　書簡をもって啓上いたします。本官は、日本国の借款に関してこの書簡の付表に掲げる日に日本国政府とネパール王国政府との間で交換された書簡（以下「従前の書簡」という。）並びに開発途上国の債務及び開発の問題について千九百七十八年三月十一日に国際連合貿易開発会議第九回特別貿易開発理事会第三会期において採択された決議第百六十五号に関し、次の了解を日本国政府に代わって提案する光栄を有します。

					Kathmandu, October 12, 2004

Dear Mr. Achrya,

	With reference to the Notes exchanged between the Government of Japan and His Majesty's Government of Nepal on the dates enumerated in the List attached hereto concerning Japanese loans (hereinafter referred to as "the Previous Notes") and to the resolution 165 adopted at the Third Part of the Ninth Special Session of the Trade and Development Board of the United Nations Conference on Trade and Development on March 11, 1978 regarding debt and development problems of developing countries, I have the honour to propose on behalf of the Government of Japan the following understanding:



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
１　債務免除方式による債務救済措置が、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従ってとられることになる。


							

						

						

							

								
1.	A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by Japan Bank for International Cooperation (hereinafter referred to as "the Bank").



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２　（１）免除される債務は、従前の書簡に従って締結された借款契約に基づく次の債務（以下「債務」という。）から成る。
　従前の書簡に従って締結された借款契約に基づいて支払われるべき二千三年四月一日以後に弁済期限の到来したか又は到来する元本及び利子


							

						

						

							

								
2.	(1)	The debts to be cancelled consist of the following debts under the loan agreements concluded in accordance with the Previous Notes (hereinafter referred to as "the Debts"):

		the principal and interest having fallen or falling due on or after April 1, 2003 which are payable under the loan agreements concluded in accordance with the Previous Notes. 



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
（２）　二千三年三月三十一日時点における債務の総額の見積りは、二百十一億千六百十五万九千二百九十六円（二一、一一六、一五九、二九六円）である。


							

						

						

							

								
	(2)	The estimate, as of March 31, 2003, of the total amount of the Debts is twenty-one billion one hundred sixteen million one hundred fifty-nine thousand two hundred and ninety-six yen (21,116,159,296).



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
（３）（２）　にいう総額は、ネパール王国政府及び銀行が行う最終的照合の後に、日本国政府及びネパール王国政府の権限のある当局間の相互の同意により修正されることがある。


							

						

						

							

								
	(3)	Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of His Majesty's Government of Nepal, after the final verification to be made by His Majesty's Government of Nepal and the Bank.




							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
（４）　銀行の各事業年度における免除の日程は、にいう各々の元本又は利子の弁済期限の到来のたびにネパール王国政府は当該元本又は利子の支払を免除されるという原則に基づき、同政府と銀行との間で決定される。その日程は、日本国政府及びネパール王国政府の権限のある当局間で確認される。


							

						

						

							

								
	(4)	The schedule of the cancellation for each Bank's fiscal year will be determined between His Majesty's Government of Nepal and the Bank on the basis of the principle that His Majesty's Government of Nepal will be exempted from the payment of each principal or interest referred to in sub-paragraph (1) above as they fall due.  The schedule shall be confirmed by the competent authorities of the Government of Japan and of His Majesty's Government of Nepal.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
（５）（３）　及び（４）にいう日本国政府の権限のある当局は、外務省及び財務省であり、及びにいうネパール王国政府の権限のある当局は、外務省及び大蔵省である。


							

						

						

							

								
	(5)	The competent authorities of the Government of Japan referred to in sub-paragraphs (3) and (4) above will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authorities of His Majesty's Government of Nepal referred to in sub-paragraphs (3) and (4) above will be the Ministry of Foreign Affairs and the Ministry of Finance.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
３　債務は、ネパール王国政府に対して銀行が行う免除の通告により免除されることになる。

４　ネパール王国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、ネパール王国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。


							

						

						

							

								
4.	His Majesty's Government of Nepal shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and promote social and economic development of the Kingdom of Nepal, taking into account the fact that the Debts will be cancelled.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
５　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

　本官は、更に、この書簡及び前記の了解をネパール王国政府に代わって確認される貴官の返簡が両政府間の合意を構成し、その合意が貴官の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
