  　書簡をもって啓上いたします。本使は、赤外線天文衛星（ＡＳＴＲＯ－Ｆ）計画に係る日本国文部科学省（以下「文部科学省」という。)と欧州宇宙機関（以下「ＥＳＡ」という。)との間の協力（以下「協力」という。)を行うための条件に関し日本国政府の代表者とＥＳＡの代表者との間で行われた最近の討議に言及する光栄を有します。


							

						

						

							

								
Excellency,

	I have the honour to refer to recent discussions between the representatives of the Government of Japan and of the European Space Agency concerning the terms and conditions whereby cooperation on the Infrared Imaging Surveyor (ASTRO-F) Programme (hereinafter referred to as the "Cooperation") will be undertaken between the Ministry of Education, Culture, Sports, Science and Technology of Japan (hereinafter referred to as "MEXT") and the European Space Agency (hereinafter referred to as "ESA").


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　本使は、更に、宇宙空間の平和的な探査及び利用の分野において日本国政府とＥＳＡ（以下「両締約者」と総称する。)との間に引き続いて存在する相互に有益な関係を考慮し、日本国政府に代わって次の取極を提案する光栄を有します。


							

						

						

							

								
	In consideration of the continuing mutually beneficial relationship between the Government of Japan and ESA (hereinafter jointly referred to as "the Parties") in the field of peaceful exploration and use of outer space, I have further the honour to propose on behalf of the Government of Japan the following arrangements:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　協力は、一方において文部科学省により指定された実施機関である宇宙科学研究所（以下「宇宙研」という。)と他方においてＥＳＡとの間で実施される。


							

						

						

							

								
1.	The Cooperation will be executed by the Institute of Space and Astronautical Science (hereinafter referred to as "ISAS") as the executing agency designated by MEXT, on the one hand, and by ESA, on the other hand.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２　協力の詳細な条件を定めるため、宇宙研及びＥＳＡは実施取決めを締結することとし、当該実施取決めは、赤外線天文衛星を用いた観測活動及びこれにより収集されたデータの処理について定める。


							

						

						

							

								
2.	With a view to setting forth detailed terms and conditions for the Cooperation, ISAS and ESA will conclude an implementing arrangement, which will provide for the conduct of observations with ASTRO-F and processing of data thereby gathered.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３　協力は、日本国において及びＥＳＡについて適用可能な法令並びに利用可能な予算に従うことを条件とする。


							

						

						

							

								
3.	The Cooperation will be subject to the laws and regulations applicable in Japan and to ESA and to the availability of appropriated funds.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　宇宙研及びＥＳＡは、協力から又はそれに関連して生ずるいかなる問題についても相互に協議する。問題が当該協議を通じて解決できない場合には、両締約者の間の協議が行われる。問題が前記の協議を通じて解決できない場合には、両締約者は、合意された紛争解決手続、例えば調停、仲介又は仲裁に当該問題を付することができる。


							

						

						

							

								
4.	ISAS and ESA will consult with each other in respect of any matter that may arise from or in connection with the Cooperation.  If the matter cannot be resolved through such consultations, consultations will be held between the Parties.  If the matter cannot be resolved through such consultations mentioned above, the Parties may submit that issue to an agreed form of dispute settlement such as conciliation, mediation or arbitration.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　この取極は、一方の締約者が他方の締約者に対してこの取極を終了させる意思を六箇月前に書面で通告することにより終了させない限り、赤外線天文衛星計画の実施の最終結果である微光天体カタログの公表の完了を外交上の経路を通じて日本国政府とＥＳＡとで相互に確認する日まで効力を有する。


							

						

						

							

								
5.	The present arrangements will remain in force until the date the Government of Japan and ESA mutually confirm through diplomatic channels the release of the faint source catalogues which are the final results of the ASTRO-F Programme, unless terminated by either Party upon six months' written notice of its intention to terminate them.


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　本使は、更に、この書簡及び前記の取極をＥＳＡに代わって確認される閣下の返簡が日本国政府とＥＳＡとの間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。


							

						

						

							

								
	I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of ESA the foregoing arrangements shall be regarded as constituting an agreement between the Government of Japan and ESA, which will enter into force on the date of Your Excellency's reply.
