（日本側書簡） （訳文） 書簡をもって啓上いたします。本使は、日本国の借款に関してこの書簡の付表に掲げる日に日本国政府と ベナン共和国政府との間で交換された書簡（以下「従前の書簡」という。)、重債務貧困国の政府開発援助債務の完全な免除に関する日本国、カナダ、フランス共和国、ドイツ連邦共和国、イタリア共和国、グレート ブリテン及び北アイルランド連合王国及びアメリカ合衆国の元首及び政府の長により千九百九十九年六月十 八日にケルンで発出された声明並びにベナン共和国が拡大重債務貧困国イニシアティブの下で包括的な債務 救済を受けるために必要な条件を満たしたことについて国際通貨基金及び国際開発協会により二千三年三月 二十日及び三月二十四日になされた承認に関し、次の了解を日本国政府に代わって提案する光栄を有しま す。
(Japanese Note) Cotonou, February 24, 2004 Excellency, With reference to the Notes exchanged between the Government of Japan and the Government of the Republic of Benin on the date enumerated in the List attached hereto concerning Japanese loans (hereinafter referred to as "the Previous Notes"), to the statement issued at Cologne on June 18, 1999 by the heads of State and Government of Japan, Canada, French Republic, Federal Republic of Germany, Republic of Italy, United Kingdom of Great Britain and Northern Ireland and United States of America regarding the full cancellation of official development assistance debt of the Heavily Indebted Poor Countries and to the approval given by the International Monetary Fund and the International Development Association on March 20 and March 24, 2003 that the Republic of Benin has met necessary conditions to receive comprehensive debt relief under the Enhanced Heavily Indebted Poor Countries Initiative, I have the honour to propose on behalf of the Government of Japan the following understanding:
１ 債務免除方式による債務救済措置が、国際協力銀行（以下「銀行」という。)により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of cancellation will be taken in accordance with the relevant laws and regulations of Japan by Japan Bank for International Cooperation (hereinafter referred to as "the Bank").
２（１） 免除される債務は、従前の書簡に従って締結された借款契約に基づく次の債務（以下「債務」とい う。)から成る。
2. (1) The debts to be cancelled consist of the following debts under the loan agreement concluded in accordance with the Previous Notes (hereinafter referred to as "the Debts"):
（a）二千三年三月一日現在で償還されていないすべての元本
(a) all the principal outstanding as of March 1, 2003; and
（b）二千三年三月一日以前に生じた未払のすべての利子（遅延利子を含む。)
(b) all the interest (including late interest) having accrued on or before March 1, 2003 and not paid.
(2) 債務の総額は、三十七億六千九百四十二万九百三十一円（三、七六九、四二〇、九三一円）になる。
(2) The total amount of the Debts will be three billion seven hundred sixty-nine million four hundred twenty thousand nine hundred and thirty-one yen (3,769,420,931).
(3) (2)にいう総額は、ベナン共和国政府及び銀行が行う最終的照合の後に、日本国政府及びベナン共和国 政府の権限のある当局間の相互の同意により修正されることがある。日本国政府の権限のある当局は、 外務省及び財務省であり、ベナン共和国政府の権限のある当局は、外務・アフリカ統合省及び財政・経 済省である。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above by mutual consent between the competent authorities of the Government of Japan and of the Government of the Republic of Benin, after the final verification to be made by the Government of the Republic of Benin and the Bank. The competent authorities of the Government of Japan will be the Ministry of Foreign Affairs and the Ministry of Finance, and the competent authorities of the Government of the Republic of Benin will be the Ministry of Foreign Affairs and African Integration and the Ministry of Finance and Economy.
３ 債務は、ベナン共和国政府に対して銀行が行う免除の通告により免除されることになる。二千三年三月二日から当該通告の日までの間（両期日を含む。)における債務に対する利子は、課されない。
3. The Debts will be cancelled by notification to that effect to be made by the Bank to the Government of the Republic of Benin. No interest will be charged on the Debts between March 2, 2003 and the date of such notification, both dates inclusive.
４ ベナン共和国政府は、債務が免除される事実を考慮し、政府間協議の結果に従って、ベナン共和国の貧 困を削減し並びに社会的及び経済的開発を促進するために必要な措置をとる。
4. The Government of the Republic of Benin shall, in accordance with the result of the consultations between the two Governments, take necessary measures to reduce poverty and promote social and economic development of the Republic of Benin, taking into account the fact that the Debts will be cancelled.
５ 両政府は、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議す る。
5. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present understanding.

I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Republic of Benin the foregoing understanding shall constitute an agreement between the two Governments, which shall enter into force on the date of Your Excellency's Note in reply.
