（債務救済措置（債務免除方式）に関する日本国政府とホンジュラス共和国政府との間の交換公文）
（訳文） 書簡をもって啓上いたします。本使は、債務救済措置に関して千九百九十二年六月二十四日、千九百九十三年十二月十五日、千九百九十七年四月二十五日及び二千年十二月二十一日に日本国政府とホンジュラス共和国政府との間で交換された書簡（以下「従前の書簡」という。）、重債務貧困国の適格な商業債務の百パーセント免除に関する日本国、カナダ、フランス共和国、ドイツ連邦共和国、イタリア共和国、グレートブリテン及び北アイルランド連合王国及びアメリカ合衆国の元首及び政府の長により二千年七月二十一日に沖縄で発出された声明並びにホンジュラス共和国が拡大重債務貧困国イニシアティブの下で包括的な債務救済を受けるために必要な条件を満たしたことについて国際通貨基金及び国際開発協会によりそれぞれ二千五年三月二十八日及び四月五日になされた承認並びに二千五年五月十二日にパリで開催されたホンジュラス共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とホンジュラス共和国政府の代表者との間で行われた最近の交渉に関し、次の取極を日本国政府に代わって提案する光栄を有します。
Tegucigalpa, October 6, 2006 Excellency, With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of Honduras on June 24, 1992, December 15, 1993, April 25, 1997 and December 21, 2000 concerning debt relief measures (hereinafter referred to as “the Previous Notes”), to the statement issued at Okinawa on July 21, 2000 by the heads of State and Government of Japan, Canada, the French Republic, the Federal Republic of Germany, the Republic of Italy, the United Kingdom of Great Britain and Northern Ireland and the United States of America regarding one hundred per cent cancellation of eligible commercial debts of the Heavily Indebted Poor Countries, to the approval given by the International Monetary Fund and the International Development Association respectively on March 28 and April 5, 2005 that the Republic of Honduras has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative and to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Honduras that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Honduras and of the Government of the creditor countries concerned held in Paris on May 12, 2005, I have the honour to propose on behalf of the Government of Japan the following arrangement:
１ この取極は、一方においてホンジュラス共和国政府、その公の機関又はホンジュラス共和国の居住者である関係債務者と他方において日本国の居住者である関係債権者（以下「債権者」という。）との間で千九百九十年六月一日より前に締結された契約に基づきホンジュラス共和国政府が保証していた次の商業上の債務の元本、繰延利子及び遅延利子であって、弁済期間が一年を超え、かつ、日本国政府が保険を引き受けたもの（以下「債務」という。）の総額に適用される。 従前の書簡に基づき行われた取極に従って過去に繰り延べられた商業債務に関し、
1. (1) The present arrangement will apply to the total amount of the following principal, rescheduling interest and late interest of the commercial debts with a repayment period of more than one year insured by the Government of Japan, which were contracted before June 1, 1990 between the Government of the Republic of Honduras, its public sectors or other debtors concerned resident in the Republic of Honduras on the one hand and the creditors concerned resident in Japan (hereinafter referred to as “the Creditors”) on the other, and which were covered by the guarantee of the Government of the Republic of Honduras (hereinafter referred to as “the Debts”): For the commercial debts previously rescheduled pursuant to the arrangements made by the Previous Notes;
(i) 二千五年三月一日現在で償還されていないすべての元本 (ii) 二千五年二月二十八日以前に生じた未払のすべての繰延利子及び遅延利子 (iii) 二千五年三月一日からこの書簡の交換の日の前日までの間（両期日を含む。）に生じた未払のすべての繰延利子及び遅延利子
(i) all the principal outstanding as of March 1, 2005; (ii) all the rescheduling interest and the late interest having accrued on or before February 28, 2005 and not paid; and (iii) all the rescheduling interest and the late interest having accrued between March 1, 2005 and the day preceding the date of exchange of the present Notes, both dates inclusive.
(2) 及び(ii)に規定する債務の総額は、日本円によって契約された債務については、五十五億九千四百五十七万五千八百七円（五、五九四、五七五、八〇七円）、合衆国ドルによって契約された債務については、五千四百十一万四千九十三合衆国ドル七十二セント（五四、一一四、〇九三・七二合衆国ドル）と見積もられる。
(2) The total amount of the debts referred to in (i) and (ii) of sub-paragraph (1) above is estimated at five billion five hundred and ninety-four million five hundred and seventy-five thousand eight hundred and seven yen (\5,594,575,807) for the debts contracted in Japanese yen and fifty-four million one hundred and fourteen thousand and ninety-three dollars and seventy-two cents ($54,114,093.72) for the debts contracted in United States dollars.
(3) 二千五年三月一日からこの書簡の交換の日の前日までの間（両期日を含む。）に生じた繰延利子及び遅延利子に対する利子率は、この書簡の附属書に掲げられる。
(3) The rates of the rescheduling interest and the late interest on the Debts accrued between March 1, 2005 and the day preceding the date of exchange of the present Notes, both dates inclusive, are shown in the ANNEX attached hereto.
(4) (2)に規定する総額は、日本国政府及びホンジュラス共和国政府の関係当局間の同意により修正することができる。
(4) Modifications may be made to the total amounts referred to in sub-paragraph (2) above by mutual consent between the authorities concerned of the Government of Japan and the Government of the Republic of Honduras.
２ １、(ii)及び(iii)に規定する債務は、この取極の発効をもって免除されることになる。
2. The debts referred to in (i), (ii) and (iii) of sub-paragraph (1) of paragraph 1. will be cancelled upon the date of entry into force of the present arrangement.
３ ホンジュラス共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、ホンジュラス共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。
3. The Government of the Republic of Honduras shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and to foster economic and social development of the Republic of Honduras, taking into account the fact that the Debts will be cancelled.
４ 関係する契約の条件のうちこの取極において特に言及されていないものは、関係する契約の当事者間で別段の合意がある場合を除くほか、引き続き適用されることが確認される。
4. It is confirmed that the terms and conditions of the contracts concerned not mentioned in the present arrangement will remain applicable, unless otherwise agreed upon by the parties to the contracts concerned.
５ 両政府は、この取極から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
5. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present arrangement.
本使は、更に、この書簡及び前記の取極をホンジュラス共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Republic of Honduras the foregoing arrangement shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.

I have further the honour to confirm on behalf of the Government of the Republic of Honduras the foregoing arrangement and to agree that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the date of this Note in reply.
