債務救済措置に関する日本国政府とモザンビーク共和国政府との間の二の交換公文

書簡をもって啓上いたします。本官は、千九百九十六年十一月二十日及び二十一日にパリで開催されたモザンビーク共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達し、千九百九十八年五月二十五日に当該代表者により修正された結論に基づき日本国政府の代表者とモザンビーク共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。
Excellency, I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Mozambique that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Mozambique and of the Governments of the creditor countries concerned held in Paris on November 20 and 21, 1996, and modified by such representatives on May 25, 1998.
本官は、更に、当該交渉において到達した次の了解を確認する光栄を有します。
I have further the honour to confirm the following understanding reached in the course of the said negotiations:
１ 債務繰延方式による債務救済措置が、日本国食糧庁（以下「庁」という。)により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will be taken in accordance with the relevant laws and regulations of Japan by the Food Agency of Japan (hereinafter referred to as "the Agency").
２(1) 繰り延べられる債務（以下「繰延債務」という。)の総額は、二十七億六千七百四十万六千六百二十一円（二、七六七、四〇六、六二一円）となる。繰延債務は、モザンビーク共和国政府が庁に対して負っている次の債務から成る。
2. (1) The total amount of the debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") will be two billion seven hundred sixty-seven million four hundred six thousand six hundred and twenty-one yen (2,767,406,621). The Rescheduled Debts consist of the following debts owed by the Government of the Republic of Mozambique to the Agency:
(a) 千九百九十六年十月三十一日以前に弁済期限の到来した未払の元本及び契約上の利子並びにそれらの遅延利子であって千九百九十六年十月三十一日以前に生じたもの（それらの内訳は、この書簡の付表一に掲げられる。)
(a) the principal and contractual interest having fallen due on or before October 31, 1996 and not paid and the late interest on such principal and contractual interest having accrued on or before October 31, 1996, the breakdown of which is shown in the List 1 attached hereto;
(b) 千九百九十六年十一月一日から千九百九十七年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の元本及び契約上の利子（それらの内訳は、この書簡の付表二に掲げられる。)
(b) the principal and contractual interest having fallen due between November 1, 1996 and June 30, 1997, both dates inclusive, and not paid, the breakdown of which is shown in the List 2 attached hereto;
(c) 千九百九十七年七月一日から千九百九十八年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の元本及び契約上の利子（それらの内訳は、この書簡の付表三に掲げられる。)
(c) the principal and contractual interest having fallen due between July 1, 1997 and June 30, 1998, both dates inclusive, and not paid, the breakdown of which is shown in the List 3 attached hereto; and
(d) 千九百九十八年七月一日から千九百九十九年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の元本及び契約上の利子（それらの内訳は、この書簡の付表四に掲げられる。)
(d) the principal and contractual interest having fallen due between July 1, 1998 and June 30, 1999, both dates inclusive, and not paid, the breakdown of which is shown in the List 4 attached hereto.
(2) (1)にいう総額並びにこの書簡の付表一、二、三及び四は、モザンビーク共和国政府の関係当局及び庁が行う最終的照合の後に日本国政府及びモザンビーク共和国政府の関係当局間の合意により修正されることがある。
(2) Modifications may be made to the total amount referred to in sub-paragraph (1) above and to the Lists 1, 2, 3 and 4 attached hereto by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Mozambique, after the final verification to be made by the authorities concerned of the Government of the Republic of Mozambique and the Agency.
３ 債務繰延べの条件は、モザンビーク共和国政府と庁との間で締結される債務繰延契約（以下「債務繰延契約」という。)であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in a rescheduling agreement to be concluded between the Government of the Republic of Mozambique and the Agency (hereinafter referred to as "the Rescheduling Agreement"), which will contain, inter alia, the following principles:
(1) 繰延債務の各々は、この書簡の附属書に掲げる支払計画に従って二千十四年五月三十一日に始まる四十八回の半年賦払によって支払われる。
(1) Each of the Rescheduled Debts will be paid in forty-eight (48) semi-annual installments beginning on May 31, 2014 in accordance with the payment schedule shown in the Annex attached hereto.
(2)(a) ２(1)(a)にいう債務に関し、千九百九十六年十月三十一日以前に弁済期限の到来した未払の元本及び契約上の利子に対する遅延利子であって、千九百九十六年十一月一日から債務繰延契約の締結の日の前日までの間（両期日を含む。)に生じたものの支払は、二千二年五月三十一日に行われる。当該遅延利子の率は、年九・八五五パーセントである。
(2) (a) With respect to the debts referred to in sub-paragraph (1)(a) of paragraph 2, the late interest, on the principal and contractual interest having fallen due on or before October 31, 1996 and not paid, having accrued between November 1, 1996 and the previous day of the date of conclusion of the Rescheduling Agreement, both dates inclusive, will be paid on May 31, 2002. The rate of such late interest will be nine point eight five five per cent (9.855%) per annum.
(b) ２(1)(a)にいう債務に関し、債務繰延契約の締結の日から適用される利子率は、年三パーセントとする。
(b) With respect to the debts referred to in sub-paragraph (1)(a) of paragraph 2, the rate of interest applied from the date of conclusion of the Rescheduling Agreement will be three per cent (3%) per annum.
(c) ２(1)(b)、(c)及び(d)にいう債務に関し、各々の当初の弁済期日の翌日から債務繰延契約の締結の日の前日までの間（両期日を含む。)に適用される利子率は、年九・八五五パーセントとし、また、債務繰延契約の締結の日から適用される利子率は、年三パーセントとする。
(c) With respect to the debts referred to in sub-paragraph (1)(b), (c) and (d) of paragraph 2, the rate of interest applied for the period between the next day of each original due date and the previous day of the date of conclusion of the Rescheduling Agreement, both dates inclusive, will be nine point eight five five per cent (9.855%) per annum and the rate of interest applied from the date of conclusion of the Rescheduling Agreement will be three per cent (3%) per annum.
(3) 最初の利子の支払は、二千二年五月三十一日に行われ、その後に引き続き行われる利子の支払は、毎年五月三十一日及び十一月三十日に行われる。
(3) The first payment of the interest will be made on May 31, 2002 and the consecutive payments of the interest after the first payment will be made on May 31 and November 30, each year.
(4) モザンビーク共和国政府は、(1)に定める支払計画（(3)に定める利子の支払計画を含む。)上の支払が遅延した場合には、未払額から生ずる遅延利子を、年四パーセントの率によって支払う。
(4) In case where any payment under the payment schedule set out in sub-paragraph (1) above, including the payment schedule of interest set out in sub-paragraph (3) above, is retarded, the Government of the Republic of Mozambique will pay the late interest accruing from the overdue amount at the rate of four per cent (4%) per annum.
(5) 支払われる利子については、モザンビーク共和国のすべての租税及び課徴金が免除される。
(5) The interest paid will be exempted from all taxes and duties of the Republic of Mozambique.
４ モザンビーク共和国政府は、関係債務の決済に伴って生ずる銀行手数料を支払う。
4. The Government of the Republic of Mozambique will pay bank charges incidental to the settlement of the debts concerned.
５ モザンビーク共和国政府は、いずれかの第三国の居住者であって債権を有するものに対し債務救済措置について３(1)にいう条件より有利な条件を与えた場合には、当該第三国の居住者であって債権を有するものに与えられる条件より不利でない条件を庁に直ちに与える。
5. If the Government of the Republic of Mozambique accords to creditors resident in any third country terms and conditions more favourable than those referred to in sub-paragraph (1) of paragraph 3 with regard to debt relief measures, the Government of the Republic of Mozambique will forthwith accord to the Agency the terms and conditions not less favourable than those accorded to creditors resident in such third country.
６ モザンビークの債務（この取極が対象とする債務を含む。)の再編に関してモザンビーク共和国政府の代表者及び関係債権諸国政府の代表者が新たな結論に到達した場合には、日本国政府とモザンビーク共和国政府との間でこの取極の継続又は修正について討議するために協議が行われる。
6. If the representative of the Government of the Republic of Mozambique and the representatives of the Governments of the creditor countries concerned come to a new conclusion in connection with reorganization of the Mozambican debts including the debts covered by the present arrangements, consultations will be held between the Government of Japan and the Government of the Republic of Mozambique, in order to discuss the matter of continuation or modification of the present arrangements.
本官は、閣下が前記の了解をモザンビーク共和国政府に代わって確認されれば幸いであります。

1. (1) The present arrangements will apply to the total amount of the following principal of, rescheduling interest on and late interest on the commercial debts with a repayment period of more than one year, contracted before February 1, 1984 between the Government and governmental corporations of the Republic of Mozambique on the one hand and the creditors concerned resident in Japan (hereinafter referred to as "the Creditors") on the other and insured by the Government of Japan (hereinafter referred to as "the Rescheduled Commercial Debts"):
(a) 千九百八十五年六月二十六日に日本国政府とモザンビーク共和国政府との間で交換された書簡（以下「従前の書簡Ⅰ」という。)により行われた取極に従って繰り延べられた商業上の債務に関し、
(a) With respect to the commercial debts rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Mozambique on June 26, 1985 (hereinafter referred to as "the Previous Notes I");
(i) 千九百九十六年十月三十一日以前に弁済期限の到来した未払の元本及び繰延利子
(i) the principal and rescheduling interest having fallen due on or before October 31, 1996 and not paid; and
(ii) (i)にいう債務に対する未払の遅延利子であって、千九百九十六年十月三十一日以前に生じたもの
(ii) the late interest on the debts referred to in (i) above, having accrued on or before October 31, 1996 and not paid.
(b) 千九百八十九年七月十九日に日本国政府とモザンビーク共和国政府との間で交換された書簡（以下「従前の書簡Ⅱ」という。)により行われた取極に従って繰り延べられた商業上の債務に関し、
(b) With respect to the commercial debts rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Mozambique on July 19, 1989 (hereinafter referred to as "the Previous Notes II");
(i) 千九百九十六年十月三十一日以前に弁済期限の到来した未払の繰延利子
(i) the rescheduling interest having fallen due on or before October 31, 1996 and not paid;
(ii) (i)にいう債務に対する未払の遅延利子であって、千九百九十六年十月三十一日以前に生じたもの
(ii) the late interest on the debts referred to in (i) above, having accrued on or before October 31, 1996 and not paid;
(iii) 千九百九十六年十一月一日から千九百九十七年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の元本及び繰延利子
(iii) the principal and rescheduling interest having fallen due between November 1, 1996 and June 30, 1997, both dates inclusive, and not paid;
(iv) 千九百九十七年七月一日から千九百九十八年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の元本及び繰延利子
(iv) the principal and rescheduling interest having fallen due between July 1, 1997 and June 30, 1998, both dates inclusive, and not paid; and
(v) 千九百九十八年七月一日から千九百九十九年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の元本及び繰延利子
(v) the principal and rescheduling interest having fallen due between July 1, 1998 and June 30, 1999, both dates inclusive, and not paid.
(c) 千九百九十一年九月十三日に日本国政府とモザンビーク共和国政府との間で交換された書簡（以下「従前の書簡Ⅲ」という。)により行われた取極に従って繰り延べられた商業上の債務に関し、
(c) With respect to the commercial debts rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Mozambique on September 13, 1991 (hereinafter referred to as "the Previous Notes III");
(i) 千九百九十六年十月三十一日以前に弁済期限の到来した未払の繰延利子
(i) the rescheduling interest having fallen due on or before October 31, 1996 and not paid;
(ii) (i)にいう債務に対する未払の遅延利子であって、千九百九十六年十月三十一日以前に生じたもの
(ii) the late interest on the debts referred to in (i) above, having accrued on or before October 31, 1996 and not paid;
(iii) 千九百九十六年十一月一日から千九百九十七年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の繰延利子
(iii) the rescheduling interest having fallen due between November 1, 1996 and June 30, 1997, both dates inclusive, and not paid;
(iv) 千九百九十七年七月一日から千九百九十八年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の繰延利子
(iv) the rescheduling interest having fallen due between July 1, 1997 and June 30, 1998, both dates inclusive, and not paid; and
(v) 千九百九十八年七月一日から千九百九十九年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の繰延利子
(v) the rescheduling interest having fallen due between July 1, 1998 and June 30, 1999, both dates inclusive, and not paid.
(d) 千九百九十五年五月三十日に日本国政府とモザンビーク共和国政府との間で交換された書簡（以下「従前の書簡Ⅳ」という。)１(1)(a)及び(b)の規定により行われた取極に従って繰り延べられた商業上の債務に関し、
(d) With respect to the commercial debts escheduled pursuant to the arrangements made by the provisions of (a) and (b) of sub-paragraph (1) of paragraph 1 of the Notes exchanged between the Government of Japan and the Government of the Republic of Mozambique on May 30, 1995 (hereinafter referred to as "the Previous Notes IV");
千九百九十八年七月一日から千九百九十九年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の元本及び繰延利子
the principal and rescheduling interest having fallen due between July 1, 1998 and June 30, 1999, both dates inclusive, and not paid.
(e) 従前の書簡Ⅳ１(1)(c)の規定により行われた取極に従って繰り延べられた商業上の債務に関し、
(e) With respect to the commercial debts rescheduled pursuant to the arrangements made by the provisions of (c) of sub-paragraph (1) of paragraph 1 of the Previous Notes IV;
千九百九十八年七月一日から千九百九十九年六月三十日までの間（両期日を含む。)に弁済期限の到来した未払の繰延利子
the rescheduling interest having fallen due between July 1, 1998 and June 30, 1999, both dates inclusive, and not paid.
(2)(a) (1)(a)(i)にいう債務の総額は、二億千五百四万六千九百六十八円（二一五、〇四六、九六八円）となる。
(2) (a) The total amount of the debts referred to in (a)(i) of sub-paragraph (1) above is estimated at two hundred fifteen million forty-six thousand nine hundred and sixty-eight yen (215,046,968).
(b) (1)(a)(ii)にいう遅延利子の総額は、この書簡の附属書Ⅰに掲げる算定方法に従って算出される。
(b) The total amount of the late interest referred to in (a)(ii) of sub-paragraph (1) above is calculated in accordance with the method of calculation shown in Annex I attached hereto.
(c) (1)(b)(i)にいう債務の総額は、一億三千五百五十七万七千九百五十円（一三五、五七七、九五〇円）となる。
(c) The total amount of the debts referred to in (b)(i) of sub-paragraph (1) above is estimated at one hundred thirty-five million five hundred seventy-seven thousand nine hundred and fifty yen (135,577,950).
(d) (1)(b)(ii)にいう遅延利子の総額は、この書簡の附属書Ⅰに掲げる算定方法に従って算出される。
(d) The total amount of the late interest referred to in (b)(ii) of sub-paragraph (1) above is calculated in accordance with the method of calculation shown in Annex I attached hereto.
(e) (1)(b)(iii)にいう債務の総額は、一億千七十八万四千百六十九円（一一〇、七八四、一六九円）となる。
(e) The total amount of the debts referred to in (b)(iii) of sub-paragraph (1) above is estimated at one hundred ten million seven hundred eighty-four thousand one hundred and sixty-nine yen (110,784,169).
(f) (1)(b)(iv)にいう債務の総額は、一億七千二百二十三万二千六百四十四円（一七二、二三二、六四四円）となる。
(f) The total amount of the debts referred to in (b)(iv) of sub-paragraph (1) above is estimated at one hundred seventy-two million two hundred thirty-two thousand six hundred and forty-four yen (172,232,644).
(g) (1)(b)(v)にいう債務の総額は、二億五千五百七十二万四千八百五十円（二五五、七二四、八五〇円）となる。

(3) Modifications may be made to the total amounts referred to in sub-paragraph (2) above by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Mozambique, after the final verification to be made by the authorities concerned of the two Governments.
２(1) モザンビーク共和国政府は、モザンビーク銀行を通じて、繰延商業債務を決済するため(4)に定める支払計画（以下「支払計画」という。)に従って行われる支払の額及び日付を日本国政府に通告する。
2. (1) The Government of the Republic of Mozambique will notify the Government of Japan, through the Bank of Mozambique, of the amount and dates of payments which will be made in order to settle the Rescheduled Commercial Debts in accordance with the payment scheme as set out in sub-paragraph (4) below (hereinafter referred to as "the Payment Scheme").
(2) モザンビーク共和国政府は、繰延商業債務の総額を支払計画に従いモザンビーク銀行を通じ関係契約において指定された通貨により債権者に支払う。
(2) The Government of the Republic of Mozambique will pay the total amount of the Rescheduled Commercial Debts to the Creditors in the currency designated in the contracts concerned through the Bank of Mozambique in accordance with the Payment Scheme.
(3) 日本国政府は、商業上の関係債務が支払計画に従って行われる支払により決済されることを容易にするため、日本国において施行されている関係法令の範囲内で可能な措置をとる。
(3) The Government of Japan will take possible measures, within the scope of the relevant laws and regulations in force in Japan, to facilitate the settlement of the commercial debts concerned by the payment to be made in accordance with the Payment Scheme.
(4)(a) １(1)(a)(i)、(a)(ii)、(b)(i)、(b)(ii)、(b)(iii)、(c)(i)、(c)(ii)及び(c)(iii)にいう債務の各々は、この書簡の附属書Ⅱに掲げる支払計画に従って二千二年五月三十一日に始まる五十八回の半年賦払によって支払われる。
(4) (a) Each of the debts referred to in (a)(i), (a)(ii), (b)(i), (b)(ii), (b)(iii), (c)(i), (c)(ii) and (c)(iii) of sub-paragraph (1) of paragraph 1 will be paid in fifty-eight (58) semi-annual installments beginning on May 31, 2002 in accordance with the payment schedule shown in Annex II attached hereto.
(b) １(1)(b)(iv)、(b)(v)、(c)(iv)、(c)(v)、(d)及び(e)にいう債務の各々は、この書簡の附属書Ⅲに掲げる支払計画に従って二千六年五月三十一日に始まる六十四回の半年賦払によって支払われる。
(b) Each of the debts referred to in (b)(iv), (b)(v), (c)(iv), (c)(v), (d) and (e) of sub-paragraph (1) of paragraph 1 will be paid in sixty-four (64) semi-annual installments beginning on May 31, 2006 in accordance with the payment schedule shown in Annex III attached hereto.
３(1) モザンビーク共和国政府は、商業上の関係債務の各々について、当該債務が決済されていない限り、(3)に定めるところにより算定される利子を債権者に支払う。
3. (1) The Government of the Republic of Mozambique will pay to the Creditors, interest to be calculated as described in sub-paragraph (3) below on each of the commercial debts concerned to the extent that they have not been settled, in accordance with the following schedule:
(a) 最初の利子の支払は、二千二年五月三十一日に行われる。
(a) the first payment of the interest will be made on May 31, 2002, and
(b) 最初の支払の後に引き続き行われる利子の支払は、毎年五月三十一日及び十一月三十日に行われる。
(b) the consecutive payments of interest after the first payment will be made on May 31 and November 30, each year.
(2)(a) １(1)(a)にいう債務に対して、千九百九十六年十一月一日からこの書簡の交換の日の前日までの間（両期日を含む。)に適用される利子率は、年八・二パーセントとする。
(2) (a) The rate of interest on the debts referred to in (a) of sub-paragraph (1) of paragraph 1, applied for the period between November 1, 1996 and the previous day of the date of exchange of the present Notes, both dates inclusive, will be eight point two per cent (8.2%) per annum.
(b) １(1)(a)にいう債務に対して、この書簡の交換の日から適用される利子率は、年一・五〇六八パーセントとする。
(b) The rate of interest on the debts referred to in (a) of sub-paragraph (1) of paragraph 1, applied from the date of exchange of the present Notes will be one point five zero six eight per cent (1.5068%) per annum.
(c) １(1)(b)(i)及び(ii)にいう債務に対して、千九百九十六年十一月一日からこの書簡の交換の日の前日までの間（両期日を含む。)に適用される利子率は、年六・六パーセントとする。
(c) The rate of interest on the debts referred to in (b)(i) and (ii) of sub-paragraph (1) of paragraph 1, applied for the period between November 1, 1996 and the previous day of the date of exchange of the present Notes, both dates inclusive, will be six point six per cent (6.6%) per annum.
(d) １(1)(b)(i)及び(ii)にいう債務に対して、この書簡の交換の日から適用される利子率は、年一・五〇六八パーセントとする。
(d) The rate of interest on the debts referred to in (b)(i) and (ii) of sub-paragraph (1) of paragraph 1, applied from the date of exchange of the present Notes will be one point five zero six eight per cent (1.5068%) per annum.
(e) １(1)(b)(iii)、(iv)及び(v)にいう債務に対して、各々の当初の弁済期日からこの書簡の交換の日の前日までの間（両期日を含む。)に適用される利子率は、年六・六パーセントとする。
(e) The rate of interest on the debts referred to in (b)(iii), (iv) and (v) of sub-paragraph (1) of paragraph 1, applied for the period between each original due date and the previous day of the date of exchange of the present Notes, both dates inclusive, will be six point six per cent (6.6%) per annum.
(f) １(1)(b)(iii)にいう債務に対して、この書簡の交換の日から適用される利子率は、年一・五〇六八パーセントとする。
(f) The rate of interest on the debts referred to in (b)(iii) of sub-paragraph (1) of paragraph 1, applied from the date of exchange of the present Notes will be one point five zero six eight per cent (1.5068%) per annum.
(g) １(1)(b)(iv)及び(v)にいう債務に対して、この書簡の交換の日から適用される利子率は、年一・一一一九パーセントとする。

(h) １(1)(c)(i)及び(ii)にいう債務に対して、千九百九十六年十一月一日からこの書簡の交換の日の前日までの間（両期日を含む。)に適用される利子率は、年五・〇パーセントとする。
(h) The rate of interest on the debts referred to in (c)(i) and (ii) of sub-paragraph (1) of paragraph 1, applied for the period between November 1, 1996 and the previous day of the date of exchange of the present Notes, both dates inclusive, will be five point zero per cent (5.0%) per annum.
(i) １(1)(c)(i)及び(ii)にいう債務に対して、この書簡の交換の日から適用される利子率は、年三・一二六パーセントとする。
(i) The rate of interest on the debts referred to in (c)(i) and (ii) of sub-paragraph (1) of paragraph 1, applied from the date of exchange of the present Notes will be three point one two six per cent (3.126%) per annum.

(k) １(1)(c)(iii)にいう債務に対して、この書簡の交換の日から適用される利子率は、年三・一二六パーセントとする。

(l) １(1)(c)(iv)、(v)及び(e)にいう債務に対して、この書簡の交換の日から適用される利子率は、年一・九七二九パーセントとする。
(l) The rate of interest on the debts referred to in (c)(iv), (v) and (e) of sub-paragraph (1) of paragraph 1, applied from the date of exchange of the present Notes will be one point nine seven two nine per cent (1.9729%) per annum.
(m) １(1)(d)にいう債務に対して、各々の当初の弁済期日からこの書簡の交換の日の前日までの間（両期日を含む。)に適用される利子率は、年九・八パーセントとする。
(m) The rate of interest on the debts referred to in (d) of sub-paragraph (1) of paragraph 1, applied for the period between each original due date and the previous day of the date of exchange of the present Notes, both dates inclusive, will be nine point eight per cent (9.8%) per annum.
(n) １(1)(d)にいう債務に対して、この書簡の交換の日から適用される利子率は、年二・八三三九パーセントとする。
(n) The rate of interest on the debts referred to in (d) of sub-paragraph (1) of paragraph 1, applied from the date of exchange of the present Notes will be two point eight three three nine per cent (2.8339%) per annum.
(3) 支払われる利子の額は、未決済の債務の額に当該債務が決済されないままに経過した日数及び一日当たりの利子率を乗じて算定される。一日当たりの利子率は、(2)にいう利子率を三百六十五で除して算定される。前記の算定方法を算式で表したものが、この書簡の附属書Ⅳに掲げられる。
(3) The amount of interest to be paid will be calculated by multiplying the amount of the debt unsettled by the product of the number of the days the debt has not been settled and the daily interest rate. The daily interest rate is calculated by dividing the rate of interest referred to in sub-paragraph (2) above by three hundred and sixty-five (365). The illustration in the form of numerical formula of the method of calculation mentioned above is shown in Annex IV attached hereto.
(4) (1)の規定にかかわらず、(3)の規定に従ってこの書簡の交換の日より生ずるモザンビーク共和国政府により本来支払われるべき利子から、四千八百九十四万七千三百四十七円（四八、九四七、三四七円）が差し引かれる。
(4) Notwithstanding the provisions of sub-paragraph (1) above, forty-eight million nine hundred forty-seven thousand three hundred and forty-seven yen (48,947,347) will be deducted from the interest which will accrue from the date of exchange of the present Notes in accordance with the provisions of sub-paragraph (3) above and is otherwise to be paid by the Government of the Republic of Mozambique.
(5) モザンビーク共和国政府は、(1)に定める利子の支払計画上の支払が遅延した場合には、未払額から生ずる遅延利子を次の率によって支払う。
(5) In case where any payment under the Payment Scheme, including the payment schedule of interest set out in sub-paragraph (1) above, is retarded, the Government of the Republic of Mozambique will pay the late interest accruing from the overdue amount, in accordance with the following rate:
(a) １(1)(a)(i)、(a)(ii)、(b)(i)、(b)(ii)、(b)(iii)、(c)(i)、(c)(ii)及び(c)(iii)にいう債務に対して適用される利子率は、年八・六五パーセントとする。
(a) The rate of interest on the debts referred to in (a)(i), (a)(ii), (b)(i), (b)(ii), (b)(iii), (c)(i), (c)(ii) and (c)(iii) of sub-paragraph (1) of paragraph 1 will be eight point six five per cent (8.65%) per annum.
(b) １(1)(b)(iv)、(b)(v)、(c)(iv)、(c)(v)、(d)及び(e)にいう債務に対して適用される利子率は、年九・〇パーセントとする。
(b) The rate of interest on the debts referred to in (b)(iv), (b)(v), (c)(iv), (c)(v), (d) and (e) of sub-paragraph (1) of paragraph 1 will be nine point zero per cent (9.0%) per annum.
(6) 支払われる利子については、モザンビーク共和国のすべての租税及び課徴金が免除される。
(6) The interest paid will be exempted from all taxes and duties of the Republic of Mozambique.
４ モザンビーク共和国政府は、商業上の関係債務の決済に伴って生ずる銀行手数料を支払う。
4. The Government of the Republic of Mozambique will pay bank charges incidental to the settlement of the commercial debts concerned.
５ 関係契約の条件のうちこの書簡において特に言及されていないものは、関係契約の当事者間で別段の合意がある場合を除くほか、引き続き適用されることが確認される。
5. It is confirmed that the terms and conditions of the contracts concerned not specifically referred to in this Note will remain applicable, unless otherwise agreed upon by the parties to the contracts concerned.
６ モザンビーク共和国政府は、いずれかの第三国の居住者であって債権を有するものに対し債務救済措置について２(4)にいう条件より有利な条件を与えた場合には、当該第三国の居住者であって債権を有するものに与えられる条件より不利でない条件を債権者に直ちに与える。
6. If the Government of the Republic of Mozambique accords to creditors resident in any third country terms and conditions more favourable than those referred to in sub-paragraph (4) of paragraph 2 with regard to debt relief measures, the Government of the Republic of Mozambique will forthwith accord to the Creditors the terms and conditions not less favourable than those accorded to creditors resident in such third country.
７ モザンビークの債務（この取極が対象とする債務を含む。)の再編に関してモザンビーク共和国政府の代表者及び関係債権諸国政府の代表者が新たな結論に到達した場合には、日本国政府とモザンビーク共和国政府との間でこの取極の継続又は修正について討議するために協議が行われる。
7. If the representative of the Government of the Republic of Mozambique and the representatives of the Governments of the creditor countries concerned come to a new conclusion in connection with reorganization of the Mozambican debts including the debts covered by the present arrangements, consultations will be held between the Government of Japan and the Government of the Republic of Mozambique, in order to discuss the matter of continuation or modification of the present arrangements.

利子の額の算定方法の算式

Ａ：未決済の債務の額
A : The amount of the debt unsettled
Ｄ：債務が決済されないままに経過した日数
D : The number of the days the debt has not been settled
Ｒ：年間の利子率
R : The rate of interest (per annum)

(1) １(1)(a)(i)、(a)(ii)、(b)(i)、(b)(ii)、(c)(i)及び(c)(ii)にいう債務についての二千二年五月三十一日における最初の利子の支払に関しては、Ｄは、千九百九十六年十一月一日から二千二年五月三十日までの間（両期日を含む。)の日数に等しい。
(1) With respect to the first payment of the interest on May 31, 2002 for the debts referred to in (a)(i), (a)(ii), (b)(i), (b)(ii), (c)(i) and (c)(ii) of sub-paragraph (1) of paragraph 1, D is equal to the number of the days from November 1, 1996 to May 30, 2002 both dates inclusive.
(2) １(1)(b)(iii)、(b)(iv)、(b)(v)、(c)(iii)、(c)(iv)、(c)(v)、(d)及び(e)にいう債務についての二千二年五月三十一日における最初の利子の支払に関しては、Ｄは、従前の書簡Ⅱ、Ⅲ及びⅣに掲げる各々の当初の弁済期日から二千二年五月三十日までの間（両期日を含む。)の日数に等しい。
(2) With respect to the first payment of the interest on May 31, 2002 for the debts referred to in (b)(iii), (b)(iv), (b)(v), (c)(iii), (c)(iv), (c)(v), (d) and (e) of sub-paragraph (1) of paragraph 1, D is equal to the number of the days from each original due date in the Previous Notes II, III and IV to May 30, 2002 both dates inclusive.
(3) 最初の支払の後に引き続き行われる利子の支払に関しては、Ｄは、当該支払に先立つ支払の日から当該支払の前日までの間（両期日を含む。)の日数に等しい。
(3) With respect to the consecutive payments of the interest after the first payment, D is equal to the number of the days from the day of the previous payment to the previous day of the payment, both dates inclusive.
