  　書簡をもって啓上いたします。本大臣は、債務救済措置に関して千九百八十九年七月十九日、千九百九十一年九月十三日、千九百九十五年五月三十日及び二千二年四月二十三日に日本国政府とモザンビーク共和国政府との間で交換された書簡（以下「従前の書簡」という。）、重債務貧困国の適格な商業債務の百パーセント免除に関する日本国、カナダ、フランス共和国、ドイツ連邦共和国、イタリア共和国、グレートブリテン及び北アイルランド連合王国及びアメリカ合衆国の元首及び政府の長により二千年七月二十一日に沖縄で発出された声明並びにモザンビーク共和国が拡大重債務貧困国イニシアティブの下で包括的な債務救済を受けるために必要な条件を満たしたことについて国際通貨基金及び国際開発協会により二千一年九月二十五日になされた承認並びに二千一年十一月十六日及び十七日にパリで開催されたモザンビーク共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とモザンビーク共和国政府の代表者との間で行われた最近の交渉に関し、次の取極を日本国政府に代わって提案する光栄を有します。

Excellency,

	With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of Mozambique on July 19, 1989, September 13, 1991, May 30, 1995 and April 23, 2002 concerning debt relief measures (hereinafter referred to as “the Previous Notes”), to the statement issued at Okinawa on July 21, 2000 by the heads of State and Government of Japan, Canada, the French Republic, the Federal Republic of Germany, the Republic of Italy, the United Kingdom of Great Britain and Northern Ireland and the United States of America regarding one hundred per cent cancellation of eligible commercial debts of the Heavily Indebted Poor Countries, to the approval given by the International Monetary Fund and the International Development Association on September 25, 2001 that the Republic of Mozambique has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative and to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Mozambique that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Mozambique and of the Government of the creditor countries concerned held in Paris on November 16 and 17, 2001, I have the honour to propose on behalf of the Government of Japan the following arrangement:


１　この取極は、一方においてモザンビーク共和国政府、その公の機関又はモザンビーク共和国の居住者である関係債務者と他方において日本国の居住者である関係債権者との間で千九百八十四年二月一日より前に締結された契約に基づきモザンビーク共和国政府が保証していた次の商業上の債務の元本、繰延利子及び遅延利子であって、弁済期間が一年を超え、かつ、日本国政府が保険を引き受けたもの（以下「債務」という。）の総額に適用される。
1.	(1)	The present arrangement will apply to the total amount of the following principal, rescheduling interest and late interest of the commercial debts with a repayment period of more than one year insured by the Government of Japan, which were contracted before February 1, 1984 between the Government of the Republic of Mozambique, its public sectors or other debtors concerned resident in the Republic of Mozambique on the one hand and the creditors concerned resident in Japan on the other, and which were covered by the guarantee of the Government of the Republic of Mozambique (hereinafter referred to as “the Debts”):

(a)　従前の書簡のうち千九百八十九年七月十九日、千九百九十一年九月十三日及び千九百九十五年五月三十日に日本国政府とモザンビーク共和国政府との間で交換された書簡に基づき行われた取極に従って過去に繰り延べられた商業債務に関し、
(a)	For the commercial debts previously rescheduled pursuant to the arrangements made by the Notes between the Government of Japan and the Government of the Republic of Mozambique on July 19, 1989, September 13, 1991, and May 30, 1995, among the Previous Notes;

(i)　二千一年九月一日現在で償還されていないすべての元本
(i)	all the principal outstanding as of September 1, 2001; 

(ii)　二千一年八月三十一日以前に生じた未払のすべての繰延利子及び遅延利子
(ii)	all the rescheduling interest and the late interest having accrued on or before August 31, 2001 and not paid; and

(iii)　二千一年九月一日からこの書簡の交換の日の前日までの間（両期日を含む。）に生じた未払のすべての繰延利子及び遅延利子
(iii)	all the rescheduling interest and the late interest having accrued between September 1, 2001 and the day preceding the date of   exchange of the present Notes, both dates inclusive.

(b)　従前の書簡のうち二千二年四月二十三日に日本国政府とモザンビーク共和国政府との間で交換された書簡に基づき行われた取極に従って過去に繰り延べられた商業債務に関し、
(b)	For the commercial debts previously rescheduled pursuant to the arrangements made by the Notes between the Government of Japan and the Government of the Republic of Mozambique on April 23, 2002, among the Previous Notes;

(i)　二千二年四月二十三日現在で償還されていないすべての元本
(i)	all the principal outstanding as of April 23, 2002; and

(ii)  二千二年四月二十三日からこの書簡の交換の日の前日までの間（両期日を含む。）に生じた未払のすべての繰延利子及び遅延利子
(ii)	all the rescheduling interest and the late interest having accrued between April 23, 2002 and the day preceding the date of exchange of the present Notes, both dates inclusive.

(2)　及び(ii)並びにに規定する債務の総額は、七十億八千八百七十三万九百一円（七、〇八八、七三〇、九〇一円）と見積もられる。
(2)	The total amount of the debts referred to in (a) (i) and (ii) of sub-paragraph (1) and in (b) (i) of sub-paragraph (1) above is estimated at seven billion eighty-eight million seven hundred and thirty thousand nine hundred and one yen (\7,088,730,901).

(3)　(iii)に規定する二千一年九月一日からこの書簡の交換の日の前日までの間（両期日を含む。）に生じた繰延利子及び遅延利子に対する利子率は、この書簡の附属書に掲げられる。
(3)	The rates of the rescheduling interests and the late interests on the Debts accrued between September 1, 2001 and the day preceding the date of  exchange of the present Notes, both dates inclusive, referred to in (a) (iii) of  sub-paragraph (1) above are shown in the ANNEX attached hereto.

(4)　(ii)に規定する二千二年四月二十三日からこの書簡の交換の日の前日までの間（両期日を含む。）に生じた繰延利子及び遅延利子に対する利子率は、この書簡の附属書に掲げられる。
(4)	The rates of the rescheduling interests and the late interests on the Debts accrued between April 23, 2002 and the day preceding the date of exchange of the present Notes, both dates inclusive, referred to in (b) (ii) of sub-paragraph (1) above are shown in the ANNEX attached hereto. 

(5)　(2)に規定する総額は、日本国政府及びモザンビーク共和国政府の関係当局間の同意により修正することができる。
(5)	Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the authorities concerned of the Government of Japan and the Government of the Republic of Mozambique.

２　１及びに規定する債務は、この取極の発効をもって免除されることになる。
2.	The debts referred to in (a) and (b) of sub-paragraph (1) of paragraph 1. will be cancelled upon the date of entry into force of the present arrangement.

３　モザンビーク共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、モザンビーク共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。
3.	The Government of the Republic of Mozambique shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and to foster economic and social development of the Republic of Mozambique, taking into account the fact that the Debts will be cancelled.

４　関係する契約の条件のうちこの取極において特に言及されていないものは、関係する契約の当事者間で別段の合意がある場合を除くほか、引き続き適用されることが確認される。
4.	It is confirmed that the terms and conditions of the contracts concerned not mentioned in the present arrangement will remain applicable, unless otherwise agreed upon by the parties to the contracts concerned.

５　両政府は、この取極から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
5.	The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present arrangement.

本大臣は、更に、この書簡及び前記の取極をモザンビーク共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Mozambique the foregoing arrangement shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.
