  　書簡をもって啓上いたします。本使は、パプア・ニューギニアの経済の安定及び開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とパプア・ニューギニア政府の代表者との間で最近到達した次の了解を確認する光栄を有します。

							

						

						

							

								
Excellency,

	I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of Papua New Guinea concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of Papua New Guinea:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １  五十三億五千万円（五、三五〇、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。)が、構造調整計画を支援するため、国際協力銀行（以下「銀行」という。)により、日本国の関係法令に従って、パプア・ニューギニア政府に供与されることになる。

							

						

						

							

								
1.	A loan in Japanese yen up to the amount of five billion three hundred and fifty million yen (5,350,000,000) (hereinafter referred to as "the Loan") will be extended to the Government of Papua New Guinea by Japan Bank for International Cooperation (hereinafter referred to as "the Bank") in accordance with the relevant laws and regulations of Japan to support the Structural Adjustment Program.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２(1)　借款は、パプア・ニューギニア政府と銀行との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。

							

						

						

							

								
2.	(1)	The Loan will be made available by a loan agreement to be concluded between the Government of Papua New Guinea and the Bank.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (a)　償還期間は、十年の据置期間の後二十年とする。

							

						

						

							

								
(a)	The repayment period will be twenty (20) years after the grace period of ten (10) years;

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (b)　利子率は、年二・二パーセントとする。

							

						

						

							

								
(b)	The rate of interest will be two point two per cent (2.2%) per annum; and

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (c)　支出期間は、前記の借款契約の発効の日から二年とする。

							

						

						

							

								
(c)	The disbursement period will be two (2) years from the date of coming into force of the said loan agreement.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。

  ３(1)　借款は、パプア・ニューギニア国内の輸入者が調達適格国の供給者に対して既に行ったか又は行う支払で、生産物（両政府の関係当局間で相互に合意される表に掲げる生産物を除く。)の購入及びそれらの 生産物の購入に付随する役務の購入のために両者の間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。

							

						

						

							

								
3.	(1)	The Loan will be made available to cover payments already made and/or to be made to suppliers of eligible source countries by importers in Papua New Guinea under such contracts as have been or may be entered into between them for purchases of products, except such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)にいう表には、両政府の関係当局間の合意によって修正を加えることができる。

							

						

						

							

								
	(2)	The list mentioned in sub-paragraph (1) above may be modified by agreement between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (3)　(1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。

							

						

						

							

								
	(3)	The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ４(1)　パプア・ニューギニア政府は、パプア・ニューギニア政府の名義でパプア・ニューギニア銀行に開設される見返資金勘定に借款の円貨による支出額に等しい額をパプア・ニューギニア通貨で振り替えるようにするための措置をとる。このようにして振り替えられたパプア・ニューギニア通貨は、保健、教育、村落インフラ及び第一次産業を主とするパプア・ニューギニア政府の経済社会開発事業計画のために使用されなければならない。

							

						

						

							

								
4.	(1)	The Government of Papua New Guinea will take measures to have the equivalent in Papua New Guinean currency of the amount of yen disbursements of the Loan transferred into the counterpart fund account opened in the name of the Government of Papua New Guinea in the Bank of Papua New Guinea.  The amount of Papua New Guinean currency thus transferred shall be used for the economic and social development projects, mainly for health, education, rural infrastructure and primary industries, of the Governments of Papua New Guinea.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　パプア・ニューギニア政府は、要請に応じ、銀行に対し、(1)にいう見返資金の使用についての報告を提出する。

  ５　パプア・ニューギニア政府は、３(1)にいう生産物又は役務が銀行の調達のためのガイドライン（国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)
    に従って調達されることを確保する。

							

						

						

							

								
5.	The Government of Papua New Guinea will ensure that products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Bank, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　パプア・ニューギニア政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。

							

						

						

							

								
6.	With regard to the shipping and marine insurance of products purchased under the Loan, the Government of Papua New Guinea will refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　パプア・ニューギニア政府は、銀行について、借款及びそれから生ずる利子に対して又はそれらに関連してパプア・ニューギニアにおいて課されるすべての財政課徴金及び租税を免除する。

							

						

						

							

								
7.	The Government of Papua New Guinea will exempt the Bank from all fiscal levies and taxes imposed in Papua New Guinea on and/or in connection with the Loan as well as interest accruing therefrom.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　パプア・ニューギニア政府は、借款が適正にかつ専ら３(1)にいう生産物又は役務の購入のために使用されることを確保するために必要な措置をとる。

							

						

						

							

								
8.	The Government of Papua New Guinea will take necessary measures to ensure that the Loan be used properly and exclusively for the purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ９　パプア・ニューギニア政府は、要請に応じ、日本国政府及び銀行に対し、借款の実施の進捗状況に関する情報及び資料を提供する。

							

						

						

							

								
9.	The Government of Papua New Guinea will, upon request, furnish the Government of Japan and the Bank with information and data concerning the progress of the implementation of the Loan.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  10　両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
