（日本側書簡） （訳文） 書簡をもって啓上いたします。本官は、日本国と東ティモール民主共和国との間の友好関係及び経済協力を強化することを目的として行われる日本国の資機材の贈与に関して日本国政府の代表者と東ティモール民主共和国政府の代表者との間で最近行われた討議に言及するとともに、次の取極を日本国政府に代わって提案する光栄を有します。
(Japanese Note) Dili, March 13, 2003 Excellency, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Democratic Republic of Timor-Leste concerning Japanese grant of materials and equipment made with a view to strengthening the friendly relations and economic cooperation between the two countries, and to propose on behalf of the Government of Japan the following arrangements:
１ 日本国政府は、東ティモール民主共和国の経済社会開発及び東ティモール民主共和国国民の福祉に寄与するため、日本国の関係法令に従い、東ティモール民主共和国政府に対し、東ティモール民主共和国における国際連合平和維持活動に従事している日本国の施設部隊の資機材であって、この書簡の付表に掲げるもの（以下「資機材」という。)を贈与する。
1. For the purpose of contributing to the economic and social development of the Democratic Republic of Timor-Leste, and to the well-being of the people of the Democratic Republic of Timor-Leste, the Government of Japan shall grant to the Government of the Democratic Republic of Timor-Leste, in accordance with the relevant laws and regulations of Japan, the materials and equipment of the Japanese Engineer Group engaged in the United Nations Peacekeeping Operation in the Democratic Republic of Timor-Leste, which are shown in the List attached hereto (hereinafter referred to as “the Materials and Equipment”).
２ 東ティモール民主共和国政府は、次のことのために必要な措置をとる。
2. The Government of the Democratic Republic of Timor-Leste shall take necessary measures:
(a) 資機材が適正にかつ専ら東ティモール民主共和国の経済社会開発及び東ティモール民主共和国国民の福祉を増進するために使用されるようにし、軍事目的に使用されないようにすること。
(a) to ensure that the Materials and Equipment are used properly and exclusively for the purpose of promoting the economic and social development of the Democratic Republic of Timor-Leste and the well-being of the people of the Democratic Republic of Timor-Leste, not for military purposes;
(b) 資機材の使用のために又はそれに関連して必要なすべての経費を負担すること。
(b) to bear all the expenses necessary for or in connection with the use of the Materials and Equipment;
(c) 要請に応じ、日本国政府に対し、資機材の使用に関する情報を提供すること。
(c) to furnish the Government of Japan, upon request, with information concerning the use of the Materials and Equipment; and
(d) 資機材が東ティモール民主共和国から再輸出されないようにすること。
(d) to ensure that the Materials and Equipment will not be re-exported from the Democratic Republic of Timor-Leste.
３ 両政府は、この取極から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
3. The two Governments shall consult with each other in respect of any matter that may arise from or in connection with the present arrangements.
本官は、更に、この書簡及び東ティモール民主共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that the present Note and Your Excellency’s Note in reply confirming on behalf of the Government of the Democratic Republic of Timor-Leste the foregoing arrangements shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the date of Your Excellency’s Note in reply.
