（日本側書簡） （訳文） 書簡をもって啓上いたします。本使は、二千一年十月十六日にパリで開催されたシエラレオネ共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論及び二千二年七月十日に合意された修正に基づき日本国政府の代表者とシエラレオネ共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、前記の交渉において到達した次の了解を確認する光栄を有します。
(Japanese Note) Accra, May 24, 2004 Excellency, I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Sierra Leone that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Sierra Leone and of the Governments of the creditor countries concerned held in Paris on October 16, 2001 as well as their amendment on July 10, 2002. I have further the honour to confirm the following understanding reached in the course of the said negotiations:
１ 債務繰延方式による債務救済措置が、日本国農林水産省（以下「省」という。)により、日本国の関係法 令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will be taken in accordance with the relevant laws and regulations of Japan by the Ministry of Agriculture, Forestry and Fisheries of Japan (hereinafter referred to as "the Ministry").
２(1) 繰り延べられる債務（以下「繰延債務」という。)の総額は、五十九億七千百八十九万三千五百八十一円（五、九七一、八九三、五八一円）になる。繰延債務は、シエラレオネ共和国政府が省に対して負っている次の債務から成る。
2. (1) The total amount of the debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") will be five billion nine hundred seventy-one million eight hundred ninety-three thousand five hundred and eighty-one yen (5,971,893,581). The Rescheduled Debts consist of the following debts owed by the Government of the Republic of Sierra Leone to the Ministry:
(a) 二千一年九月三十日以前に弁済期限の到来した未払の元本及び契約上の利子並びにそれらの遅延利子であって二千一年九月三十日以前に生じたもの（それらの内訳は、この書簡の付表一に掲げられる。)
(a) the principal and contractual interest having fallen due on or before September 30, 2001 and not paid, and the late interest on such principal and contractual interest having accrued on or before September 30, 2001, the breakdown of which is shown in the List 1 attached hereto;
(b) 二千一年十月一日から二千二年九月三十日までの間（両期日を含む。)に弁済期限の到来した未払の 元本及び契約上の利子（それらの内訳は、この書簡の付表二に掲げられる。)
(b) the principal and contractual interest having fallen due between October 1, 2001 and September 30, 2002, both dates inclusive, and not paid, the breakdown of which is shown in the List 2 attached hereto;
(c) 二千二年十月一日から二千三年九月三十日までの間（両期日を含む。)に弁済期限の到来した未払の 元本及び契約上の利子（それらの内訳は、この書簡の付表三に掲げられる。)
(c) the principal and contractual interest having fallen due between October 1, 2002 and September 30, 2003, both dates inclusive, and not paid, the breakdown of which is shown in the List 3 attached hereto; and
(d) 二千三年十月一日から二千四年九月三十日までの間（両期日を含む。)に弁済期限の到来したか又は 到来する元本及び契約上の利子（それらの内訳は、この書簡の付表四に掲げられる。)
(d) the principal and contractual interest having fallen or falling due between October 1, 2003 and September 30, 2004, both dates inclusive, the breakdown of which is shown in the List 4 attached hereto.
(2) (1)にいう総額及びこの書簡の付表一から四は、シエラレオネ共和国政府の関係当局及び省が行う最終的照合の後に日本国政府及びシエラレオネ共和国政府の関係当局間の合意により修正されることがあ る。
(2) Modifications may be made to the total amount referred to in sub-paragraph (1) above and to the Lists 1, 2, 3 and 4 attached hereto by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Sierra Leone, after the final verification to be made by the authorities concerned of the Government of the Republic of Sierra Leone and the Ministry.
３ 債務繰延べの条件は、シエラレオネ共和国政府と省との間で締結される債務繰延契約（以下「債務繰延契約」という。)であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in a rescheduling agreement to be concluded between the Government of the Republic of Sierra Leone and the Ministry (hereinafter referred to as "the Rescheduling Agreement"), which will contain, inter alia, the following principles:
(1) 繰延債務の総額は、この書簡の附属書に掲げる支払計画に従って二千十九年十月一日に始まる四十八回の半年賦払によって支払われる。
(1) The total amount of the Rescheduled Debts will be paid in forty-eight (48) semi-annual installments beginning on October 1, 2019 in accordance with the payment schedule shown in the Annex attached hereto.
(2) 繰延債務に対して各々の当初の弁済期日の翌日から債務繰延契約の締結の日の前日までの間（両期日を含む。)に適用される利子率は、年九・八五五パーセントとし、また、債務繰延契約の締結の日から適 用される利子率は、年三パーセントとする。
(2) The rate of interest on the Rescheduled Debts applied between the next day of each original due date and the previous day of the date of conclusion of the Rescheduling Agreement, both dates inclusive, will be nine point eight five five per cent (9.855%) per annum and the rate of interest applied from the date of conclusion of the Rescheduling Agreement will be three per cent (3%) per annum.
(3) 利子の支払は、毎年四月一日及び十月一日に行われる。最初の利子の支払は、二千四年十月一日に行われる。
(3) The payments of interest will be made on April 1 and October 1 each year. The first payment of interest will be made on October 1, 2004.
(4) シエラレオネ共和国政府は、(1)に定める支払計画又は(3)に定める利子の支払計画に基づくいずれかの支払が遅延した場合には、未払額から生ずる遅延利子を年五パーセントの率によって支払う。
(4) In case where any payment under the payment schedule set out in sub-paragraph (1) above or the payment schedule of interest set out in sub-paragraph (3) above is retarded, the Government of the Republic of Sierra Leone will pay the late interest accruing from the overdue amount at the rate of five per cent (5%) per annum.
(5) 支払われる利子については、シエラレオネ共和国のすべての租税及び課徴金が免除される。
(5) The interest paid will be exempted from all taxes and duties of the Republic of Sierra Leone.
４ シエラレオネ共和国政府は、関係債務の決済に伴って生ずる銀行手数料を支払う。
4. The Government of the Republic of Sierra Leone will pay bank charges incidental to the settlement of the debts concerned.
５ シエラレオネ共和国政府は、いずれかの第三国の居住者であって債権を有する者に対し債務救済措置について３(1)にいう条件より有利な条件を与えた場合には、当該第三国の居住者であって債権を有する者に与えられる条件より不利でない条件を、省に直ちに与える。
5. If the Government of the Republic of Sierra Leone accords to creditors resident in any third country terms and conditions more favourable than those referred to in sub-paragraph (1) of paragraph 3 with regard to debt relief measures, the Government of the Republic of Sierra Leone will forthwith accord to the Ministry the terms and conditions not less favourable than those accorded to creditors resident in such third country.
６ シエラレオネの債務（この取極が対象とする債務を含む。)の再編に関してシエラレオネ共和国政府の代 表者及び関係債権諸国の代表者が新たな結論に到達した場合には、日本国政府とシエラレオネ共和国政府との間でこの取極の継続又は修正について討議するための協議が行われる。
6. If the representative of the Government of the Republic of Sierra Leone and the representatives of the Governments of the creditor countries concerned come to a new conclusion in connection with reorganization of the Sierra Leonean debts including the debts covered by the present arrangements, consultations shall be held between the Government of Japan and the Government of the Republic of Sierra Leone, in order to discuss the matter of continuation or modification of the present arrangements.
