（訳文） 書簡をもって啓上いたします。本使は、二千六年五月十一日及び十二日にパリで開催されたモルドバ共和国政府の代表者と関係債権諸国（以下「債権諸国」という。）政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とモルドバ共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認する光栄を有します。
Chisinau, November 17, 2006 Excellency, I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Moldova that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Moldova and of the Governments of the creditor countries concerned (hereinafter referred to as “the Creditor Countries”) held in Paris on May 11 and 12, 2006. I have further the honour to confirm the following understanding reached in the course of the said negotiations:
１ 債務繰延方式による債務救済措置が、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will be taken in accordance with the relevant laws and regulations of Japan by Japan Bank for International Cooperation (hereinafter referred to as “the Bank”).
２(1) 繰り延べられる債務（以下「繰延債務」という。）は、モルドバ共和国政府が銀行に対して負う次の債務から成る。
アンタイド・ローンの供与に関してモルドバ共和国政府と日本輸出入銀行（以下「輸銀」という。）との間で二千年十二月三十一日より前に締結された借款契約に基づいて支払われるべき債務は、次のとおりである。
2. (1) The debts to be rescheduled (hereinafter referred to as “the Rescheduled Debts”) consist of the following debts which the Government of the Republic of Moldova owes to the Bank: The debts payable under the Loan Agreements concluded before December 31, 2000 between the Government of the Republic of Moldova and the Export-Import Bank of Japan (hereinafter referred to as “JEXIM”) concerning the extension of Untied Loan, which are as follows:
(a) 二千六年四月三十日以前に弁済期限の到来した未払の元本及び契約上の利子並びに二千六年四月三十日以前に生じた未払の遅延利子
(a) the principal and the contractual interest having fallen due on or before April 30, 2006 and not paid, and the late interest having accrued on or before April 30, 2006 and not paid; and
(b) 二千六年五月一日から二千八年十二月三十一日までの間（両期日を含む。）に弁済期限の到来したか又は到来する未払の元本及び契約上の利子
(b) the principal and the contractual interest having fallen or falling due between May 1, 2006 and December 31, 2008, both dates inclusive, and not paid.
(2) 繰延債務の総額は、十八億二千二十六万七百七十一円（一、八二〇、二六〇、七七一円）になる。
(2) The total amount of the Rescheduled Debts will be one billion eight hundred and twenty million two hundred and sixty thousand seven hundred and seventy-one yen (\1,820,260,771).
(3) (2)に規定する総額は、モルドバ共和国政府の関係当局及び銀行が行う最終的照合の後に、日本国政府及びモルドバ共和国政府の関係当局間の相互の同意により修正されることがある。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the authorities concerned of the Government of Japan and of the Government of the Republic of Moldova after the final verification to be made by the authorities concerned of the Government of the Republic of Moldova and the Bank.
３ 債務繰延べの条件は、モルドバ共和国政府と銀行との間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in a rescheduling agreement to be concluded between the Government of the Republic of Moldova and the Bank, which will contain, inter alia, the following principles:
(1)(a) ２(1)(b)に規定する債務の百パーセント及び２(1)(a)に規定する債務の三十・五パーセントは、この書簡の附属書Ⅰに掲げる支払計画に従い、二千十三年三月一日に始まる二十回の半年賦払によって支払われる。
(1) (a) one hundred per cent (100%) of the debts referred to in (b) of sub-paragraph (1) of paragraph 2. and thirty point five per cent (30.5%) of the debts referred to in (a) of sub- paragraph (1) of paragraph 2. will be paid in twenty (20) semi-annual instalments beginning on March 1, 2013, in accordance with the payment schedule shown in the ANNEX I attached hereto; and
(b) ２(1)(a)に規定する債務の残りの六十九・五パーセントは、この書簡の附属書Ⅱに掲げる支払計画に従い、二千六年十一月一日に始まる五回の半年賦払によって支払われる。
(b) the remaining sixty-nine point five per cent (69.5%) of the debts referred to in (a) of sub- paragraph (1) of paragraph 2. will be paid in five (5) semi-annual instalments beginning on November 1, 2006, in accordance with the payment schedule shown in the ANNEX II attached hereto;
(2) 繰延債務に対する利子率は、日本円預金に対する適用可能なロンドン銀行間取引金利（六箇月の貸出しに適用される金利）に年〇・五パーセントを加えたものとする。
(2) The rate of interest on the Rescheduled Debts will be nought point five per cent (0.5%) per annum above the applicable London inter-bank offered rate on Japanese yen deposits applied for six months lending.
４ モルドバ共和国の債務（この取極が対象とする債務を含む。）の再編に関し、モルドバ共和国政府の代表者及び債権諸国政府の代表者が新たな結論に到達した場合には、日本国政府とモルドバ共和国政府との間でこの取極の継続又は修正について討議するための協議が行われる。
4. If the representatives of the Government of the Republic of Moldova and the representatives of the Governments of the Creditor Countries come to a new conclusion in connection with reorganization of the debts of the Republic of Moldova including the debts covered by the present understanding, consultations shall be held between the Government of Japan and the Government of the Republic of Moldova in order to discuss the matter of continuation or modification of the present understanding.
本使は、更に、この書簡及びモルドバ共和国政府に代わって前記の了解を確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Moldova the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.
