AGREEMENT AMENDING
THE AGREEMENT BETWEEN
THE GOVERNMENT OF JAPAN AND
THE GOVERNMENT OF THE UNITED STATES OF AMERICA
CONCERNING RECIPROCAL PROVISION OF LOGISTIC SUPPORT,
SUPPLIES AND SERVICES
BETWEEN
THE SELF-DEFENSE FORCES OF JAPAN AND
THE ARMED FORCES OF THE UNITED STATES OF AMERICA

　日本国政府及びアメリカ合衆国政府は、
　日本国に対する武力攻撃に対処するに当たり日本国の自衛隊及びアメリカ合衆国軍隊がそれぞれの役割を効率的に果たしていくことを促進すること並びに国際の平和及び安全に寄与するための国際社会の努力の促進、大規模災害への対処その他の目的のために行われる活動における日本国の自衛隊とアメリカ合衆国軍隊との間の協力を拡大することの重要性を認識し、
　千九百九十八年四月二十八日に東京で署名された日本国の自衛隊とアメリカ合衆国軍隊との間における後方支援、物品又は役務の相互の提供に関する日本国政府とアメリカ合衆国政府との間の協定を改正する協定により改正された千九百九十六年四月十五日に東京で署名された日本国の自衛隊とアメリカ合衆国軍隊との間における後方支援、物品又は役務の相互の提供に関する日本国政府とアメリカ合衆国政府との間の協定（以下「改正された協定」という。)を改正することを希望して、
　次のとおり協定した。

	The Government of Japan and the Government of the United States of America,

	Recognizing the importance of promoting efficient performance of the respective roles of the Self-Defense Forces of Japan and the Armed Forces of the United States of America in coping with armed attack against Japan and of expanding cooperation between the Self-Defense Forces of Japan and the Armed Forces of the United States of America in operations conducted to further the efforts of the international community to contribute to international peace and security, to cope with large scale disasters, or for other purposes, 

	Desiring to amend the Agreement between the Government of Japan and the Government of the United States of America concerning reciprocal provision of logistic support, supplies and services between the Self-Defense Forces of Japan and the Armed Forces of the United States of America signed at Tokyo on April 15, 1996, as amended by the Agreement amending the Agreement between the Government of Japan and the Government of the United States of America concerning reciprocal provision of logistic support, supplies and services between the Self-Defense Forces of Japan and the Armed Forces of the United States of America signed at Tokyo on April 28, 1998 (hereinafter referred to as "the Agreement as amended"),

	Have agreed as follows:

　　　　第一条
　改正された協定前文中「及び人道的な国際救援活動」を「、人道的な国際救援活動及びその他の活動」に改める。

Article I

	The preamble of the Agreement as amended shall be amended by replacing the words "and humanitarian international relief operations" by the words ", humanitarian international relief operations and other operations".

　　　　第二条
　改正された協定第一条１ｂの次に次の新たなｃ及びｄを加える。

Article II

	Paragraph 1 of Article I of the Agreement as amended shall be amended by replacing the period at the end of subparagraph b. with a semi-colon, and adding the following:

ｃ　「武力攻撃事態」とは、日本国に対する武力攻撃が発生した事態又は日本国に対する武力攻撃が発生する明白な危険が切迫していると認められるに至った事態をいう。

	"c.	the term "armed attack situations" means 			situations in which armed attack against Japan 			occurs or situations in which it is recognized 			that clear danger of armed attack against Japan 			is imminent;

ｄ　「武力攻撃予測事態」とは、武力攻撃事態には至っていないが、事態が緊迫し、日本国に対する武力攻撃が予測されるに至った事態をいう。

	d.	the term "situations in which armed attack is 			anticipated" means situations which are not yet 			armed attack situations but in which 				circumstances are critical and armed attack 			against Japan is anticipated."

　　　　第三条
　改正された協定第一条２を次のように改める。

Article III

	Paragraph 2 of Article I of the Agreement as amended shall be replaced by the following:

２　この協定は、共同訓練、国際連合平和維持活動、人道的な国際救援活動、周辺事態に対応する活動、武力攻撃事態若しくは武力攻撃予測事態に際して日本国に対する武力攻撃を排除するために必要な活動又は第六条に定める活動に必要な後方支援、物品又は役務の日本国の自衛隊とアメリカ合衆国軍隊との間における相互の提供に関する基本的な条件を定めることを目的とする。

"2.	The purpose of this Agreement is to establish basic terms and conditions for the reciprocal provision of logistic support, supplies and services, between the Self-Defense Forces of Japan and the Armed Forces of the United States of America, necessary for bilateral exercises and training, United Nations Peacekeeping Operations, humanitarian international relief operations, operations in response to situations in areas surrounding Japan, operations which are necessary for repelling armed attack against Japan in armed attack situations or situations in which armed attack is anticipated, or operations as specified in Article VI."

　　　　第四条
　改正された協定第二条２中「付表」を「付表１」に改める。

Article IV

	Paragraph 2 of Article II of the Agreement as amended shall be amended by replacing the words "the Annex" by the words "Annex 1".

　　　　第五条
　改正された協定第四条２中「第二条にいう付表」を「付表１」に改める。

Article V

	Paragraph 2 of Article IV of the Agreement as amended shall be amended by replacing the words "the Annex referred to in Article II" by the words "Annex 1".

　　　　第六条
　改正された協定第四条の次に次の新たな第五条及び第六条を加える。

Article VI

	The following new Articles shall be inserted immediately after Article IV of the Agreement as amended:

　　　　第五条
１　いずれか一方の当事国政府が、武力攻撃事態又は武力攻撃予測事態に際して日本国の自衛隊又はアメリカ合衆国軍隊がそれぞれの国の法令に従って行う活動であって、日本国に対する武力攻撃を排除するために必要なもののために必要な後方支援、物品又は役務の提供を他方の当事国政府に対してこの協定に基づいて要請する場合には、当該他方の当事国政府は、その権限の範囲内で、要請された後方支援、物品又は役務を提供することができる。

"Article V

1.	When either Party requests, under this Agreement, the other Party to provide logistic support, supplies and services necessary for operations which are conducted by the Self-Defense Forces of Japan or the Armed Forces of the United States of America, in armed attack situations or situations in which armed attack is anticipated, in accordance with the laws and regulations of the respective countries and which are necessary for repelling armed attack against Japan, the other Party, within its competence, may provide the logistic support, supplies and services requested.

２　この条の規定に基づいて提供される後方支援、物品又は役務は、次に掲げる区分に係るものとする。
　食料、水、宿泊、輸送（空輸を含む。)、燃料・油脂・潤滑油、被服、通信、衛生業務、基地支援、保管、施設の利用、訓練業務、部品・構成品、修理・整備、空港・港湾業務及び弾薬
　　それぞれの区分に係る後方支援、物品又は役務については、付表１において定める。

2.	The logistic support, supplies and services related to the following categories may be provided under this Article:  food; water; billeting; transportation (including airlift); petroleum, oils, and lubricants; clothing; communications; medical services; base support; storage; use of facilities; training services; spare parts and components; repair and maintenance; airport and seaport services; and ammunition.

	The logistic support, supplies and services related to each category are specified in Annex 1.

３　２の規定については、日本国の自衛隊による武器の提供又はアメリカ合衆国軍隊による武器システムの提供が含まれるものと解してはならない。

3.	Paragraph 2 of this Article shall not be interpreted as to include the provision of weapons by the Self-Defense Forces of Japan, or the provision of weapons systems by the Armed Forces of the United States of America.

４　日本国の自衛隊が１の規定に基づいてアメリカ合衆国軍隊により後方支援、物品又は役務の提供を要請される場合には、日本国の自衛隊によるアメリカ合衆国軍隊に対する後方支援、物品又は役務の提供は、武力攻撃事態及び武力攻撃予測事態に対処するための日本国の措置について定めた日本国の関連の法律に従って行われるものと了解される。

4.	When the Self-Defense Forces of Japan is requested to provide logistic support, supplies and services under paragraph 1 of this Article by the Armed Forces of the United States of America, it is understood that the provision of logistic support, supplies and services by the Self-Defense Forces of Japan to the Armed Forces of the United States of America will be conducted pursuant to the relevant laws of Japan concerning its actions to cope with armed attack situations or situations in which armed attack is anticipated.

　　　　第六条
１　いずれか一方の当事国政府が、第二条から前条までの規定の適用を受ける活動以外の活動であって、国際の平和及び安全に寄与するための国際社会の努力の促進、大規模災害への対処その他の目的のために日本国の自衛隊又はアメリカ合衆国軍隊がそれぞれの国の法令に従って行うもののために必要な後方支援、物品又は役務の提供を他方の当事国政府に対してこの協定に基づいて要請する場合には、当該他方の当事国政府は、その権限の範囲内で、要請された後方支援、物品又は役務を提供することができる。

Article VI


1.	When either Party requests, under this Agreement, the other Party to provide logistic support, supplies and services necessary for operations, other than those which fall within the scope of Article II, III, IV, or V, conducted by the Self-Defense Forces of Japan or the Armed Forces of the United States of America in accordance with the laws and regulations of the respective countries to further the efforts of the international community to contribute to international peace and security, to cope with large scale disasters, or for other purposes, the other Party, within its competence, may provide the logistic support, supplies and services requested.

２　この条の規定に基づいて提供される後方支援、物品又は役務は、次に掲げる区分に係るものとする。
　食料、水、宿泊、輸送（空輸を含む。)、燃料・油脂・潤滑油、被服、通信、衛生業務、基地支援、保管、施設の利用、訓練業務、部品・構成品、修理・整備及び空港・港湾業務
　　それぞれの区分に係る後方支援、物品又は役務については、付表１において定める。

2.	The logistic support, supplies and services related to the following categories may be provided under this Article:  food; water; billeting; transportation (including airlift); petroleum, oils, and lubricants; clothing; communications; medical services; base support; storage; use of facilities; training services; spare parts and components; repair and maintenance; and airport and seaport services.

	The logistic support, supplies and services related to each category are specified in Annex 1.

３　２の規定については、日本国の自衛隊による武器若しくは弾薬の提供又はアメリカ合衆国軍隊による武器システム若しくは弾薬の提供が含まれるものと解してはならない。

3.	Paragraph 2 of this Article shall not be interpreted as to include the provision of weapons or ammunition by the Self-Defense Forces of Japan, or the provision of weapons systems or ammunition by the Armed Forces of the United States of America.

４　日本国の自衛隊が１の規定に基づいてアメリカ合衆国軍隊により後方支援、物品又は役務の提供を要請される場合には、日本国の自衛隊によるアメリカ合衆国軍隊に対する後方支援、物品又は役務の提供は、付表２に定める日本国の法律の規定であって現に有効なものに従って行われるものと了解される。

4.	When the Self-Defense Forces of Japan is requested to provide logistic support, supplies and services under paragraph 1 of this Article by the Armed Forces of the United States of America, it is understood that the provision of logistic support, supplies and services by the Self-Defense Forces of Japan to the Armed Forces of the United States of America will be conducted pursuant to the provisions of the laws of Japan specified in Annex 2 which are currently in effect."

　　　　第七条
　改正された協定第五条から第十条までを二条ずつ繰り下げる。新たな第八条中「第八条」を「第十条」に改める。

Article VII

	Remaining Articles V, VI, VII, VIII, IX, and X of the Agreement as amended shall be renumbered as Articles VII, VIII, IX, X, XI, and XII, respectively.  The references to "Article V" and "Article VIII" in renumbered Article VIII shall be replaced by references to "Article VII" and "Article X", respectively.

　　　　第八条
　改正された協定の新たな第十二条２の次に次の新たな３を加える。

Article VIII

	The following new paragraph shall be inserted immediately after paragraph 2 of renumbered Article XII of the Agreement as amended:

　３　両当事国政府が合意するこの協定の改正は、アメリカ合衆国政府が日本国政府から日本国が当該改正を承認した旨の書面による通告を受領した日の後三十日目の日に効力を生じ、この協定が有効である限り効力を有する。ただし、この協定の付表２は、両当事国政府の合意により、この協定を改正することなく修正することができる。付表２の修正は、両当事国政府間の外交上の公文の交換によって確認された日に効力を生ずる。

"3.	An amendment of this Agreement agreed to between the Parties shall enter into force on the 30th day after the date of receipt by the Government of the United States of America of a written notice from the Government of Japan of approval of the amendment by Japan and shall remain in force as long as this Agreement remains in force.  However, Annex 2 of this Agreement may be modified by agreement between the Parties without amendment of this Agreement.  Modifications of Annex 2 shall take effect on the date upon which they have been confirmed by exchange of diplomatic notes."

　　　　第九条
　改正された協定の付表をこの協定に添付されている付表１に改める。この協定に添付されている付表２を改正された協定に付表２として加える。

Article IX

	The Annex of the Agreement as amended shall be replaced by Annex 1 attached to this Agreement.  Annex 2 attached to this Agreement shall be added to the Agreement as amended as Annex 2.

　　　　第十条
　この協定は、アメリカ合衆国政府が日本国政府から日本国がこの協定を承認した旨の書面による通告を受領した日の後三十日目の日に効力を生じ、改正された協定が有効である限り効力を有する。

Article X

	This Agreement shall enter into force on the 30th day after the date of receipt by the Government of the United States of America of a written notice from the Government of Japan of approval of this Agreement by Japan and shall remain in force as long as the Agreement as amended remains in force.

　以上の証拠として、下名は、各自の政府から正当に委任を受けてこの協定に署名した。

　二千四年二月二十七日に東京で、ひとしく正文である日本語及び英語により本書二通を作成した。
