　書簡をもって啓上いたします。本使は、相手国の権限のある当局が付与した運転免許を有する者に対して自国の権限のある当局が運転免許を付与する際の手続に関して、日本国政府の代表者とポーランド共和国政府の代表者との間で行われた最近の協議に言及する光栄を有します。本使は、更に、次の取極を日本国政府に代わって提案する光栄を有します。

Excellency,

	I have the honour to refer to the recent consultation held between the representatives of the Government of Japan and of the Government of the Republic of Poland concerning the procedures for the competent authorities of one country to give a driving permit to a person holding a driving permit issued by the competent authorities of the other country.  I have further the honour to propose on behalf of the Government of Japan the following arrangements:



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
１　いずれの国の権限のある当局も、他方の国の権限のある当局が付与した運転免許を有する者からの運転
免許（仮運転免許及び旅客自動車運送事業に係る旅客を運送する目的で自動車を運転することを許可するための運転免許を除く。)の申請を受けて次のことを行うに際し、自国の法令に従い実技試験及び筆記試験を免除する。


							

						

						

							

								
1.	The competent authorities of either country shall, in taking the following measures, exempt from examination of technical skill and that of knowledge for a driving permit in accordance with its laws and regulations when it issues a driving permit, other than a temporary driving permit as well as a permit for driving motor vehicles for the purpose of transporting passengers in the passenger motor vehicle transportation business, equivalent in kind to a driving permit issued by the competent authorities of the other country upon relevant requests submitted by interested persons:



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(a)　日本国の権限のある当局に関しては、当該者にポーランド共和国の権限のある当局が付与した運転免許の種類に相当する自国の運転免許の付与


							

						

						

							

								
(a) With regard to the competent authorities of Japan, the issuance of the driving permit of Japan which has the equivalent category issued by the competent authorities of the Republic of Poland.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(b)　ポーランド共和国の権限のある当局に関しては、当該者に日本国の権限のある当局が付与した運転免許と引換えに行う、その運転免許の種類に相当する自国の運転免許の付与


							

						

						

							

								
(b) With regard to the competent authorities of the Republic of Poland, the exchange of the driving permit which has the equivalent category issued by the competent authorities of Japan.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２　いずれの政府も、自国の権限のある当局の運転免許を申請する者が有する他方の国の権限のある当局の
運転免許証が真正なものであるかどうかにつき自国の権限のある当局が疑義を有する場合には、他方の政府に対し確認を要請することができる。


							

						

						

							

								
2.	Either Government may seek confirmation from the other Government when the competent authorities of the former Government have a doubt about authenticity of the driving permit of the competent authorities of the latter Government held by a person applying for a driving permit of the former competent authorities.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
３　いずれの政府も、他方の政府の要請に基づき、自国の運転免許証の様式、自国の運転免許と他方の国の
運転免許との同等性及び運転免許に係る制度に関する情報を提供する。


							

						

						

							

								
3.	Either Government shall, upon the request of the other Government, provide information on the form of the driving permit of its country, the equivalence of such driving permit to the driving permit of the other country and the system concerning driving permit.




							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
４　この取極の規定は、運転免許を申請する者に対し、それぞれの国の法令に従い行政上の手続のために必
要とされる手続（書類の提出、手数料の支払等）を免除するものではない。


							

						

						

							

								
4.	The provisions of the present arrangements do not exempt a person who applies for a driving permit from the procedures, such as the submission of documents and the payment of fees, which are required for administrative process under the laws and regulations of each country.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
５　この取極は、千九百四十九年の道路交通に関する条約に基づくいかなる権利及び義務にも影響を及ぼす
ものではない。


							

						

						

							

								
5.	The present arrangements shall not affect any rights and obligations under the Convention on Road Traffic of 1949.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
６　この取極は、それぞれの国において施行されている法令に従って実施される。


							

						

						

							

								
6.	The present arrangements shall be implemented in accordance with the laws and regulations in force in each country.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
７　いずれの政府も、他方の政府に対し三十日前に文書による予告を与えることにより、この取極を終了さ
せることができる。


							

						

						

							

								
7.	Either Government may terminate the present arrangements by giving thirty days' written notice to the other Government.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
　本使は、更に、この書簡及びポーランド共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意がそれぞれの政府がこの取極の効力発生のために必要な国内手続を完了したことを確認する外交上の経路を通じた文書による通告を行った日であっていずれか遅い方の日付の日の後六十日目の日に効力を生ずるものとすることを提案する光栄を有します。
この書簡は、ひとしく正文である日本語、ポーランド語及び英語により作成され、解釈に相違がある場合
には、英語の本文によるものとします。
　本使は、以上を申し進めるに際し、ここに重ねて閣下に向かって敬意を表します。

	I have further the honour to propose that this Note and Your Excellency's Note in reply confirming the foregoing arrangements on behalf of the Government of the Republic of Poland shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the sixtieth day after the latter of the dates of the written notifications through the diplomatic channel by which the two Governments confirm that their respective internal procedures required for its entry into force have been completed.

	This Note is written in the Japanese, Polish and English languages, each text being equally authentic, and in case of any divergence in interpretation, the English text shall prevail.

	I avail myself of this opportunity to renew to Your Excellency the assurance of my highest consideration.
