    書簡をもって啓上いたします。本官は、日本国政府（以下「政府」という。)の代表者と国際連合児童基金（以下「ユニセフ」という。)の代表者との間で最近行われたウズベキスタン共和国における干ばつ地域保健改善計画（以下「計画」という。)に関する協議に言及するとともに、次の取極を提案する光栄を有します。

							

						

						

							

								
Sir,

	I have the honour to refer to the recent discussions held between the representatives of the Government of Japan (hereinafter referred to as "the Government") and of the United Nations Children's Fund (hereinafter referred to as "UNICEF") in relation to the project for Improving Health Care in Draught Affected Areas in the Republic of Uzbekistan (hereinafter referred to as "the Project") and have further the honour to propose the following arrangements:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １  政府は、日本国の関係法令に従い、三億五千五百万円（三五五、〇〇〇、〇〇〇円）を贈与の形でユニセフの使用に供する。

							

						

						

							

								
1.	The Government shall make available to UNICEF, in accordance with the relevant laws and regulations of Japan, the amount of three hundred and fifty-five million yen (355,000,000) in the form of grant.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２  政府は、日本国の銀行の東京店に開設されているユニセフの勘定に、１に定める額を日本円で払い込む。この額は、政府の関係当局とユニセフとの間の合意によって延長されない限り、この取極が効力を生ずる日から二千二年三月三十一日までの期間中に払い込まれる。

							

						

						

							

								
2.	The Government shall make a payment of the amount referred to in the preceding paragraph in Japanese yen to a UNICEF account opened in the Tokyo office of a bank of Japan.  This amount shall be paid during the period between the date of coming into force of the present arrangements and March 31, 2002, unless the period is extended by mutual agreement between the authority concerned of the Government and UNICEF.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３  政府は、２の規定に従って払込みを行うことにより、その払込みを行ったときにその払込みの金額までこの取極に基づく援助を実施したとみなされる。

							

						

						

							

								
3.	By and upon making the payment under the preceding paragraph, the Government shall be deemed to have made the assistance under the present arrangements to the extent of the amount of such payment.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４(1)　１に定める総額は、計画の実施に必要な医薬品及び機材（以下「生産物」という。)の購入及びこの購入に関連する費用（輸送費、保険料及びユニセフに対する手数料を含む。)に使用される。

							

						

						

							

								
4.	(1)	The total amount referred to in paragraph 1 above shall be used for the purchase of medicine and equipment necessary for the execution of the Project (hereinafter referred to as "the Products"), and for the expenditures related to such purchase, including freight, insurance premium and UNICEF's agency fees.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　生産物の現在の価格、輸送費及び保険料を考慮して、最小限二億七千二百万円（二七二、〇〇〇、〇〇〇円）相当の生産物が購入され、船積みされ、ウズベキスタン共和国における計画の実行地に引き渡されることが期待される。

							

						

						

							

								
	(2)	Taking into account the current price of the Products, freight and insurance premium, it is anticipated that a minimum of two hundred and seventy-two million yen (272,000,000) of the Products will be purchased and shipped to the Project sites in the Republic of Uzbekistan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (3)　ユニセフは、生産物の購入並びに輸送及び保険のため、ユニセフの財務規則に従い供給者と契約を締結する。

							

						

						

							

								
	(3)	UNICEF shall enter into contracts with suppliers for the purchase of the Products and for the shipping and insurance in accordance with UNICEF's financial rules.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５  ユニセフは、４の規定に従って購入した生産物が計画の実行のために適正にかつ効果的に維持され及び使用されることを確保するために必要なすべての措置をとる。

							

						

						

							

								
5.	UNICEF shall take all the necessary measures to ensure that the Products purchased under the preceding paragraph be maintained and used properly and effectively for the execution of the Project.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６  政府及びユニセフは、いずれか一方の要請により、この取極から又はこれに関連して生ずるいかなる事項についても、相互に協議する。

							

						

						

							

								
6.	The Government and UNICEF shall consult with each other, at the request of either of them, on any matter that may arise from or in connection with the present arrangements.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７(1)　ユニセフは、４(3)における供給者と契約を締結した後、遅滞なく次の事項を政府に通報する。

							

						

						

							

								
7.	(1)	When UNICEF has entered into contracts with the suppliers mentioned in sub-paragraph (3) of paragraph 4 above, UNICEF shall inform the Government, without delay, of the following:

    (2)　積荷の計画の実行地への到着のたびに、ユニセフは、これらの日付並びにこの取極に従って購入した生産物の数量及び品質を政府に通報する。

							

						

						

							

								
	(2)	Each time a shipment arrives at the Project sites, UNICEF shall inform the Government of the date and the quantity and condition of the Products purchased under the present arrangements.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (3)　ユニセフは、最初の積荷が計画の実行地に到着した後、六箇月ごとにこの取極に従って購入した生産物の使用に関する報告書を政府に提出するよう努める。

							

						

						

							

								
	(3)	After the arrival of the first shipment at the Project sites, UNICEF shall endeavour to submit to the Government a report on the use of the Products purchased under the present arrangements every six months.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (4)  ユニセフは、この取極に従って購入した生産物の配布が完了した後、その使用に関する最終報告書を、できる限り計画の実行地における写真を付して、政府に提出する。

							

						

						

							

								
	(4)	Upon the completion of the distribution of the Products purchased under the present arrangements, UNICEF shall provide for the Government a final report on the use thereof, if possible together with photographs taken at the Project sites.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (5)  ユニセフは、この取極に従って購入した生産物が日本国の贈与であることを明示するため、日本国の政府開発援助のシンボルマークを生産物及び（又は）その包装に付すことを確保する。

							

						

						

							

								
	(5)	UNICEF shall ensure that the Products purchased under the present arrangements and/or their containers bear the logo of Japan's ODA in order to identify that the said Products are donated by Japan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    本官は、更に、この書簡及び前記の取極を確認される貴官の返簡が政府とユニセフとの間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。
