（日本側書簡） （訳文） 書簡をもって啓上いたします。本使は、日本国の借款に関してこの書簡の付表に掲げる日に日本国政府とマリ共和国政府との間で交換された書簡（以下「従前の書簡」という。)、重債務貧困国の政府開発援助債務 の完全な免除に関する日本国、カナダ、フランス共和国、ドイツ連邦共和国、イタリア共和国、グレートブリテン及び北アイルランド連合王国及びアメリカ合衆国の元首及び政府の長により千九百九十九年六月十八日にケルンで発出された声明並びにマリ共和国が拡大重債務貧困国イニシアティブの下で包括的な債務救済を受けるために必要な条件を満たしたことについて国際通貨基金及び国際開発協会により二千三年二月二十八日及び三月六日になされた承認に関し、次の了解を日本国政府に代わって提案する光栄を有します。
(Japanese Note) Dakar, March 12, 2004 Excellency, With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of Mali on the dates enumerated in the List attached hereto concerning Japanese loans (hereinafter referred to as "the Previous Notes"), to the statement issued at Cologne on June 18, 1999 by the heads of State and Government of Japan, Canada, French Republic, Federal Republic of Germany, Republic of Italy, United Kingdom of Great Britain and Northern Ireland and United States of America regarding the full cancellation of official development assistance debt of the Heavily Indebted Poor Countries and to the approval given by the International Monetary Fund and the International Development Association on February 28, 2003 and March 6, 2003 that the Republic of Mali has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative, I have the honour to propose on behalf of the Government of Japan the following understanding:
１ 債務免除方式による債務救済措置が、国際協力銀行（以下「銀行」という。)により、日本国の関係法令 に従ってとられることになる。
1. A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by Japan Bank for International Cooperation (hereinafter referred to as "the Bank").
２（１） 免除される債務は、従前の書簡に従って締結された借款契約に基づく次の債務（以下「債務」とい う。)から成る。
2. (1) The debts to be cancelled consist of the following debts under the loan agreements concluded in accordance with the Previous Notes (hereinafter referred to as "the Debts"):
（a） 二千三年三月一日現在で償還されていないすべての元本
(a) all the principal outstanding as of March 1, 2003; and
(b) 二千三年三月一日以前に生じた未払のすべての利子（遅延利子を含む。)
(b) all the interest (including late interest) having accrued on or before March 1, 2003 and not paid.
（２） 債務の総額は、七十八億三千四百三十三万三百三十二円（七、八三四、三三〇、三三二円）になる。
(2) The total amount of the Debts will be seven billion eight hundred thirty-four million three hundred thirty thousand three hundred and thirty-two yen (7,834,330,332).
（３）（２）にいう総額は、マリ共和国政府及び銀行が行う最終的照合の後に、日本国政府及びマリ共和国政府 の権限のある当局間の相互の同意により修正されることがある。日本国政府の権限のある当局は、外務省及び財務省であり、マリ共和国政府の権限のある当局は、経済財政省である。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of the Government of the Republic of Mali, after the final verification to be made by the Government of the Republic of Mali and the Bank. The competent authorities of the Government of Japan will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authorities of the Government of the Republic of Mali will be Ministry of Economy and Finance.
３ 債務は、マリ共和国政府に対して銀行が行う免除の通告により免除されることになる。二千三年三月二 日から当該通告の日までの間（両期日を含む。)における債務に対する利子は、課されない。
3. The Debts will be cancelled by notification to that effect to be made by the Bank to the Government of the Republic of Mali. No interest will be charged on the Debts between March 2, 2003 and the date of such notification, both dates inclusive.
４ マリ共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、マリ共和国の貧困を 削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。
4. The Government of the Republic of Mali shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and promote social and economic development of the Republic of Mali, taking into account the fact that the Debts will be cancelled.
５ 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議す る。
5. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.

I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Republic of Mali the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency's Note in reply.
