　書簡をもって啓上いたします。本使は、スリランカ民主社会主義共和国の経済の安定及び開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とスリランカ民主社会主義共和国政府の代表者との間で最近到達した次の了解を確認する光栄を有します。

	I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of the Democratic Socialist Republic of Sri Lanka concerning Japanese loans to be extended with a view to promoting the economic stabilization and development efforts of the Democratic Socialist Republic of Sri Lanka:



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
１　百十七億七千六百万円（一一、七七六、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款
Ⅰ」という。）が、この書簡の付表（以下「付表」という。）の１に掲げる事業計画を実施するため、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従って、スリランカ民主社会主義共和国政府に供与されることになる。


							

						

						

							

								
I

1.	A loan in Japanese yen up to the amount of eleven billion  seven hundred and seventy-six million yen (11,776,000,000) (hereinafter referred to as "the Loan I") will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Democratic Socialist Republic of Sri Lanka by Japan Bank for International Cooperation (hereinafter referred to as "the Bank") to implement the project enumerated in 1 of the list attached hereto (hereinafter referred to as "the List").



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２(1)　借款Ⅰは、スリランカ民主社会主義共和国政府と銀行との間で締結される借款契約に基づいて使用に供される。借款Ⅰの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。


							

						

						

							

								
2.	(1)	The Loan I will be made available by a loan agreement to be concluded between the Government of the Democratic Socialist Republic of Sri Lanka and the Bank.  The terms and conditions of the Loan I as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(a)　償還期間は、十年の据置期間の後三十年とする。


							

						

						

							

								
	(a)	the repayment period will be thirty (30) years after the grace period of ten (10) years;



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(b)　利子率は、年○・七五パーセントとする。


							

						

						

							

								
	(b)	the rate of interest will be seventy-five-hundredths per cent (0.75%) per annum; and



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(c)　支出期間は、前記の借款契約の発効の日から四年とする。

(2)　(1)に規定する借款契約は、銀行が付表の１に掲げる事業計画の実行可能性（環境に対する配慮を含む。）を確認した後に締結される。


							

						

						

							

								
	(2)	The loan agreement mentioned in sub-paragraph (1) above will be concluded after the Bank is satisfied of the feasibility, including environmental consideration, of the project enumerated in 1 of the List.




							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
３(1)　借款Ⅰは、スリランカの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して既に行ったか又は行う支払で、付表の１に掲げる事業計画の実施に必要な生産物又は役務の購入のために両
者の間で締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。


							

						

						

							

								
3.	(1)	The Loan I shall be made available to cover payments already made and/or to be made by the Sri Lankan executing agency to suppliers, contractors and/or consultants of eligible source countries under such contracts as may be entered into between them for purchases of products and/or services required for the implementation of the project enumerated in 1 of the List, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(2)　(1)に規定する調達適格国の範囲は、両政府の関係当局間で合意される。


							

						

						

							

								
	(2)	The scope of eligible source countries mentioned in sub-paragraph (1) above shall be agreed upon between the authorities concerned of the two Governments.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(3)　借款Ⅰの一部は、付表の１に掲げる事業計画の実施のための適格な現地通貨の需要に充てるために使用することができる。


							

						

						

							

								
	(3)	A part of the Loan I may be used to cover eligible local currency requirements for the implementation of the project enumerated in 1 of the List.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
４　スリランカ民主社会主義共和国政府は、３(1)に規定する生産物又は役務が銀行の調達のためのガイドライン（国際競争入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際競争入札の手続をなかんずく定める。）に従って調達されることを確保する。


							

						

						

							

								
4.	The Government of the Democratic Socialist Republic of Sri Lanka shall ensure that the products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Bank, which set forth, inter alia, the procedures of international competitive bidding to be followed except where such procedures are inapplicable or inappropriate.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
５　スリランカ民主社会主義共和国政府は、借款Ⅰに基づいて購入される生産物の海上輸送及び海上保険に
関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。


							

						

						

							

								
5.	With regard to the shipping and marine insurance of the products purchased under the Loan I, the Government of the Democratic Socialist Republic of Sri Lanka shall refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
６　３(1)に規定する生産物又は役務の供給に関連してスリランカ民主社会主義共和国においてその役務が必要とされる日本国民は、作業の遂行のためスリランカ民主社会主義共和国への入国及び同国における滞在に必要な便宜を与えられる。


							

						

						

							

								
6.	Japanese nationals whose services may be required in the Democratic Socialist Republic of Sri Lanka in connection with the supply of the products and/or services mentioned in sub-paragraph (1) of paragraph 3 shall be accorded such facilities as may be necessary for their entry into the Democratic Socialist Republic of Sri Lanka and stay therein for the performance of their work.




							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
７　スリランカ民主社会主義共和国政府は、供給者、請負業者又はコンサルタントとして活動する日本国の
会社に代わって、付表の１に掲げる事業計画の実施に必要な資材及び設備の輸入及び再輸出に関する財政課徴金を支払うための措置をとる。


							

						

						

							

								
7.	The Government of the Democratic Socialist Republic of Sri Lanka, on behalf of the Japanese companies operating as suppliers, contractors and/or consultants, shall make arrangements to meet the fiscal levies with respect to the import and re-export of the materials and equipment needed for the implementation of the project enumerated in 1 of the List.




							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
　　　　Ⅱ
１　百四十八億五千五百万円（一四、八五五、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款
Ⅱ」という。）が、付表の２及び３に掲げる事業計画を実施するため、各事業計画につき付表の定める配分に応じ、銀行により、日本国の関係法令に従って、スリランカ民主社会主義共和国政府に供与されることになる。


							

						

						

							

								
II

1.	A loan in Japanese yen up to the amount of fourteen billion eight hundred and fifty-five million yen (14,855,000,000) (hereinafter referred to as "the Loan II") will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Democratic Socialist Republic of Sri Lanka by the Bank to implement the projects enumerated in 2 and 3 of the List according to the allocation for each project as specified in the List.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２(1)　借款Ⅱは、スリランカ民主社会主義共和国政府と銀行との間で締結される借款契約に基づいて使用に供される。借款Ⅱの条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。


							

						

						

							

								
2.	(1)	The Loan II will be made available by loan agreements to be concluded between the Government of the Democratic Socialist Republic of Sri Lanka and the Bank. (2)　(1)に規定する借款契約の各々は、銀行が当該借款契約に係る事業計画の実行可能性（環境に対する配慮を含む。）を確認した後に締結される。

３　借款Ⅱは、事業計画に基づきスリランカ民主社会主義共和国政府が借入人に対して行うことのある融資

3.	The Loan II will be made available to cover credits to be extended by the Government of the Democratic Socialist Republic of Sri Lanka to the sub-borrowers under the projects.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
　　　　Ⅲ
１　Ｉ２(1)(c)及びⅡ２(1)(c)に規定するそれぞれの支出期間は、両政府の関係当局の同意を得てそれぞれ延長することができる。

1.	The respective disbursement periods mentioned in sub-paragraph (1)(c) of paragraph 2 of part I and sub-paragraph (1)(c) of paragraph 2 of part II may be extended with the consent of the authorities concerned of the two Governments.




							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２　スリランカ民主社会主義共和国政府は、銀行について、借款Ｉ及び借款Ⅱ並びにそれらから生ずる利子
に対して又はそれらに関連してスリランカ民主社会主義共和国において課されるすべての財政課徴金及び租税を免除する。


							

						

						

							

								
2.	The Government of the Democratic Socialist Republic of Sri Lanka shall exempt the Bank from all fiscal levies and taxes imposed in the Democratic Socialist Republic of Sri Lanka on and/or in connection with the Loan I and the Loan II as well as interest accruing therefrom.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
３　スリランカ民主社会主義共和国政府は、次のことを確保するために必要な措置をとる。

(a)　借款Ｉ及び借款Ⅱが適正にかつ専ら付表に掲げる事業計画のために使用されること。

(b)　借款Ｉに基づいて建設される施設がこの了解に定める目的のために適正にかつ効果的に維持され及び使用されること。

４　スリランカ民主社会主義共和国政府は、要請に応じ、日本国政府及び銀行に対し、付表に掲げる事業計
画の実施の進状(ちよく)況に関する情報及び資料を提供する。

The Government of the Democratic Socialist Republic of Sri Lanka shall, upon request, furnish the Government of Japan and the Bank with information and data concerning the progress of the implementation of the projects enumerated in the List.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
５　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議す
