    書簡をもって啓上いたします。本長官は、静止気象衛星五号の支援を通じた西太平洋地域の気象衛星観測の維持に係るアメリカ合衆国政府と日本国政府との間の協力（以下「協力」という。)を行うための条件に関しアメリカ合衆国政府の代表者と日本国政府の代表者との間で行われた最近の討議に言及する光栄を有します。

							

						

						

							

								
Excellency,

	I have the honor to refer to the recent discussions between representatives of the Government of the United States of America and of the Government of Japan concerning the terms and conditions whereby cooperation to maintain meteorological satellite observation over the Western Pacific region through the back-up of Geostationary Meteorological Satellite-5 (hereinafter referred to as "the Cooperation") will be undertaken between the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　本長官は、更に、気象衛星観測の分野において両政府の間に引き続いて存在する相互に有益な関係を考慮し、アメリカ合衆国政府に代わって次の取極を提案する光栄を有します。

							

						

						

							

								
	In consideration of the continuing mutually beneficial relationship between the two Governments in the field of meteorological satellite observation, I have the further honor to propose on behalf of the Government of the United States of America the following arrangements:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　協力は、アメリカ合衆国政府については商務省海洋大気局（以下「ＮＯＡＡ」という。)と日本国政府については国土交通省気象庁（以下「気象庁」という。)との間で実施される。

							

						

						

							

								
1.	The Cooperation will be executed for the Government of the United States of America by the National Oceanic and Atmospheric Administration, U.S. Department of Commerce (hereinafter referred to as "NOAA") and for the Government of Japan by the Japan Meteorological Agency, Ministry of Land, Infrastructure and Transport (hereinafter referred to as "JMA").

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２　協力の詳細な条件を定めるため、ＮＯＡＡと気象庁との間において、ＮＯＡＡの静止運用環境衛星九号による気象庁の静止気象衛星五号の支援について定める実施取決め（以下「実施取決め」という。)が作成される。

							

						

						

							

								
2.	With a view to setting forth detailed terms and conditions for the Cooperation, NOAA and JMA will conclude implementing arrangements (hereinafter referred to as "the Implementing Arrangement"), which will provide for the back-up of JMA's Geostationary Meteorological Satellite-5 by NOAA's Geostationary Operational Environmental Satellite-9.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３　ＮＯＡＡ及び気象庁は、協力から又はそれに関連して生ずるいかなる問題についても協議を行う。問題が当該協議を通じて解決できない場合には、相互に受け入れることのできる解決を図るために外交上の経路を通じてアメリカ合衆国政府と日本国政府との間の協議が行われる。

							

						

						

							

								
3.	NOAA and JMA shall consult with each other regarding any matter that may arise from or in connection with the Cooperation.  If the matter cannot be resolved through such consultations, consultations between the Government of the United States of America and the Government of Japan shall be held through diplomatic channels with a view to finding a mutually acceptable solution.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　この取極及び実施取決めは、それぞれの国において施行されている法令に従って実施される。この取極及び実施取決めの下での活動は、利用可能な予算に従うことを条件とする。

							

						

						

							

								
4.	The provisions of the present arrangements and the Implementing Arrangement shall be implemented in accordance with the laws and regulations in force in each country.  Activities under the present arrangements and the Implementing Arrangement shall be subject to the availability of appropriated funds.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　この取極は、一方の政府が他方の政府に対してこの取極を終了させる意思を六箇月前に外交上の経路を通じて書面で通告することにより終了させない限り五年間効力を有する。この取極は、両政府間の相互の書面による合意により延長又は改正することができる。

							

						

						

							

								
5.	The present arrangements shall remain in force for a period of five years, unless terminated by either Government upon six months' written notice of its intention to terminate them through diplomatic channels.　  The present arrangements may be extended or amended by mutual written agreement of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　本長官は、更に、前記の取極が日本国政府にとって受諾し得るものであるときは、この書簡及び閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
