  　書簡をもって啓上いたします。本官は、日本国政府が、千九百七十八年に作成され、千九百九十五年に改正された船員の訓練及び資格証明並びに当直の基準に関する国際条約（以下「条約」という。）の規定に従ってフィリピン共和国の国民が日本国を旗国とする船舶（以下「日本船舶」という。）に職員として乗り組むための承認に関して、日本国政府の代表者とフィリピン共和国政府の代表者との間で行われた最近の協議に言及する光栄を有します。本官は、更に、次の取極を日本国政府に代わって提案する光栄を有します。

							

						

						

							

								
Excellency,

	I have the honor to refer to the recent consultation held between the representatives of the Government of Japan and of the Government of the Republic of the Philippines concerning the recognition for nationals of the Republic of the Philippines to serve as officers on board ships entitled to fly the flag of Japan (hereinafter referred to as "Japanese ships") in accordance with the provisions of International Convention on Standards of Training, Certification and Watchkeeping for Seafarers done in 1978, as amended in 1995 (hereinafter referred to as "the Convention").  I have further the honor to propose on behalf of the Government of Japan the following arrangements:


							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　日本国政府は、日本船舶に職員として乗り組むことを求めるフィリピン共和国の国民であってフィリピン共和国政府が発給した証明書を受有するものを承認する。ただし、そのような承認が条約及び自国の法令に従い、かつ、日本国政府により適当と認められることを条件とする。

							

						

						

							

								
1.	The Government of Japan shall recognize nationals of the Republic of the Philippines seeking to serve as officers on board Japanese ships and holding certificates which the Government of the Republic of the Philippines has issued to them, provided that such recognition is in accordance with the Convention and the laws and regulations of Japan and deemed appropriate by the Government of Japan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２　１にいう承認を受けたフィリピン共和国の国民は、日本国の法令に従って、その承認の際に日本国政府により認められた職務を遂行する資格を与えられる。

							

						

						

							

								
2.	Nationals of the Republic of the Philippines who have been given the recognition referred to in paragraph 1 shall be entitled to perform the functions permitted by the Government of Japan at the time of such recognition in accordance with the laws and regulations of Japan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３　日本国政府は、能力の基準、証明書の発給及び裏書並びに記録の保管に関する要件が十分に満たされていることを確認するため、フィリピン共和国政府の施設及び手続の点検を含む必要な措置をとることができる。

							

						

						

							

								
3.	The Government of Japan may take necessary measures including inspection of facilities and procedures of the Government of the Republic of the Philippines in order to confirm that the requirements concerning standards of competence, the issue and endorsement of certificates and record keeping are fully complied with.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４　フィリピン共和国政府は、条約に基づいて定める訓練及び資格証明のための制度に変更が生じたときは、日本国政府に対し迅速に通報する。

							

						

						

							

								
4.	The Government of the Republic of the Philippines shall give the Government of Japan prompt notification of any significant change in the arrangements for training and certification provided in compliance with the Convention.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ５　日本国政府の権限のある当局は、１にいう承認についての決定に先立って、フィリピン共和国の国民が遂行することを認められるように求める職務について必要な知識及び能力を有していることを確保するためにフィリピン共和国の領域において日本国の法令により必要とされる試験及び日本国の海事法令に関する講習を実施することができる。

							

						

						

							

								
5.	The competent authority of the Government of Japan may conduct seminar on the maritime laws and regulations of Japan as well as examination necessary under its laws and regulations in the territory of the Republic of the Philippines in advance of its decision on the recognition referred to in paragraph 1 in order to ensure that nationals of the Republic of the Philippines seeking such recognition have a knowledge and capabilities necessary for the functions which those nationals of the Republic of the Philippines seek to be permitted to perform.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　この取極は、それぞれの国において施行されている法令に従って実施される。

							

						

						

							

								
6.	The present arrangements shall be implemented in accordance with the laws and regulations in force in each country.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　いずれの一方の政府も、他方の政府に対し、三十日前に文書による予告を与えることにより、この取極を終了させることができる。

							

						

						

							

								
7.	Either Government may terminate the present arrangements by giving thirty days' written notice to the other Government.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  　本官は、更に、この書簡及びフィリピン共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。

							

						

						

							

								
	I have further the honor to propose that this Note and Your Excellency's Note in reply confirming the foregoing arrangements on behalf of the Government of the Republic of the Philippines shall be regarded as constituting an agreement between the two Governments, which shall enter into force on the date of Your Excellency's Note in reply.
