  　書簡をもって啓上いたします。本官は、インドネシア共和国の経済の安定及び開発努力を促進することを目的として供与される二千一年の日本国の借款に関して日本国政府の代表者とインドネシア共和国政府の代表者との間で最近行われた討議に言及するとともに、両政府の間で到達した次の了解を確認する光栄を有します。

							

						

						

							

								
Sir,

	I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Republic of Indonesia regarding a Japanese loan for 2001 to be extended with a view to promoting the economic stabilization and development efforts of the Republic of Indonesia, and to confirm the following understanding reached between the two Governments:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　四百十七億三千百万円（四一、七三一、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。)が、この書簡に附属する表（以下「付表」という。)に掲げる事業計画を実施するため、各事業計画につき付表に定める配分に応じ、国際協力銀行（以下「銀行」という。)により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。

							

						

						

							

								
1.	A loan in Japanese yen up to the amount of forty-one billion seven hundred and thirty-one million yen (41,731,000,000) (hereinafter referred to as "the Loan") will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by Japan Bank for International Cooperation (hereinafter referred to as "the Bank") to implement the projects enumerated in the list attached hereto (hereinafter referred to as "the List") according to the allocation for each project as specified in the List.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２(1)　借款は、インドネシア共和国政府と銀行との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。

							

						

						

							

								
2.	(1)	The Loan will be made available by loan agreements to be concluded between the Government of the Republic of Indonesia and the Bank.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreements which will contain, inter alia, the following principles:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (a)(i)　償還期間は、十年の据置期間の後二十年とする。

							

						

						

							

								
	(a)	(i)	The repayment period will be twenty (20) years after the grace period of ten (10) years;

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
        (ii)　 利子率は、年一・八パーセントとする。

							

						

						

							

								
(ii) The rate of interest will be one and eight-tenths per cent (1.8%) per annum;


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (b)　ただし、(a)にもかかわらず、借款の一部が付表に掲げる事業計画のコンサルタントに対して行う支払のために使用される場合には、

							

						

						

							

								
(b) Notwithstanding sub-paragraph (a) above, where a part of the Loan is made available to cover payments to the consultants of the projects mentioned in the List, then:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
        (i)　当該部分に係る償還期間は、十年の据置期間の後三十年とする。

							

						

						

							

								
(i) the repayment period of the said part will be thirty (30) years after the grace period of ten (10) years;

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
        (ii)　当該部分に係る利子率は、年〇・七五パーセントとする。

							

						

						

							

								
(ii) the rate of interest of the said part will be seventy-five-hundredths per cent (0.75%) per annum; and

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (c)　支出期間は、関係借款契約の発効の日から、付表の１に掲げる事業計画については九年及び付表の２に掲げる事業計画については八年とする。

							

						

						

							

								
(c) The disbursement period will be nine (9) years with regard to the project mentioned in 1 of the List and eight (8) years with regard to the project mentioned in 2 of the List from the dates of coming into force of the relevant loan agreements.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)にいう借款契約の各々は、銀行が当該借款契約に係る事業計画の実行可能性（環境に対する配慮を含む。)を確認した後に締結される。

							

						

						

							

								
	(2)	Each of the loan agreements mentioned in sub-paragraph (1) above will be concluded after the Bank is satisfied of the feasibility, including environmental consideration, of the project to which such loan agreement relates.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (3)　(1)(c)にいうそれぞれの支出期間は、両政府の関係当局の同意を得て延長することができる。

							

						

						

							

								
	(3)	The respective disbursement periods mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３(1)　借款は、インドネシアの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して行う支払で、付表に掲げる事業計画の実施に必要な生産物又は役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。

							

						

						

							

								
3.	(1)	The Loan will be made available to cover payments to be made by Indonesian executing agencies to suppliers, contractors and/or consultants of eligible source countries under such contracts as have been or may be entered into between them for purchases of products and/or services required for the implementation of the projects enumerated in the List, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)にいう調達適格国のそれぞれの範囲は、両政府の関係当局間で合意される。

    (3)　借款の一部は、付表に掲げる事業計画の実施のための適格な現地通貨の需要に充てるために使用することができる。

  ４　借款の元本の償還並びに利子及びあらゆるその他の課徴金の支払の責任は、インドネシア共和国政府が負う。

							

						

						

							

								
4.	The Government of the Republic of Indonesia shall bear the responsibility for the repayment of principal of the Loan, as well as the payment of interest and any other charges thereon.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　インドネシア共和国政府は、３(1)にいう生産物又は役務が銀行の調達のためのガイドライン（国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。

							

						

						

							

								
5.	The Government of the Republic of Indonesia will ensure that products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Bank, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　インドネシア共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。

							

						

						

							

								
6.	With regard to the shipping and marine insurance of products purchased under the Loan, the Government of the Republic of Indonesia will refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７(1)　インドネシア共和国政府は、銀行について、借款及びそれから生ずる利子に対して又はそれらに関連して課されるインドネシアの財政課徴金及び租税を免除する。

							

						

						

							

								
7.	(1)	The Government of the Republic of Indonesia will exempt the Bank from Indonesian fiscal levies and taxes on and/or in connection with the Loan as well as interest accruing therefrom.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　インドネシア共和国政府は、供給者、請負業者又はコンサルタントとして活動する日本国の会社が借款に基づいて既に行ったか又は行う生産物又は役務の供給から生ずる所得に関するすべてのインドネシアの財政課徴金及び租税を負担する。

							

						

						

							

								
	(2)	The Government of the Republic of Indonesia shall assume all Indonesian fiscal levies and taxes with respect to the income of Japanese companies operating as suppliers, contractors and/or consultants accruing from the supply of products and/or services already provided and/or to be provided under the Loan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (3)　インドネシア共和国政府は、請負業者又はコンサルタントとして活動する日本国の会社が付表に掲げる事業計画の実施に必要な自己の資材及び設備の輸入及び再輸出に関するすべてのインドネシアの関税及び関連の財政課徴金を負担する。

							

						

						

							

								
	(3)	The Government of the Republic of Indonesia shall assume all Indonesian duties and related fiscal charges with respect to the import and re-export of own materials and equipment of Japanese companies operating as contractors and/or consultants needed for the implementation of the projects enumerated in the List.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　インドネシア共和国政府は、次のことを確保するために必要な措置をとる。

							

						

						

							

								
8.	The Government of the Republic of Indonesia will take necessary measures to ensure that:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (1)　借款が適正にかつ専ら３(1)にいう生産物又は役務の購入のために使用されること。

							

						

						

							

								
	(1)	the Loan be used properly and exclusively for purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3; and

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　借款に基づいて建設される施設がこの了解に定める目的のために適正にかつ効果的に維持され及び使用されること。

  ９　インドネシア共和国政府は、要請に応じ、日本国政府に対し、付表に掲げる事業計画の進捗状況についての報告を提出する。

							

						

						

							

								
9.	The Government of the Republic of Indonesia will, upon request, furnish the Government of Japan with reports on the progress of the projects enumerated in the List.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  10　両政府は、共同して借款の実施の進捗状況を随時検討し、借款の円滑かつ効果的な使用を確保するために必要な措置をとり、また、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

							

						

						

							

								
10.	The two Governments will jointly review from time to time the progress of the implementation of the Loan and take necessary measures to secure smooth and effective utilization of the Loan and otherwise consult with each other in respect of any matter that may arise from or in connection with this understanding.
