  　書簡をもって啓上いたします。本官は、重債務貧困国の適格な商業債務の百パーセント免除に関する日本国、カナダ、フランス共和国、ドイツ連邦共和国、イタリア共和国、グレートブリテン及び北アイルランド連合王国及びアメリカ合衆国の元首及び政府の長により二千年七月二十一日に沖縄で発出された声明、ガーナ共和国が拡大重債務貧困国イニシアティブの下で包括的な債務救済を受けるために必要な条件を満たしたことについて国際開発協会及び国際通貨基金により二千四年七月十三日になされた承認並びに二千四年七月二十二日にパリで開催されたガーナ共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とガーナ共和国政府の代表者との間で行われた最近の交渉に関し、次の取極を日本国政府に代わって提案する光栄を有します。

Excellency,

	With reference to the statement issued at Okinawa on July 21, 2000 by the heads of State and Government of Japan, Canada, the French Republic, the Federal Republic of Germany, the Republic of Italy, the United Kingdom of Great Britain and Northern Ireland and the United States of America regarding one hundred per cent cancellation of eligible commercial debts of the Heavily Indebted Poor Countries, to the approval given by the International Development Association and the International Monetary Fund on July 13, 2004 that the Republic of Ghana has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative and to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Ghana that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Ghana and of the Government of the creditor countries concerned held in Paris on July 22, 2004, I have the honour to propose on behalf of the Government of Japan the following arrangement:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
１　この取極は、一方においてガーナ共和国政府、その公の機関又はガーナ共和国の居住者である関係債務者と他方において日本国の居住者である関係債権者との間で千九百九十九年六月二十日より前に締結された契約に基づきガーナ共和国政府が保証していた次の商業上の債務の元本、利子及び遅延利子であって、弁済期間が一年を超え、かつ、日本国政府が保険を引き受けたもの（以下「債務」という。）の総額に適用される。

							

						

						

							

								
1.	(1)	The present arrangement will apply to the total amount of the following principal, interest and late interest of the commercial debts with a repayment period of more than one year insured by the Government of Japan, which were contracted before June 20, 1999 between the Government of the Republic of Ghana, its public sectors or other debtors concerned resident in the Republic of Ghana on the one hand and the creditors concerned resident in Japan on the other, and which were covered by the guarantee of the Government of the Republic of Ghana (hereinafter referred to as “the Debts”):

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(i)　二千四年六月一日現在で償還されていないすべての元本

(2)　及び(ii)に規定する債務の総額は、二億七千四百万二千六百八十六円（二七四、〇〇二、六八六円）と見積もられる。

							

						

						

							

								
(2)	The total amount of the debts referred to in (i) and (ii) of sub-paragraph (1) above is estimated at two hundred and seventy-four million two thousand six hundred and eighty-six yen (\274,002,686).

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(3)　(2)に規定する総額は、日本国政府及びガーナ共和国政府の関係当局間の同意により修正することができる。

							

						

						

							

								
(3)	Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the authorities concerned of the Government of Japan and the Government of the Republic of Ghana.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２　１及び(ii)に規定する債務は、この取極の発効をもって免除されることになる。二千四年六月一日からこの書簡の交換の日の前日までの間（両期日を含む。）における債務に対する利子は、課されない。

							

						

						

							

								
2.	The debts referred to in (i) and (ii) of sub-paragraph (1) of paragraph 1. will be cancelled upon the date of entry into force of the present arrangement.  No interest will be charged on the Debts between June 1, 2004 and the day preceding the date of exchange of the present Notes, both dates inclusive.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
３　ガーナ共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、ガーナ共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。

							

						

						

							

								
3.	The Government of the Republic of Ghana shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and to foster economic and social development of the Republic of Ghana, taking into account the fact that the Debts will be cancelled.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
４　関係する契約の条件のうちこの取極において特に言及されていないものは、関係する契約の当事者間で別段の合意がある場合を除くほか、引き続き適用されることが確認される。

							

						

						

							

								
4.	It is confirmed that the terms and conditions of the contracts concerned not mentioned in the present arrangement will remain applicable, unless otherwise agreed upon by the parties to the contracts concerned.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
５　両政府は、この取極から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

本官は、更に、この書簡及び前記の取極をガーナ共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
