（日本側書簡） （訳文） 書簡をもって啓上いたします。本使は、相手国の権限のある当局が付与した運転免許を有する者に対して自国の権限のある当局が運転免許を付与する際の手続に関して、日本国政府の代表者とイタリア共和国政府の代表者との間で行われた最近の協議に言及するとともに、次の取極を日本国政府に代わって提案する光栄を有します。
(Japanese Note) Rome, September 29, 2003 Excellency, With reference to the recent consultation held between the representatives of the Government of Japan and of the Government of the Republic of Italy concerning the procedures for the competent authorities of either country to give a driving permit to a person holding a driving permit issued by the competent authorities of the other country, I have the honour to propose on behalf of the Government of Japan the following arrangements:
１ いずれの国の権限のある当局も、他方の国の権限のある当局が付与した運転免許を有する者からの運転免許（仮運転免許及び旅客自動車運送事業に係る旅客を運送する目的で自動車を運転することを許可するための運転免許を除く。)の申請を受けて次のことを行うに際し、自国の法令に従い運転免許試験の一部又は全部を免除する。
1. When the holder of a driving permit issued by the competent authorities of either country applies to the competent authorities of the other country for a driving permit other than a temporary driving permit as well as a permit for driving motor vehicles for the purpose of transporting passengers in the passenger motor vehicle transportation business, the latter competent authorities shall, in taking the following measures, exempt that person from part or all of the examination for the driving permit in accordance with its laws and regulations:
(a) 日本国の権限のある当局に関しては、当該者にイタリア共和国の権限のある当局が付与した運転免許の種類に相当する自国の運転免許の付与
(a) With regard to the competent authorities of Japan, issuance of the driving permit of Japan whose category is equivalent to that of the driving permit issued to the applying person by the competent authorities of the Republic of Italy.
(b) イタリア共和国の権限のある当局に関しては、当該者に日本国の権限のある当局が付与した運転免許と引換えに行う、その運転免許の種類に相当する自国の運転免許の付与
(b) With regard to the competent authorities of the Republic of Italy, issuance of the driving permit of Italy whose category is equivalent to that of the driving permit issued to the applying person by the competent authorities of Japan in exchange for the latter driving permit.
２ いずれの政府の権限のある当局も、自国の運転免許を申請する者が有する他方の国の運転免許証が真正なものであるかどうかにつき疑義を有する場合には、外交上の経路を通じて、他方の政府の権限のある当局に対し確認を要請することができる。当該他方の政府の権限のある当局は、そのような要請に対し、自国の法令に従い、実行可能な限り速やかに回答するよう努力する。
2. The competent authorities of either Government may request through the diplomatic channel confirmation from the competent authorities of the other Government when the former competent authorities have a doubt about authenticity of the driving permit of the country of the latter competent authorities held by a person applying for a driving permit of the country of the former competent authorities. The competent authorities of that other Government shall endeavour to respond to such request as soon as practically possible in accordance with its laws and regulations.
３ いずれの政府の権限のある当局も、外交上の経路を通じて、自国の運転免許証の様式及び運転免許に係る制度に関する情報を提供するとともに、自国の運転免許と他方の国の運転免許との同等性に関する見解を表明する。
3. The competent authorities of either Government shall provide through the diplomatic channel information on the form of the driving permit of its country and the system concerning driving permit of its country and express views on the equivalence of driving permit of its country to the driving permit of the other country.
４ この取極の規定は、運転免許を申請する者に対し、それぞれの国の法令に従い行政上の手続のために必要とされる手続（書類の提出、手数料の支払等）を免除するものではない。
4. The provisions of the present arrangements do not exempt a person who applies for a driving permit of either country from the procedures, such as the submission of documents and the payment of fees, which are required for administrative process under the laws and regulations of that country.
５ この取極は、いずれかの国を締約国とする現行の他の二国間又は多数国間の条約又は国際協定に基づくそれぞれの国のいかなる権利及び義務にも影響を及ぼすものではない。
5. The present arrangements shall not affect any rights and obligations of either country under any other existing bilateral or multilateral treaty or international agreement to which either country is a party.
６ この取極は、それぞれの国において施行されている法令に従って実施される。
6. The present arrangements shall be implemented in accordance with the laws and regulations in force in each country.
７ いずれの政府も、他方の政府に対し三十日前に文書による予告を与えることにより、この取極を終了させることができる。
7. Either Government may terminate the present arrangements by giving thirty days’ written notice to the other Government.
本使は、更に、この書簡及びイタリア共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日の後三十日目の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency’s Note in reply confirming the foregoing arrangements on behalf of the Government of the Republic of Italy shall constitute an agreement between the two Governments, which shall enter into force on the thirtieth day after the date of Your Excellency’s Note in reply.

(Italian Note) Rome, September 29, 2003 Excellency, I have the honour to acknowledge the receipt of Your Excellency’s Note of today’s date, which reads as follows:
（日本側書簡） 本官は、更に、前記の取極がイタリア共和国政府にとって受諾し得るものであることをイタリア共和国政府に代わって閣下に通報するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成し、その合意がこの返簡の日付の日の後三十日目の日に効力を生ずるものとすることを確認する光栄を有します。
“(Japanese Note)” I have further the honour to inform Your Excellency, on behalf of the Government of the Republic of Italy, that the arrangements set forth in Your Excellency’s Note are acceptable to the Government of the Republic of Italy and to confirm that Your Excellency’s Note and this Note in reply shall constitute an agreement between the two Governments, which shall enter into force on the thirtieth day after the date of this Note in reply.
