    書簡をもって啓上いたします。本大臣は、千九百八十九年三月八日に東京で署名された航空業務に関するトルコ共和国と日本国との間の協定（以下「協定」という。)の第十四条及び第十六条の規定に従って二千二年九月十日にアンカラで行われたトルコ共和国及び日本国の航空当局の間の協議に言及する光栄を有します。

Excellency,

	I have the honour to refer to the consultations held in Ankara on 10th September 2002 between the aeronautical authorities of the Republic of Turkey and of Japan, in accordance with Articles 14 and 16 of the Agreement between the Republic of Turkey and Japan for Air Services, signed at Tokyo on 8th March 1989 (hereinafter referred to as "the Agreement").



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    本大臣は、更に、前記の協議において到達した合意に基づき、及び協定第十六条３の規定に従い、別添の新たな付表が協定の現行の付表に代わることをトルコ共和国政府に代わって提案する光栄を有します。


							

						

						

							

								
	I have further the honour to propose, on behalf of the Government of the Republic of Turkey, that the new Schedule as set out in the Attachment shall replace the existing Schedule to the Agreement, based on the agreement reached at the said consultations and pursuant to paragraph 3 of Article 16 of the Agreement.



							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    本大臣は、更に、前記の提案が日本国政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

  １  日本国の一又は二以上の指定航空企業が両方向に運営する路線
    (a)  日本国内の地点－後に合意されるアジア内の一地点－中東内の一地点又はカラチ－イスタンブール－
      後に合意される以遠の二地点
    (b)  日本国内の地点－モスクワ－フランクフルト・アム・マイン（注１）－後に特定される一地点－イス
      タンブール及び（又は）後に特定されるトルコ内の一地点－後に特定される以遠の二地点（アメリカ合
      衆国内の地点を除く。)
    (c)　日本国内の地点－アルマティ（注２）－イスタンブール及び（又は）後に特定されるトルコ内の一地
      点
      注１　路線(b)において、日本国の一又は二以上の指定航空企業は、トルコ内の地点とフランクフルト・アム・マインとの間においては、自己が運送する途中降機の旅客を除き、第五の自由の運輸権を行使することができない。
      注２　路線(c)において、日本国の一又は二以上の指定航空企業は、トルコ内の地点とアルマティとの間においては、自己が運送する途中降機の旅客を含め、第五の自由の運輸権を行使することができない。
  ２  トルコ共和国の一又は二以上の指定航空企業が両方向に運営する路線
    (a)  トルコ内の地点－中東内の一地点又はカラチ－後に合意されるアジア内の一地点－東京－後に合意さ
      れる以遠の二地点
    (b)  トルコ内の地点－モスクワ－ソウル（注３、注４）－東京及び（又は）大阪
    (c)　トルコ内の地点－アルマティ（注５）－ソウル（注３、注４）－東京及び（又は）大阪
      注３　路線(b)及び(c)において、ソウルには、トルコ共和国の一又は二以上の指定航空企業がトルコ内の地点と東京との間で協定業務を運営するときは寄港してはならない。
      注４　路線(b)及び(c)において、トルコ共和国の一又は二以上の指定航空企業は、大阪とソウルとの間においては、自己が運送する途中降機の旅客を除き、第五の自由の運輸権を行使することができない。
      注５　路線(c)において、トルコ共和国の一又は二以上の指定航空企業は、東京及び（又は）大阪とアルマティとの間においては、自己が運送する途中降機の旅客を含め、第五の自由の運輸権を行使することができない。
  ３  いずれの締約国の一又は二以上の指定航空企業が提供する協定業務も、当該締約国の領域内の一地点をその起点としなければならないが、特定路線上の他の地点は、いずれかの又はすべての飛行に当たり当該指定航空企業の選択によって省略することができる。
  　　　　　


							

						

						

							

								
Attachment


SCHEDULE


1.	Routes to be operated in both directions by the designated airline or airlines of Japan:

(a)	Points in Japan - one point in Asia to be agreed upon later - one point in the Middle East or Karachi - Istanbul - two points beyond to be agreed upon later

(b)	Points in Japan - Moscow - Frankfurt-am-Main (Note 1) - one point to be specified later - Istanbul and/or one point in Turkey to be specified later - two points beyond, excluding points in the United States of America, to be specified later

(c)	Points in Japan - Almaty (Note 2) - Istanbul and/or one point in Turkey to be specified later

Note 1:	The designated airline or airlines of Japan may not exercise fifth freedom traffic rights with the exception of its or their own stopover passengers between points in Turkey and Frankfurt-am-Main on the Route (b).

Note 2:	The designated airline or airlines of Japan may not exercise fifth freedom traffic rights including its or their own stopover passengers between points in Turkey and Almaty on the Route (c).

2.	Routes to be operated in both directions by the designated airline or airlines of the Republic of Turkey:

(a)	Points in Turkey - one point in the Middle East or Karachi - one point in Asia to be agreed upon later - Tokyo - two points beyond to be agreed upon later

(b)	Points in Turkey - Moscow - Seoul (Note 3, Note 4) - Tokyo and/or Osaka

(c)	Points in Turkey - Almaty (Note 5) - Seoul (Note 3, Note 4) - Tokyo and/or Osaka


Note 3:	Seoul may not be served when the designated airline or airlines of the Republic of Turkey operate the agreed services between points in Turkey and Tokyo on the Routes (b) and (c).

Note 4:	The designated airline or airlines of the Republic of Turkey may not exercise fifth freedom traffic rights with the exception of its or their own stopover passengers between Osaka and Seoul on the Routes (b) and (c).

Note 5:	The designated airline or airlines of the Republic of Turkey may not exercise fifth freedom traffic rights including its or their own stopover passengers between Tokyo and/or Osaka and Almaty on the Route (c).

3.
