（訳文） 書簡をもって啓上いたします。本使は、日本国の借款に関してこの書簡の付表一に掲げる日に日本国政府とルワンダ共和国政府との間で交換された書簡（以下「従前の書簡Ⅰ」という。）、債務救済措置に関してこの書簡の付表二に掲げる日に日本国政府とルワンダ共和国政府との間で交換された書簡（以下「従前の書簡Ⅱ」という。）、債務免除方式による債務救済措置に関して二千五年一月十四日に日本国政府とルワンダ共和国政府との間で交換された書簡（以下「従前の書簡Ⅲ」という。）、重債務貧困国の政府開発援助債務の完全な免除に関する日本国、カナダ、フランス共和国、ドイツ連邦共和国、イタリア共和国、グレートブリテン及び北アイルランド連合王国及びアメリカ合衆国の元首及び政府の長により千九百九十九年六月十八日にケルンで発出された声明並びにルワンダ共和国が拡大重債務貧困国イニシアティブの下で包括的な債務救済を受けるために必要な条件を満たしたことについて国際開発協会及び国際通貨基金により二千五年四月十三日になされた承認に関し、次の了解を日本国政府に代わって提案する光栄を有します。
Kigali, January 25, 2006 Excellency, With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of Rwanda on the dates enumerated in the List 1 attached hereto concerning Japanese loans (hereinafter referred to as “the Previous Notes I”), to the Notes exchanged between the Government of Japan and the Government of the Republic of Rwanda on the dates enumerated in the List 2 attached hereto concerning debt relief measures (hereinafter referred to as “the Previous Notes II”), to the Notes exchanged between the Government of Japan and the Government of the Republic of Rwanda on January 14, 2005 concerning debt relief measures in the form of cancellation (hereinafter referred to as “the Previous Notes III”), to the statement issued at Cologne on June 18, 1999 by the heads of State and Government of Japan, Canada, French Republic, Federal Republic of Germany, Republic of Italy, United Kingdom of Great Britain and Northern Ireland and United States of America regarding the full cancellation of official development assistance debt of the Heavily Indebted Poor Countries and to the approval given by the International Development Association and the International Monetary Fund on April 13, 2005 that the Republic of Rwanda has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative, I have the honour to propose on behalf of the Government of Japan the following understanding:
１ 債務免除方式による債務救済措置が、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by Japan Bank for International Cooperation (hereinafter referred to as “the Bank”).
２ 免除される債務は、従前の書簡Ⅰに従って締結された借款契約及び従前の書簡Ⅱに従って締結された債務繰延契約に基づく次の債務（以下「債務」という。）から成る。
二千五年四月一日現在で償還されていないすべての元本
二千五年四月一日以前に生じた未払のすべての利子（遅延利子を含む。）
(2) 債務の総額は、十四億五千四百六十八万五千三百二十二円（一、四五四、六八五、三二二円）になる。
(3) (2)に規定する総額は、日本国政府及びルワンダ共和国政府の権限のある当局間の同意により修正することができる。日本国政府の権限のある当局は、外務省及び財務省であり、ルワンダ共和国政府の権限のある当局は、外務・協力省及び財務・経済計画省である。
2. (1) The debts to be cancelled consist of the following debts under the loan agreements concluded in accordance with the Previous Notes I and the rescheduling agreements concluded in accordance with the Previous Notes II (hereinafter referred to as “the Debts”): (a) all the principal outstanding as of April 1, 2005; and (b) all the interest (including late interest) having accrued on or before April 1, 2005 and not paid. (2) The total amount of the Debts will be one billion four hundred and fifty-four million six hundred and eighty-five thousand three hundred and twenty-two yen (\1,454,685,322). (3) Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of the Government of the Republic of Rwanda. The competent authorities of the Government of Japan will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authorities of the Government of the Republic of Rwanda will be the Ministry of Foreign Affairs and Cooperation and the Ministry of Finance and Economic Planning.
３ 債務は、ルワンダ共和国政府に対して銀行が行う免除の通告により免除されることになる。二千五年四月二日から当該通告の日までの間（両期日を含む。）における債務に対する利子は、課されない。
3. The Debts will be cancelled by notification to that effect to be made by the Bank to the Government of the Republic of Rwanda. No interest will be charged on the Debts between April 2, 2005 and the date of such notification, both dates inclusive.
４ ルワンダ共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、ルワンダ共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。
4. The Government of the Republic of Rwanda shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and promote social and economic development of the Republic of Rwanda, taking into account the fact that the Debts will be cancelled.
５ 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
5. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.
６ 従前の書簡Ⅲに定められた了解は、この書簡が交換された日からこの了解によって代替され、無効となる。
二千三年四月一日から二千四年三月三十一日までの二千三年度、及び二千四年四月一日から二千五年三月三十一日までの二千四年度の債務は、免除の日程に従って既に免除された。
(2) 免除された債務の総額は、一億六千七百九十九万千三百二十七円（一六七、九九一、三二七円）であった。
6. The understanding contained in the Previous Notes III is superseded by the present understanding and shall be null and void from the date of exchange of the present Notes. (1) The debts have been cancelled according to the schedule of cancellation for the fiscal years 2003, which is from April 1, 2003 to March 31, 2004, and 2004, which is from April 1, 2004 to March 31, 2005. (2) The total amount of the debts cancelled was one hundred and sixty-seven million nine hundred and ninety-one thousand three hundred and twenty-seven yen (\167,991,327).
本使は、更に、この書簡及び前記の了解をルワンダ共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。 本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Rwanda the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.
