（日本側書簡） 書簡をもって啓上いたします。本使は、関連の国際連合安全保障理事会決議に基づく日本国の自衛隊員その他の日本国政府の職員のクウェート国への派遣に関して日本国政府の代表者とクウェート国政府の代表者との間で最近行われた討議に言及する光栄を有します。
(Japanese Note) Kuwait, December 22, 2003 Excellency, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the State of Kuwait concerning the dispatch of the personnel of the Self-Defense Forces of Japan and other personnel of the Government of Japan to the State of Kuwait in accordance with relevant United Nations Security Council Resolutions.
日本国の自衛隊員その他の日本国政府の職員のクウェート国の領域への派遣に対するクウェート国政府の同意及び両政府間の緊密で長年にわたる関係に考慮を払いつつ、次の取極を日本国政府に代わって提案する光栄を有します。
Having regard to the consent of the Government of the State of Kuwait to the dispatch of the personnel of the Self-Defense Forces of Japan and other personnel of the Government of Japan to the territory of the State of Kuwait, and to the close and longstanding ties between our two Governments, I have the honour to propose on behalf of the Government of Japan the following arrangements:
１(a) 「部隊隊員」とは、日本国の防衛庁の自衛官以外の者を含む日本国の自衛隊員であって、この取極に関連してクウェート国に派遣され、かつ、クウェート国政府の同意を得てクウェート国に適法にあるものをいう。
1. (a) The "Personnel of the Forces" means the personnel of the Self-Defense Forces of Japan, including civilian persons of the Japan Defense Agency who is sent to the State of Kuwait in connection with the present arrangements and, with the consent of the Government of the State of Kuwait, is lawfully present in the State of Kuwait.
(b) 「支援職員」とは、日本国の内閣府の職員であって、この取極に関連してクウェート国に派遣され、かつ、クウェート国政府の同意を得てクウェート国に適法にあるものをいう。
(b) The "Support Personnel" means the personnel of the Cabinet Office of Japan who is sent to the State of Kuwait in connection with the present arrangements and, with the consent of the Government of the State of Kuwait, is lawfully present in the State of Kuwait.
２(a) 両政府は、この取極をそれぞれの国の法令に従って実施する。両政府は、この取極を実施することがそれぞれの国の法令に反しないこととなることを確認する。
2. (a) Both Governments shall implement the present arrangements in accordance with respective laws and regulations of each country. Both Governments confirm that the implementation of the present arrangements is consistent with the laws and regulations of each country.
(b) 部隊隊員及び支援職員は、３の規定に基づく特権及び免除を害されることなく、クウェート国の法令、慣習及び伝統を尊重するものとし、クウェート国の国内問題に介入しない義務を有する。
(b) Without prejudice to the privileges and immunities under paragraph 3, the Personnel of the Forces and the Support Personnel shall respect the laws, regulations, customs and traditions of the State of Kuwait, and shall have a duty not to interfere in the internal affairs of the State of Kuwait.
３ 部隊隊員及び支援職員は、クウェート国の領域において、千九百六十一年四月十八日の外交関係に関するウィーン条約に基づいて事務及び技術職員に与えられる特権及び免除をクウェート国により与えられる。
3. The Personnel of the Forces and the Support Personnel shall be granted by the State of Kuwait on its territory such privileges and immunities as those accorded to the administrative and technical staff in accordance with the Vienna Convention on Diplomatic Relations of 18 April 1961.
４ 日本国政府により雇用される契約者、企業の職員及びクウェート人は、民事及び刑事に関してクウェート国の司法当局の管轄に服する。
4. Contractors, personnel of companies and Kuwaitis employed by the Government of Japan are subject to the judicial authority of the State of Kuwait regarding civil and penal matters.
５(a) いずれか一方の政府の職員又はいずれか一方の政府が所有する財産がクウェート国の領域において傷害（死亡をもたらした傷害を含む。)を受け、又は損害若しくは損失を被り、かつ、これらの傷害、損害又は損失が他方の政府の職員のこの取極に関連する公務の遂行中の作為又は不作為から生じた場合は、当該他方の政府は、当該一方の政府に対して公正かつ合理的な賠償を行う。部隊隊員又は支援職員によるこの取極に関連する公務の遂行中のものではない作為又は不作為であって、傷害、損害又は損失を生じさせたものに起因する請求権をクウェート国が有する場合は、日本国政府は、相互主義に基づき、クウェート国が当該請求権に関して得られた判決の履行を確保することを支援するよう努める。日本国政府は、日本国の自衛隊の使用に供されたクウェート国の備品及び建築物を当該備品及び建築物が引き渡された時の状態と同じ状態で返還するか、又は日本国の自衛隊による当該備品及び建築物の不適正な使用から生じた損害若しくは損失を賠償する。
5. (a) If personnel of or property owned by either Government suffers injury (including injury resulting in death), damage or loss within the territory of the State of Kuwait and that such injury, damage or loss was caused by acts or omissions of any personnel of the other Government in the performance of official duties in connection with the present arrangements, the latter Government shall pay just and reasonable compensation to the former Government. The Government of Japan shall endeavour, on a reciprocal basis, to assist the State of Kuwait, if the State of Kuwait has claims resulting from acts or omissions by any Personnel of the Forces or any Support Personnel causing injury, damage or loss other than in the performance of official duties in connection with the present arrangements, in obtaining satisfaction of any judgement obtained in respect of any such claims. The Government of Japan shall submit the equipment and constructions of Kuwait which were under the disposal of the Self-Defense Forces of Japan in the same condition at the time of delivery or compensate against any damage or loss resulting of the misuse of them by the Self-Defense Forces of Japan.
(b) クウェート国政府は、部隊隊員又は支援職員によるこの取極に関連する公務の遂行中の作為又は不作為であって、傷害、死亡、損失又は損害を生じさせたものにつき又はこれらに関連してクウェート国の領域において生ずる第三者の請求権を自国の法令に従って処理し、解決する。日本国政府は、そのような請求権に関し、クウェート国政府に対して公正かつ合理的な賠償を行う。
(b) The Government of the State of Kuwait shall deal with and settle, in accordance with its laws, any claims by third parties arising within its own territory for or in connection with any act or omission by any Personnel of the Forces or any Support Personnel in the performance of official duties in connection with the present arrangements which results in injury, death, loss or damage. The Government of Japan will pay just and reasonable compensation to the Government of Kuwait in respect of any such claims.
(c) 日本国政府は、相互主義に基づき、部隊隊員又は支援職員によるこの取極に関連する公務の遂行中のものではない作為又は不作為であって、傷害、死亡、損失又は損害を生じさせたものに起因する請求権を有する第三者が、当該請求権に関して得られた判決の履行を確保することを支援するよう努める。
(c) The Government of Japan shall endeavour, on a reciprocal basis , to assist third parties who have claims resulting from any act or omission of any Personnel of the Forces or any Support Personnel causing injury, death, loss or damage other than in the performance of official duties in connection with the present arrangements in obtaining satisfaction of any judgement obtained in respect of any such claims.
６ 部隊隊員及び支援職員は、日本国政府の身分証明書によってクウェート国へ入国し、又はクウェート国から出国することができる。クウェート国政府の権限のある当局は、クウェート国において、部隊隊員及び支援職員に対しクウェート国の身分証明書を発行する。部隊隊員及び支援職員は、クウェート国政府の権限のある当局から求められた場合には、クウェート国の身分証明書を提示する。
6. The Personnel of the Forces and the Support Personnel may enter and exit the State of Kuwait with identification cards of the Government of Japan. In the State of Kuwait, Kuwaiti identification cards shall be issued to the Personnel of the Forces and the Support Personnel by the competent authorities of the Government of the State of Kuwait. The Personnel of the Forces and the Support Personnel shall produce the Kuwaiti identification cards to the competent authorities of the Government of the State of Kuwait when required.
７ 部隊隊員及び支援職員により使用される車両、船舶及び航空機は、クウェート国の法令に基づく免許又は登録には服さない。部隊隊員及び支援職員は、手数料、使用料その他の料金を支払うことなく、飛行場の施設を使用することができる。部隊隊員及び支援職員は、有効な日本国の運転免許及びクウェート国の身分証明書によって車両を運転することができる。
7. Vehicles, vessels and aircraft used by the Personnel of the Forces and the Support Personnel shall not be subject to licensing or registration under the laws and regulations of the State of Kuwait. The Personnel of the Forces and the Support Personnel may use airfield facilities without payment of dues, tolls or other charges. The Personnel of the Forces and the Support Personnel may operate vehicles with valid Japanese driving licenses and Kuwaiti identification cards.
８ 部隊隊員及び支援職員は、クウェート国において、租税の免除を受けて、備品その他需品、役務及び設備を購入することができる。部隊隊員及び支援職員は、許可その他の制限なく、また、関税及び租税の免除を受けて、その活動のために必要な備品その他需品及び個人的に消費又は使用する身回品をクウェート国へ輸入することができる。この８の規定に基づき関税及び租税の免除を受けて輸入された備品その他需品であって、関税及び租税の免除を受けて備品その他需品を輸入する権利を有しない者に対してクウェート国において売却されたものについては、その売却時の価額に基づき関税及び租税が課される。
8. The Personnel of the Forces and the Support Personnel may purchase equipment and other supplies, services and utilities in the State of Kuwait free of taxes. The Personnel of the Forces and the Support Personnel may import into the State of Kuwait without licence or other restriction and free of customs duties and taxes, equipment and other supplies required by them for the purpose of their operations together with their personal effects and items for their personal consumption or use. Any equipment and other supplies imported free of customs duties and taxes under this paragraph which are sold in the State of Kuwait to persons other than those entitled to import of equipment and other supplies free of customs duties and taxes will be subject to customs duties and taxes on its value at the time of sale.
９ 自衛官である部隊隊員は、日本国の自衛隊の制服を着用することができる。自衛官である部隊隊員は、公務の遂行中に命令に基づきその使用が許可されることのある武器を所持し、又は携行することができ
る。
9. The military Personnel of the Forces may wear the uniforms of the Self-Defense Forces of Japan. The military Personnel of the Forces may possess and carry arms to be used in the performance of official duties when authorised to do so by their orders during their official duties.
10 クウェート国政府は、いつでも、部隊隊員及び支援職員のクウェート国からの撤退を要請することができる。日本国政府は、クウェート国政府に通告した後に、いつでも、部隊隊員及び支援職員を撤退させる権利を留保する。
10. The Government of the State of Kuwait may at any time request the withdrawal of the Personnel of the Forces and the Support Personnel from the State of Kuwait. The Government of Japan reserves the right to withdraw the Personnel of the Forces and the Support Personnel at any time after so notifying the Government of the State of Kuwait.
11 この取極の解釈又は実施から生ずる両政府間のいかなる紛争も、専ら両政府によって協議及び交渉を通じて解決される。
11. Any dispute between the two Governments arising out of the interpretation or implementation of the present arrangements shall be settled exclusively by the two Governments through consultations and negotiations.
12 この取極は、十二箇月間効力を有するものとし、いずれか一方の政府が他方の政府に対し少なくとも六箇月の予告をもってこの取極を終了させる意思を通告しない限り、自動的に更に十二箇月ごとに更新される。この取極の終了は、この取極の実施から生じることのあるいかなる事項についても適用される５の規定の実施に影響を及ぼすものではない。
12. The present arrangements shall remain in force for the period of twelve months and shall be automatically renewed for further periods of twelve months unless either Government notifies the other Government of its intention of terminating the present arrangements at least six months in advance. The termination of the present arrangements shall not affect paragraph 5 which shall be implemented on any matter which may occur from executing the present arrangements.
この書簡は、ひとしく正文である日本語、アラビア語及び英語により作成され、解釈に相違がある場合には、英語の本文による。
This Note is written in Japanese, Arabic and English languages, each text being equally authentic, and in case of any divergences in interpretation, the English text shall prevail.
本使は、更に、この書簡及びクウェート国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。
