Excellency,

	I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Islamic Republic of Pakistan concerning a Japanese loan to be extended with a view to contributing to the earthquake disaster relief and economic reconstruction of the Islamic Republic of Pakistan:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
１　百十二億二千万円（一一、二二〇、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従って、パキスタン・イスラム共和国政府に供与されることになる。

							

						

						

							

								
1.	A loan in Japanese yen up to the amount of eleven billion two hundred and twenty million yen (¥11,220,000,000) (hereinafter referred to as “the Loan”) will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Islamic Republic of Pakistan by Japan Bank for International Cooperation (hereinafter referred to as “the Bank”).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２(1)　借款は、パキスタン・イスラム共和国政府と銀行との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規律される。

							

						

						

							

								
2.	(1)	The Loan will be made available by a loan agreement to be concluded between the Government of the Islamic Republic of Pakistan and the Bank.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(a)　償還期間は、十年の据置期間の後二十年とする。

							

						

						

							

								
(a)	The repayment period will be twenty (20) years after the grace period of ten (10) years;

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(b)　利子率は、年一・三パーセントとする。

							

						

						

							

								
(b)	The rate of interest will be one point three per cent (1.3%) per annum; and

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(c)　支出期間は、借款契約の発効の日の翌日から二年とする。

(2)　(1)(c)に規定する支出期間は、両政府の関係当局の同意を得て延長することができる。

３(1)　借款は、パキスタン・イスラム共和国内の輸入者が調達適格国の供給者に対して既に行ったか又は行われる支払で、両政府の関係当局間で相互に合意する表に掲げる生産物の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。

							

						

						

							

								
3.	(1)	The Loan will be made available to cover payments already made and/or to be made to suppliers of eligible source countries by importers in the Islamic Republic of Pakistan under such contracts as have been or may be entered into between them for purchases of such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(2)　(1)に規定する表は、両政府の関係当局間の合意によって修正することができる。

							

						

						

							

								
(2)	The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(3)　(1)に規定する調達適格国の範囲は、両政府の関係当局間で合意される。

４(1)　パキスタン・イスラム共和国政府は、パキスタン・イスラム共和国政府の名義でパキスタン中央銀行に開設される見返資金勘定に借款の円貨による支出額に等しい額をパキスタン通貨で振り替えるようにするための措置をとる。このようにして振り替えられた通貨は、パキスタン・イスラム共和国政府の救援、復旧及び再建計画に基づく事業計画の現地通貨の需要に充てるために使用されなければならない。

							

						

						

							

								
4.	(1)	The Government of the Islamic Republic of Pakistan shall take measures to have the equivalent in Pakistani currency of the amount of yen disbursements of the Loan transferred into the counterpart fund account opened in the name of the Government of the Islamic Republic of Pakistan at the State Bank of Pakistan.  The amount of Pakistani currency thus transferred shall be used to cover local currency requirements of the projects under a program of the Government of the Islamic Republic of Pakistan for relief, rehabilitation and reconstruction.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(2)　パキスタン・イスラム共和国政府は、日本国政府及び銀行に対し、(1)に規定する見返資金の使用についての報告を提出する。

５　パキスタン・イスラム共和国政府は、３(1)に規定する生産物又は役務が銀行の調達のためのガイドライン（国際競争入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際競争入札の手続をなかんずく定める。）に従って調達されることを確保する。

							

						

						

							

								
5.	The Government of the Islamic Republic of Pakistan shall ensure that the products and/or services mentioned in sub-paragraph (1) of paragraph 3. are procured in accordance with the guidelines for procurement of the Bank, which set forth, inter alia, the procedures of international competitive bidding to be followed except where such procedures are inapplicable or inappropriate.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
６　パキスタン・イスラム共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限を課すことも差し控える。

							

						

						

							

								
6.	With regard to the shipping and marine insurance of the products purchased under the Loan, the Government of the Islamic Republic of Pakistan shall refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
７　パキスタン・イスラム共和国政府は、銀行について、借款及びそれから生ずる利子に対して又はそれらに関連してパキスタン・イスラム共和国において課されるすべての財政課徴金及び租税を免除する。

							

						

						

							

								
7.	The Government of the Islamic Republic of Pakistan shall exempt the Bank from all fiscal levies and taxes imposed in the Islamic Republic of Pakistan on and/or in connection with the Loan as well as interest accruing therefrom.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
８　パキスタン・イスラム共和国政府は、借款が、適正にかつ専ら３(1)に規定する生産物又は役務を購入するために使用されることを確保するために必要な措置をとる。

							

						

						

							

								
8.	The Government of the Islamic Republic of Pakistan shall take necessary measures to ensure that the Loan be used properly and exclusively for purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
９　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

本大臣は、更に、この書簡及びパキスタン・イスラム共和国政府に代わって前記の了解を確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
