（日本側書簡） （訳文） 書簡をもって啓上いたします。本使は、二千一年十二月十日にパリで開催されたガーナ共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とガーナ共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、前記の交渉において到達した次の了解を確認する光栄を有します。
(Japanese Note) Accra, March 9, 2004 Excellency, I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Ghana that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Ghana and of the Governments of the creditor countries concerned held in Paris on December 10, 2001. I have further the honour to confirm the following understanding reached in the course of the said negotiations:
１ 債務支払猶予方式による債務救済措置が、国際協力銀行（以下「銀行」という。)により、日本国の関係 法令に従ってとられることになる。
1. A debt relief measure in the form of deferral will be taken in accordance with the relevant laws and regulations of Japan by Japan Bank for International Cooperation (hereinafter referred to as "the Bank").
２(1) 支払猶予の対象となる債務（以下「支払猶予債務」という。)は、ガーナ共和国政府が銀行に対して負 う次の(a)及び(b)にいう債務から成る。
2. (1) The debts to be deferred (hereinafter referred to as "the Deferred Debts") consist of the debts referred to in (a) and (b) below which the Government of the Republic of Ghana owes to the Bank.
(a) 円借款の供与に関してガーナ共和国政府と海外経済協力基金（以下「基金」という。)との間で千九 百八十三年一月一日以降千九百九十九年六月二十日より前に締結された借款契約に基づいて支払われるべき債務に関し、
(a) For the debts payable under the Loan Agreements concluded on or after January 1, 1983 and before June 20, 1999 between the Government of the Republic of Ghana and the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") on the extension of Yen Loan,
(i) 二千一年五月三十一日以前に弁済期限の到来した未払の元本及び契約上の利子の百パーセント。 それらの内訳は、この書簡の付表一に掲げられる。
(i) a hundred per cent (100%) of the principal and contractual interest having fallen due on or before May 31, 2001 and not paid, the breakdown of which is shown in the List 1 attached hereto;
(ii) 二千一年六月一日から二千二年一月三十一日までの間（両期日を含む。)に弁済期限の到来した未 払の元本及び契約上の利子の七十パーセント。それらの内訳は、この書簡の付表二に掲げられる。
(ii) seventy per cent (70%) of the principal and contractual interest having fallen due between June 1, 2001 and January 31, 2002, both dates inclusive, and not paid, the breakdown of which is shown in the List 2 attached hereto; and
(b) 上記(a)(i)及び(a)(ii)にいう債務に対して二千一年六月一日から二千二年一月三十一日までの間（両期 日を含む。)に発生した利子。利子は、年一・八パーセントの利子率で算出される。
(b) The interest on the debts mentioned in (a)(i) and (a)(ii) above accrued for the period between June 1, 2001 and January 31, 2002, both dates inclusive. The interest will be calculated at the rate of one point eight per cent (1.8%) par annum.
(2) 支払猶予債務の総額は、三十九億二千六百二万三千五百七十円（三、九二六、〇二三、五七〇円）に なる。
(2) The total amount of the Deferred Debts will be three billion nine hundred twenty-six million twenty-three thousand five hundred and seventy yen (3,926,023,570).
(3) (2)にいう総額及びこの書簡の付表一及び二は、ガーナ共和国政府の関係当局及び銀行が行う最終的照 合の後に日本国政府及びガーナ共和国政府の関係当局間の合意により修正されることがある。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above and to the Lists 1 and 2 attached hereto by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Ghana, after the final verification to be made by the authorities concerned of the Government of the Republic of Ghana and the Bank.
３ 債務支払猶予の条件は、ガーナ共和国政府と銀行との間で締結される債務支払猶予契約であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the deferral will be stipulated in a deferral agreement to be concluded between the Government of the Republic of Ghana and the Bank which will contain, inter alia, the following principles:
(1) 支払猶予債務の総額は、二千二年四月一日に始まる十回の均等半年賦払によって支払われる。
(1) The total amount of the Deferred Debts will be paid in ten (10) equal semi-annual installments beginning on April 1, 2002.
(2) 支払猶予債務に対する利子率は、年一・八パーセントとし、二千二年二月一日から適用される。
(2) The rate of interest on the Deferred Debts will be one point eight per cent (1.8%) per annum and it will be applied from February 1, 2002.
４ ガーナの債務（この取極が対象とする債務を含む。)の再編に関してガーナ共和国政府の代表者及び関係債権諸国政府の代表者が新たな結論に到達した場合には、日本国政府とガーナ共和国政府は、この取極の継続又は修正について討議するための協議を行う。
4. If the representative of the Government of the Republic of Ghana and the representatives of the Governments of the creditor countries concerned come to a new conclusion in connection with reorganization of the Ghanaian debts including the debts covered by the present arrangements, the Government of Japan and the Government of the Republic of Ghana shall hold consultations in order to discuss the matter of continuation or modification of the present arrangements.
