　書簡をもって啓上いたします。本使は、日本国の借款に関してこの書簡の付表一に掲げる日に日本国政府とマラウイ共和国政府との間で交換された書簡（以下「従前の書簡Ⅰ」という。）、債務救済措置に関してこの書簡の付表二に掲げる日に日本国政府とマラウイ共和国政府との間で交換された書簡（以下「従前の書簡Ⅱ」という。）並びに開発途上国の債務及び開発の問題について千九百七十八年三月十一日に国際連合貿易開発会議第九回特別貿易開発理事会第三会期において採択された決議第百六十五号に関し、次の了解を日本国政府に代わって提案する光栄を有します。

Honourable Minister,

	With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of Malawi on the dates enumerated in the List 1 attached hereto concerning Japanese loans (hereinafter referred to as "the Previous Notes I"), to the Notes exchanged between the Government of Japan and the Government of the Republic of Malawi on the date enumerated in the List 2 attached hereto concerning debt relief measures (hereinafter referred to as "the Previous Notes II") and to the resolution 165 adopted at the Third Part of the Ninth Special Session of the Trade and Development Board of the United Nations Conference on Trade and Development on March 11, 1978 regarding debt and development problems of developing countries, I have the honour to propose on behalf of the Government of Japan the following understanding:



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
１　債務免除方式による債務救済措置が、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従ってとられることになる。


							

						

						

							

								
1.	A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by Japan Bank for International Cooperation (hereinafter referred to as "the Bank").



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
２　（１）免除される債務は、従前の書簡Ⅰに従って締結された借款契約に基づく次の債務であって、従前の書簡Ⅱに従って締結された債務繰延契約を考慮した次のもの（以下「債務」という。）から成る。


							

						

						

							

								
2.	(1)	The debts to be cancelled will be the following debts under the loan agreements concluded in accordance with the Previous Notes I, taking into account the rescheduling agreement concluded in accordance with the Previous Notes II (hereinafter referred to as "the Debts"):  
	


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
(a)　従前の書簡Ⅰに従って締結された借款契約に基づいて支払われるべき二千三年四月一日以後に弁済期限の到来したか又は到来する元本及び契約上の利子

（２）　二千三年三月三十一日時点における債務の総額の見積りは、二百八十二億二千五百二十七万九千八百十五円（二八、二二五、二七九、八一五円）である。


							

						

						

							

								
	(2)	The estimate, as of March 31, 2003, of the total amount of the Debts is twenty-eight billion two hundred twenty-five million two hundred seventy-nine thousand eight hundred and fifteen yen (28,225,279,815).



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
（３）（２）　にいう総額は、マラウイ共和国政府及び銀行が行う最終的照合の後に、日本国政府及びマラウイ共和国政府の権限のある当局間の相互の同意により修正されることがある。


							

						

						

							

								
	(3)	Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of the Government of the Republic of Malawi, after the final verification to be made by the Government of the Republic of Malawi and the Bank.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
（４）　銀行の各事業年度における免除の日程は、にいう各々の元本又は利子の弁済期限の到来のたびにマラウイ共和国政府は当該元本又は利子の支払を免除されるという原則に基づき、同政府及び銀行の間で
決定される。その日程は、日本国政府及びマラウイ共和国政府の権限のある当局間で確認される。


							

						

						

							

								
	(4)	The schedule of the cancellation for each Bank's fiscal year will be determined between the Government of the Republic of Malawi and the Bank on the basis of the principle that the Government of the Republic of Malawi will be exempted from the payment of each principal or interest referred to in sub-paragraph (1) above as they fall due.  The schedule shall be confirmed by the competent authorities of the Government of Japan and of the Government of the Republic of Malawi.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
（５）（３）　及び（４）にいう日本国政府の権限のある当局は、外務省及び財務省であり、及びにいうマラウイ共和国政府の権限のある当局は、財務省である。


							

						

						

							

								
	(5)	The competent authorities of the Government of Japan referred to in sub-paragraphs (3) and (4) above will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authority of the Government of the Republic of Malawi referred to in sub-paragraphs (3) and (4) above will be the Ministry of Finance.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
３　債務は、マラウイ共和国政府に対して銀行が行う免除の通告により免除されることになる。

４　マラウイ共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、マラウイ共和国の貧困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。


							

						

						

							

								

4.	The Government of the Republic of Malawi shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and promote social and economic development of the Republic of Malawi, taking into account the fact that the Debts will be cancelled.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
５　両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議す
る。

　本使は、更に、この書簡及び前記の了解をマラウイ共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
