts, the Senior Volunteers, their families and members of the Missions as well as JOCV.
第六条
ARTICLE VI
１(1) 東ティモール民主共和国政府は、次の措置をとる。
1. (1) The Government of the Democratic Republic of Timor-Leste will:
(a) 専門家、シニア海外ボランティア、調査団の構成員及び協力隊員に対し、国外から送金される給与及び手当に対して又はこれらの給与及び手当に関連して課される所得税を含む租税及び課徴金を免除すること。
(a) exempt the Experts, the Senior Volunteers and members of the Missions as well as JOCV from taxes including income tax and fiscal charges imposed on or in connection with salaries and any allowances remitted to them from overseas;
(b) 専門家及びシニア海外ボランティア並びにそれらの家族、調査団の構成員並びに協力隊員に対し、次のものの輸入に関し、領事手数料、租税（関税を含む。）及び課徴金並びに輸入許可証及び為替証明書の取得要件を免除すること。
(b) exempt the Experts, the Senior Volunteers, their families and members of the Missions as well as JOCV from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation of:
(i) 携帯荷物
(i) luggage;
(ii) 身回品、家財及び消費財
(ii) personal effects, household effects and consumer goods; and
(iii) 東ティモール民主共和国に派遣される専門家一名につき一台及びシニア海外ボランティア一名につき一台の自動車
(iii) one motor vehicle per Expert and per Senior Volunteer assigned to stay in the Democratic Republic of Timor-Leste;
(c) 東ティモール民主共和国に自動車を輸入しない専門家、シニア海外ボランティア及び協力隊員に対し、当該専門家、シニア海外ボランティア及び協力隊員が自動車を現地購入する場合には、専門家一名につき一台、シニア海外ボランティア一名につき一台及び協力隊員一名につき一台の自動車に対して課される付加価値税を含む租税及び課徴金を免除すること。
(c) exempt the Experts, the Senior Volunteers and JOCV who do not import any motor vehicle into the Democratic Republic of Timor-Leste from taxes including value added tax and fiscal charges in respect of the local purchase of one motor vehicle per Expert and per Senior Volunteer as well as per JOCV; and
(d) 専門家、シニア海外ボランティア及び協力隊員に対し、(b)(iii)及び(c)に規定する自動車の登録料を免除すること。
(d) exempt the Experts and the Senior Volunteers as well as JOCV from the registration fee of the motor vehicles mentioned in (b)(iii) and (c).
(2) (1)に規定する自動車が、その後東ティモール民主共和国内において、租税（関税を含む。）の免除又は同様の特権を有しない個人又は団体に売却され又は譲渡される場合には、当該自動車に係るそれらの租税（関税を含む。）は支払われなければならない。
(2) The motor vehicles mentioned in sub-paragraph (1) will be subject to payment of taxes including customs duties if they are subsequently sold or transferred within the Democratic Republic of Timor-Leste to individuals or organizations not entitled to exemption from such taxes or similar privileges.
２ 東ティモール民主共和国政府は、次の措置をとる。
2. The Government of the Democratic Republic of Timor-Leste will take the following measures:
(a) 専門家及びシニア海外ボランティア並びにそれらの家族、調査団の構成員並びに協力隊員に対し、その任期中、東ティモール民主共和国に入国し、同国から出国し及び同国に滞在することを許可し、外国人登録要件に係る手続に関し便宜を与え、並びに領事手数料を免除すること。
(a) to permit the Experts, the Senior Volunteers, their families and members of the Missions as well as JOCV to enter, leave and sojourn in the Democratic Republic of Timor-Leste for the duration of their assignment therein, offer them the convenience for procedures of alien registration requirements, and exempt them from consular fees;
(b) 専門家、シニア海外ボランティア、調査団の構成員及び協力隊員の任務の遂行に必要なすべての政府機関の協力を確保するために、専門家、シニア海外ボランティア、調査団の構成員及び協力隊員に対し、身分証明書を交付すること。
(b) to issue identification cards to the Experts, the Senior Volunteers and members of the Missions as well as JOCV to secure the cooperation of all governmental organizations necessary for the performance of their duties;
(c) 自動車運転免許証を保有する専門家及びシニア海外ボランティア並びにそれらの家族並びに協力隊員に対し、東ティモール民主共和国における自動車運転免許証の取得のための便宜を与えること。
(c) to offer the Experts, the Senior Volunteers and their families as well as JOCV, holding car driving licenses, the convenience for acquisition of car driving license;
(d) 専門家、シニア海外ボランティア、調査団及び協力隊員の任務の遂行に必要なその他の措置をとること。
(d) to carry out other measures necessary for the performance of the duties of the Experts, the Senior Volunteers and members of the Missions as well as JOCV; and
(e) 協力隊員の任務の遂行に必要な無線通信機の設置及び使用を許可すること。
(e) to permit JOCV to install and use radio communication sets necessary for the performance of their duties.
３ 東ティモール民主共和国政府は、専門家及びシニア海外ボランティア並びにそれらの家族、調査団の構成員並びに協力隊員に対し、東ティモール民主共和国において同様の任務を遂行しているいかなる第三国又は国際機関の専門家及びシニア海外ボランティア並びにそれらの家族、調査団の構成員並びに協力隊員に類するボランティアに与えられているものよりも不利でない特権、免除及び便宜を与える。
3. The Government of the Democratic Republic of Timor-Leste will accord the Experts, the Senior Volunteers, their families and members of the Missions as well as JOCV such privileges, exemptions and benefits as are no less favourable than those accorded to the Experts, the Senior Volunteers, their families and members of the Missions as well as similar volunteers of any third country or of any international organizations performing a similar mission in the Democratic Republic of Timor-Leste.
第七条
ARTICLE VII
東ティモール民主共和国政府は、専門家、シニア海外ボランティア、調査団の構成員及び協力隊員の任務の遂行に起因し、その任務の遂行中に発生し、又はその任務の遂行に関連する当該専門家、シニア海外ボランティア、調査団の構成員及び協力隊員に対する請求について責任を負う。ただし、そのような請求が専門家、シニア海外ボランティア、調査団の構成員又は協力隊員の重大な過失又は故意から生じたことについて両政府が合意する場合には、この限りでない。
The Government of the Democratic Republic of Timor-Leste will bear claims, if any arises, against the Experts, the Senior Volunteers, members of the Missions and JOCV, resulting from, occurring in the course of, or otherwise connected with, the performance of their duties, except when the two Governments agree that such claims arise from gross negligence or willful misconduct on the part of the Experts, the Senior Volunteers, members of the Missions, or JOCV.
第八条
ARTICLE VIII
１(1) ＪＩＣＡが東ティモール民主共和国政府に設備、機械及び資材を供与する場合には、東ティモール民主共和国政府は、それらの設備、機械及び資材の輸入に関し、領事手数料、租税（関税を含む。）及び課徴金並びに輸入許可証及び為替証明書の取得要件を免除する。これらの設備、機械及び資材は、陸揚港において保険料及び運賃込みの条件で東ティモール民主共和国政府の権限のある当局に引き渡された時に東ティモール民主共和国政府の財産となる。
1. (1) In case JICA provides the Government of the Democratic Republic of Timor-Leste with equipment, machinery and materials, the Government of the Democratic Republic of Timor-Leste will exempt such equipment, machinery and materials from consular fees, taxes including custom duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage, in respect of the importation. The equipment, machinery and materials mentioned above will become the property of the Government of the Democratic Republic of Timor-Leste upon being delivered c.i.f. at the port of the disembarkation to competent authorities of the Government of the Democratic Republic of Timor-Leste.
(2) ＪＩＣＡが東ティモール民主共和国政府に設備、機械及び資材を供与する場合には、東ティモール民主共和国政府は、それらの設備、機械及び資材の現地購入に関し、付加価値税を含む租税及び課徴金を免除する。
(2) In case JICA provides the Government of the Democratic Republic of Timor-Leste with equipment, machinery and materials, the Government of the Democratic Republic of Timor-Leste will exempt such equipment, machinery and materials from taxes including value added tax and fiscal charges in respect of the local purchase.
(3) (1)及び(2)に規定する設備、機械及び資材は、別途の合意がない限り、第二条に規定する取極に定める目的のために使用される。
(3) The equipment, machinery and materials mentioned in sub-paragraphs (1) and (2) will be utilized for the purpose specified in the arrangements referred to in Article II unless otherwise agreed upon.
(4) (1)及び(2)に規定する設備、機械及び資材の東ティモール民主共和国内における輸送のための費用並びにそれらの交換、維持及び修理のための費用は、東ティモール民主共和国政府が負担する。
(4) The expenses for the transportation within the Democratic Republic of Timor-Leste of the equipment, machinery and materials mentioned in sub-paragraphs (1) and (2) and the expenses for their replacement, maintenance and repair will be borne by the Government of the Democratic Republic of Timor-Leste.
２(1) 専門家、シニア海外ボランティア、調査団の構成員及び協力隊員の任務の遂行に必要な設備、機械及び資材であってＪＩＣＡが用意するものは、別途の合意がない限り、ＪＩＣＡの財産である。
2. (1) The equipment, machinery and materials, prepared by JICA, necessary for the performance of the duties of the Experts, the Senior Volunteers, members of the Missions and JOCV will remain the property of JICA unless otherwise agreed upon.
(2) 東ティモール民主共和国政府は、専門家、シニア海外ボランティア、調査団の構成員及び協力隊員に対し、(1)に規定する設備、機械及び資材の輸入に関し、領事手数料、租税（関税を含む。）及び課徴金並びに輸入許可証及び為替証明書の取得要件を免除する。
(2) The Government of the Democratic Republic of Timor-Leste will exempt the Experts, the Senior Volunteers, members of the Missions and JOCV from consular fees, taxes including customs duties and fiscal charges, as well as from the requirements of obtaining import license and certificate of foreign exchange coverage in respect of the importation of the equipment, machinery and materials mentioned in sub-paragraph (1).
(3) 東ティモール民主共和国政府は、専門家、シニア海外ボランティア、調査団の構成員及び協力隊員に対し、(1)に規定する設備、機械及び資材の現地購入に関し、付加価値税を含む租税及び課徴金を免除する。
(3) The Government of the Democratic Republic of Timor-Leste will exempt the Experts, the Senior Volunteers, members of the Missions and JOCV from taxes including value added tax and fiscal charges in respect of the local purchase of the equipment, machinery and materials mentioned in sub-paragraph (1).
第九条
ARTICLE IX
専門家、シニア海外ボランティア、調査団の構成員及び協力隊員は、東ティモール民主共和国政府が指定する機関を通じ、同政府と緊密に連絡を保つものとする。
The Experts, the Senior Volunteers, members of the Missions and JOCV will maintain close contact with the Government of the Democratic Republic of Timor-Leste through organizations designated by it.
第十条
ARTICLE X
１ 東ティモール民主共和国政府は、ＪＩＣＡが東ティモール民主共和国においてＪＩＣＡの海外事務所（以下「事務所」という。）を開設し及び維持することを認め、また、日本国から派遣されてこの協定に基づく技術協力計画及び青年海外協力隊の事業に関連してＪＩＣＡにより与えられる任務を東ティモール民主共和国において遂行する駐在員及び職員（以下「駐在員等」という。）並びにシニア海外ボランティア及び協力隊の調整員（以下「調整員」という。）を受け入れる。
1. The Government of the Democratic Republic of Timor-Leste will admit JICA to open and maintain an overseas office of JICA in the Democratic Republic of Timor-Leste (hereinafter referred to as the “Office”) and will accept a resident representative and his/her staff (hereinafter referred to as the “Representative and Staff”), and resident co-ordinators for the Senior Volunteers and JOCV (hereinafter referred to as the “Co-ordinators”) to be dispatched from Japan who perform the duties to be assigned to them by JICA relative to the technical cooperation program and Japan overseas cooperation volunteers program under this Agreement in the Democratic Republic of Timor-Leste.
２ 東ティモール民主共和国政府は、駐在員等及びその家族、調整員及びその家族並びに事務所に対し、次の特権、免除及び便宜を与える。
2. The Government of the Democratic Republic of Timor-Leste will accord the Representative and Staff and their families, the Co-ordinators and their families as well as the Office the following privileges, exemptions and benefits:
(1) 駐在員等及びその家族並びに調整員及びその家族については、
(1) For the Representative and Staff and their families, the Co-ordinators and their families:
(a) 駐在員等及び調整員に対し、国外から送金される給与及び手当に対して又はこれらの給与及び手当に関連して課される所得税を含む租税及び課徴金を免除すること。
(a) exemption from taxes including income tax and fiscal charges imposed on or in connection with salaries and any allowances remitted to the Representative and Staff and the Co-ordinators from overseas;
(b) 次のものの輸入に関し、領事手数料、租税（関税を含む。）及び課徴金並びに輸入に対する制限を免除すること。
(b) exemption from consular fees, taxes including customs duties and fiscal charges, as well as from the restrictions on importation of:
(i) 携帯荷物
(i) luggage;
(ii) 身回品、家財及び消費財
(ii) personal effects, household effects and consumer goods; and
(iii) 東ティモール民主共和国に派遣される駐在員等一名につき一台及び調整員一名につき一台の自動車
(iii) one motor vehicle per Representative and Staff and per Co-ordinator assigned to stay in the Democratic Republic of Timor-Leste;
(c) 東ティモール民主共和国に自動車を輸入しない駐在員等及び調整員に対し、当該駐在員等及び調整員が自動車を現地購入する場合には、駐在員等一名につき一台及び調整員一名につき一台の自動車に対して課される付加価値税を含む租税及び課徴金を免除すること。
(c) exemption from taxes including value added tax and fiscal charges in respect of the local purchase of one motor vehicle per Representative and Staff and per Co-ordinator who do not import any motor vehicle into the Democratic Republic of Timor-Leste;
(d) (b)(iii)に規定する自動車の登録料を免除すること。
(d) exemption from the registration fee of the motor vehicles mentioned in (b)(iii);
(e) その任期中、東ティモール民主共和国に入国し、同国から出国し及び同国に滞在することを許可し、外国人登録要件に係る手続に関し便宜を与え、並びに領事手数料を免除すること。
(e) permission to enter, leave and sojourn in the Democratic Republic of Timor-Leste for the duration of their assignment therein, offer of the convenience for procedures of alien registration requirements, and exemption from consular fees;
(f) 駐在員等及び調整員に対し、身分証明書並びに専門家、シニア海外ボランティア、調査団の構成員及び協力隊員を送迎するために空港及び海港に出入国手続地点を越えて入るための特別通行証を、第十一条を考慮して発行すること。
(f) issuance of identification cards and special passes for the Representative and Staff and the Co-ordinators to enter airport/seaport beyond passport control point to receive and send off the Experts, the Senior Volunteers, members of the Missions and JOCV, having regard to Article XI of this Agreement;
(g) 自動車運転免許証を保有する駐在員等及びその家族並びに調整員及びその家族に対し、東ティモール民主共和国における自動車運転免許証の取得のための便宜を与えること。
(g) offer of the convenience for acquisition of car driving license for the Representative and Staff and their families, and the Co-ordinators and their families, holding car driving licenses;
(h) 調整員の任務の遂行に必要な無線通信機の設置及び使用を許可すること。
(h) permission for the Co-ordinators to install and use radio-communication sets necessary for the performance of their duties; and
(i) 駐在員等及び調整員の任務の遂行に必要なその他の措置をとること。
(i) carrying out other measures necessary for the performance of the duties of the Representative and Staff and the Co-ordinators.
(2) 事務所については、
(2) For the Office:
(a) 事務所の活動に必要な設備、機械、自動車及び資材の輸入に関し、領事手数料、租税（関税を含む。）及び課徴金並びに輸入許可証及び為替証明書の取得要件を免除すること。
(a) exemption from consular fees, taxes including customs duties and fiscal charges as well as from the requirement of obtaining import license and certificate of foreign exchange coverage, in respect of the importation of the equipment, machinery, motor vehicles and materials necessary for office activities;
(b) 事務所の任務に必要な設備、機械、自動車及び資材の現地購入に関し、付加価値税を含む租税及び課徴金を免除すること。
(b) exemption from taxes including value added tax and fiscal charges in respect of the local purchase of the equipment, machinery, motor vehicles and materials necessary for the functions of the Office; and
(c) 事務所の経費であって国外から送金されるものに対して又はこれに関連して課される所得税を含む租税及び課徴金を免除すること。
(c) exemption from taxes including income tax and fiscal charges imposed on or in connection with office expenses remitted from overseas.
３ ２に規定する自動車が、その後東ティモール民主共和国内において、租税（関税を含む。）の免除又は同様の特権を有しない個人又は団体に売却され又は譲渡される場合には、当該自動車に係るそれらの租税（関税を含む。）は支払われなければならない。
3. The motor vehicles mentioned in paragraph 2 will be subject to payment of taxes including customs duties if they are subsequently sold or transferred within the Democratic Republic of Timor-Leste to individuals or organizations not entitled to exemption from such taxes or similar privileges.
４ 東ティモール民主共和国政府は、駐在員等及びその家族、調整員及びその家族並びに事務所に対し、東ティモール民主共和国において同様の任務を遂行しているいかなる第三国又は国際機関の駐在員等及びその家族、調整員及びその家族並びに事務所に与えられているものよりも不利でない特権、免除及び便宜を与える。
4. The Government of the Democratic Republic of Timor-Leste will accord the Representative and Staff and their families, and the Co-ordinators and their families as well as the Office such privileges, exemptions and benefits as are no less favourable than those accorded to representative and staff and their families, and the co-ordinators and their families as well as the office of any third country or of any international organization performing a similar mission in the Democratic Republic of Timor-Leste.
第十一条
ARTICLE XI
東ティモール民主共和国政府は、東ティモール民主共和国に滞在する専門家及びその家族、シニア海外ボランティア及びその家族、調査団の構成員、協力隊員、駐在員等及びその家族並びに調整員及びその家族の安全を確保するために必要な措置をとる。
The Government of the Democratic Republic of Timor-Leste will take necessary measures to ensure security of the Experts and their families, the Senior Volunteers and their families, members of the Missions, JOCV, the Representative and Staff and their families and the Co-ordinators and their families staying in the Democratic Republic of Timor-Leste.
第十二条
ARTICLE XII
日本国政府及び東ティモール民主共和国政府は、この協定から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
The Government of Japan and the Government of the Democratic Republic of Timor-Leste will consult with each other in respect of any matter that may arise from or in connection with this Agreement.
第十三条
ARTICLE XIII
１ この協定の規定は、この協定が効力を生ずる前から両政府間で実施されている個別の技術協力計画にも適用され、また、当該計画を実施するために東ティモール民主共和国に滞在中の専門家及びその家族、シニア海外ボランティア及びその家族、調査団の構成員、駐在員等及びその家族、調整員及びその家族、協力隊員並びに当該計画に関連する設備、機械及び資材にも適用される。
1. The provisions of this Agreement will also apply to the specific technical cooperation programs being carried out between the two Governments prior to the entering into force of this Agreement, and to the Experts and their families, the Senior Volunteers and their families, members of the Missions, the Representative and Staff and their families, and the Co-ordinators and their families as well as JOCV staying in the Democratic Republic of Timor-Leste, as well as to the equipment, machinery and materials related to the said programs.
２ この協定の終了は、両政府が明示的に別途の合意をしない限り、実施中の個別の技術協力計画が完了する日までの間当該計画に影響を与えるものではなく、また、当該計画に関連する任務を遂行するために東ティモール民主共和国に滞在中の専門家及びその家族、シニア海外ボランティア及びその家族、調査団の構成員、駐在員等及びその家族、調整員及びその家族並びに協力隊員に対して与えられる特権、免除及び便宜に影響を与えるものではない。
2. The termination of this Agreement will affect neither the specific technical cooperation programs being carried out until the date of the completion of the said programs, unless otherwise the two Governments expressly agree, nor the privileges, exemptions and benefits accorded to the Experts and their families, Senior Volunteers and their families, members of the Missions, the Representative and Staff and their families, and the Co-ordinators and their families as well as JOCV staying in the Democratic Republic of Timor-Leste for the performance of their duties in connection with the said programs.
第十四条
ARTICLE XIV
１ この協定は、日本国政府が東ティモール民主共和国政府からこの協定の効力発生のために必要な国内手続を完了した旨の書面による通告を受領した日に効力を生ずる。
1. This Agreement will enter into force on the date of the receipt by the Government of Japan of the written notification from the Government of the Democratic Republic of Timor-Leste of the completion of necessary domestic procedures for the entry into force of this Agreement.
２ この協定は、一年間効力を有するものとし、いずれか一方の政府が他方の政府に対し少なくとも六箇月の予告をもって協定を終了させる意思を書面により通告しない限り、毎年自動的に一年ずつ更新される。
2. This Agreement will remain in force for a period of one year, and will be automatically renewed every year for another period of one year each, unless either Government has given to the other Government at least six months’ written advance notice of its intention to terminate the Agreement.
以上の証拠として、下名は、正当に委任を受けてこの協定に署名した。
