    書簡をもって啓上いたします。本使は、千九百五十四年三月八日に東京で署名されたアメリカ合衆国と日本国との間の相互防衛援助協定（以下「ＭＤＡ協定」という。)に言及する光栄を有します。ＭＤＡ協定は、各政府が、他方の政府に対し、援助を供与する政府が承認することがある装備、資材、役務その他の援助を、両政府の間で行うべき細目取極に従って、使用に供するものとすることを特に規定しています。

							

						

						

							

								
Excellency,

	I have the honor to refer to the Mutual Defense Assistance Agreement between the United States of America and Japan, signed at Tokyo on March 8, 1954 (hereinafter referred to as "the MDA Agreement"), which provides, inter alia, that each Government will make available to the other such equipment, materials, services, or other assistance as the Government furnishing such assistance may authorize, in accordance with such detailed arrangements as may be made between them.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　その規定に従い、アメリカ合衆国政府及び日本国政府は、これまで、日本国政府が九十九機を限度とするＳＨ－六十Ｊ航空機、四十四機を限度とするＵＨ－六十Ｊ航空機、十八機を限度とするＵＨ－六十ＪＡ航空機及び二機を限度とするＳＨ－六十ＪＭＯＤ航空機並びにそれらに関連する装備及び資材を取得し並びに日本国において生産する計画について前記の細目取極を作成してきました。両政府の代表者は、最近、前記の計画に追加されるものとしてＵＨ－六十Ｊ航空機及びＵＨ－六十ＪＡ航空機並びにそれらに関連する装備及び資材の取得並びに日本国における生産について前記の細目取極を作成するため討議を行いました。

							

						

						

							

								
	In pursuance of this provision, the Government of the United States of America and the Government of Japan, thus far, have made such detailed arrangements mentioned above concerning the programs for the acquisition and production in Japan of up to ninety-nine (99) SH-60J Aircraft, up to forty-four (44) UH-60J Aircraft, up to eighteen (18) UH-60JA Aircraft and up to two (2) SH-60JMOD Aircraft and related equipment and materials.  The representatives of the Government of the United States of America and the Government of Japan have recently held discussions for the purpose of makingsuchdetailed arrangements concerning the acquisition and production in Japan of the UH-60J/UH-60JA Aircraft and related equipment and materials as an addition to the above-mentioned programs.

  １　３の規定に基づき作成される実施細目取極に従い、日本国政府は、二機を限度とするＵＨ－六十Ｊ航空機及び三機を限度とするＵＨ－六十ＪＡ航空機並びにそれらに関連する装備及び資材を取得し又は生産するものとし、アメリカ合衆国政府は、これらのものの販売又は生産を承認する。この結果、新たな合計は、四十六機を限度とするＵＨ－六十Ｊ航空機及び二十一機を限度とするＵＨ－六十ＪＡ航空機並びにそれらに関連する装備及び資材となる。

							

						

						

							

								
1.	In accordance with the detailed implementing arrangements to be made under paragraph 3, the Government of Japan will acquire or produce and the Government of the United States of America will authorize the sale or production of up to two (2) UH-60J Aircraft and up to three (3) UH-60JA Aircraft and related equipment and materials for a new total of up to forty-six (46) UH-60J Aircraft and up to twenty-one (21) UH-60JA Aircraft and related equipment and materials.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２　ＵＨ－六十Ｊ航空機及びＵＨ－六十ＪＡ航空機並びにそれらに関連する装備及び資材の生産は、アメリカ合衆国及び日本国の企業が参加し、並びにアメリカ合衆国政府が日本国政府に直接販売を行うことにより、実施される。この計画の実施に必要な防衛物件又は防衛役務の商業上の輸出は、合衆国国務省によって許可される。

							

						

						

							

								
2.	The production of the UH-60J/UH-60JA Aircraft and related equipment and materials will be undertaken through the participation of the industries of the United States of America and Japan and through direct sales by the Government of the United States of America to the Government of Japan.  Commercial exports of defense articles or services necessary to carry out this program will be authorized by the United States Department of State.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３　この了解は、ＭＤＡ協定及びこれに基づく取極（千九百五十六年三月二十二日に東京で署名された防衛目的のためにする特許権及び技術上の知識の交流を容易にするためのアメリカ合衆国政府と日本国政府との間の協定を含む。)に従って実施される。この了解の実施細目取極は、両政府の権限のある当局の代表者により作成されるＵＨ－六十Ｊ航空機及びＵＨ－六十ＪＡ航空機並びにそれらに関連する装備及び資材の取得並びに日本国における生産に関する取極並びにその修正である。

							

						

						

							

								
3.	The present understanding will be implemented in accordance with the MDA Agreement and arrangements made thereunder, including the Agreement between the Government of the United States of America and the Government of Japan to Facilitate Interchange of Patent Rights and Technical Information for Purposes of Defense signed at Tokyo on March 22, 1956.  The detailed implementing arrangements of the present understanding will be those arrangements made between representatives of the competent authorities of the two Governments concerning the acquisition and production in Japan of the UH-60J/UH-60JA Aircraft and related equipment and materials, and any subsequent amendments thereto.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　この了解及びこれに基づき作成されるすべての取極に基づき日本国政府が行う財政上の債務の負担又は支出は、日本国の憲法上の規定に従った予算の承認を得たところにより行う。

							

						

						

							

								
4.	Financial obligations or expenditures incurred by the Government of Japan under the present understanding and all arrangements to be made hereunder will be subject to budget authorization pursuant to the constitutional provisions of Japan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    本使は、この了解が日本国政府により受諾される場合には、この書簡及び受諾する旨の閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。
