    書簡をもって啓上いたします。本使は、日本国とパキスタン・イスラム共和国との間の友好協力関係を強化することを目的として行われる日本国の経済協力に関して、日本国政府の代表者とパキスタン・イスラム共和国政府の代表者との間で最近行われた討議に言及するとともに、次の取極を日本国政府に代わって提案する光栄を有します。

							

						

						

							

								
Excellency,

	I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Islamic Republic of Pakistan concerning Japanese economic cooperation to be extended with a view to strengthening friendly and cooperative relations between the two countries, and to propose on behalf of the Government of Japan the following arrangements:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １  日本国政府は、パキスタン・イスラム共和国の経済の構造改善努力推進及び債務問題を含む同国の経済困難緩和に寄与するため、日本国の関係法令に従い、パキスタン・イスラム共和国政府に対し、三十億円（三、○○○、○○○、○○○円）の贈与（以下「贈与」という。)を行う。

							

						

						

							

								
1.	For the purpose of contributing to promotion of the economic structural adjustment efforts by the Government of the Islamic Republic of Pakistan as well as mitigation of the economic difficulties, including indebtedness, of the Islamic Republic of Pakistan, the Government of Japan will extend to the Government of the Islamic Republic of Pakistan, in accordance with the relevant laws and regulations of Japan, a grant of three billion yen (3,000,000,000) (hereinafter referred to as "the Grant").

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２(1)  贈与及びその利子は、パキスタン・イスラム共和国政府により、適正にかつ専ら両政府の関係当局間で合意する表に掲げる生産物及び同生産物に付随する役務を購入するために使用される。ただし、当該生産物は、調達適格国において生産されるものとする。

							

						

						

							

								
2.	(1)	The Grant and its accrued interest will be used by the Government of the Islamic Republic of Pakistan properly and exclusively for the purchase of products enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments and services incidental to such products, provided that those products are produced in eligible source countries.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)にいう表は、両政府の関係当局間の合意により修正されることがある。

							

						

						

							

								
	(2)	The list mentioned in sub-paragraph (1) above will be subject to modifications which may be agreed upon between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (3)　(1)にいう調達適格国については、両政府の関係当局間で合意される。

							

						

						

							

								
	(3)	The scope of the eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３(1)　パキスタン・イスラム共和国政府は、この取極の効力の生ずる日の後十四日以内に日本国の銀行に同国政府名義の円普通預金勘定（以下「勘定」という。)を開設し、かつ、勘定開設の日の後七日以内に日本国政府に対し勘定を開設するための手続を完了した旨を書面により通告する。

							

						

						

							

								
3.	(1)	The Government of the Islamic Republic of Pakistan will open a yen ordinary deposit account at a bank of Japan in the name of the Government of the Islamic Republic of Pakistan (hereinafter referred to as "the Account") within fourteen days after the date of coming into force of the present arrangements and will notify in writing the Government of Japan of the completion of the procedure for opening the Account within seven days after the date of the opening of the Account.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　勘定の目的は、４にいう日本国政府が払い込む日本円を受領すること、２(1)にいう生産物と役務の購入に必要な支払を行うこと及び両政府の関係当局が合意するその他の支払を行うことに限られる。

							

						

						

							

								
	(2)	The sole purpose of the Account is to receive the payment in Japanese yen by the Government of Japan referred to in paragraph 4 as well as to make payments necessary for the purchase of the products and services referred to in sub-paragraph (1) of paragraph 2, and such other payment as may be agreed upon between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４  日本国政府は、両政府の関係当局間の合意により延長されない限り、３(1)にいう書面による通告の受領の日から、二千二年三月三十一日までの期間に、１にいう金額を勘定に日本円で払い込むことにより、贈与を実施する。

							

						

						

							

								
4.	The Government of Japan will execute the Grant by making payment in Japanese yen of the amount referred to in paragraph 1 to the Account during the period between the date of receipt of the written notification referred to in sub-paragraph (1) of paragraph 3 and March 31, 2002, unless the period is extended by mutual agreement between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５(1)　パキスタン・イスラム共和国政府は、次のことのために必要な措置をとる。

							

						

						

							

								
5.	(1)	The Government of the Islamic Republic of Pakistan will take necessary measures:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (a)　贈与及びその利子を、贈与が実施された日から十二カ月以内に使用することとし、それ以降の勘定中の残余金は日本国政府に返済すること。ただし、両政府当局間の合意により延長される場合にはこの限りでない。

							

						

						

							

								
(a) to use the Grant and its accrued interest within a period of twelve months after the date of the execution of the Grant and to refund the amount remaining in the Account after the period to the Government of Japan unless the period is extended by mutual agreement between the authorities concerned of the two Governments;

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (b)　２(1)にいう生産物及び役務の供与に関してパキスタン・イスラム共和国において課される関税、内国税その他の財政課徴金が贈与によって負担されないことを確保すること。

							

						

						

							

								
(b) to ensure that customs duties, internal taxes and other fiscal levies which may be imposed in the Islamic Republic of Pakistan with respect to the purchase of the products and services referred to in sub-paragraph (1) of paragraph 2 shall not be borne by the Grant;

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (c)　贈与及びその利子がパキスタン・イスラム共和国の経済の構造改善努力推進及び債務問題を含む同国の経済困難緩和のために適正かつ効果的に使用されることを確保すること。

							

						

						

							

								
(c) to ensure that the Grant and its accrued interest be used properly and effectively for promotion of the economic structural adjustment efforts as well as mitigation of the economic difficulties, including indebtedness, of the Islamic Republic of Pakistan; and

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (d)　贈与及びその利子が３(2)の規定に従ってすべて引き出された場合、(a)の規定に従って使用期間を了した場合又は日本国政府から要請があった場合には、遅滞なく、日本国政府に対し、勘定に関する取引についての契約書、証憑類その他の文書類の写しを添付のうえ、当該取引につき、日本国政府が受け入れることができる形式の書面による報告を行うこと。

							

						

						

							

								
(d) to present to the Government of Japan a report prepared in a written form acceptable to the Government of Japan on the transactions on the Account together with copies of contracts, vouchers and other documents concerning the relevant transactions without delay when the Grant and its accrued interest are completely drawn in accordance with the provisions of sub-paragraph (2) of paragraph 3, or when the period for the use of the Grant and its accrued interest expires in accordance with the provisions of (a) above, or upon request by the Government of Japan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　贈与及びその利子に基づいて購入される生産物は、パキスタン・イスラム共和国から再輸出されてはならない。

  ６(1)　パキスタン・イスラム共和国政府は、２(1)にいう生産物の購入に関して行われる日本円による払込みの額と等価額が同国政府の名義でパキスタン国立銀行に開設される勘定にパキスタンの通貨で積立てられることを確保する。積立ては、両政府の関係当局間で別段の合意がない限り、この取極が効力を生ずる日から三年以内に行われる。

							

						

						

							

								
6.	(1)	The Government of the Islamic Republic of Pakistan shall ensure that an amount equivalent to the yen disbursement paid with respect to the purchase of the products referred to in sub-paragraph (1) of paragraph 2 will be deposited in Pakistani currency in an account to be opened in its name in the National Bank of Pakistan.  The deposit shall be made within the period of three years from the date of coming into force of the present arrangements, unless otherwise agreed between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　このようにして積立てられた通貨は、パキスタン・イスラム共和国の経済社会開発事業計画支援のために利用される。

    (3)　両政府の関係当局は、積立てられた通貨を利用する事業計画につき相互に協議する。

  ７　この取極の実施に関する手続細目は、両政府の関係当局間の協議の後合意により決定される。

							

						

						

							

								
7.	Further procedural details for the implementation of the present arrangements will be agreed upon through consultation between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８  両政府は、この取極から又はこれに関連して生ずることのあるいかなる事項についても相互に協議する。

							

						

						

							

								
8.	The two Governments will consult with each other in respect of any matter that may arise from or in connection with the present arrangements.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    本使は、更に、この書簡及びパキスタン・イスラム共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

							

						

						

							

								
	I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Islamic Republic of Pakistan the foregoing arrangements shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.
