  　書簡をもって啓上いたします。本使は、インドネシア共和国の経済の安定及び開発努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とインドネシア共和国政府の代表者との間で最近行われた討議に言及するとともに、両政府の間で到達した次の了解を確認する光栄を有します。

							

						

						

							

								
Excellency,

	I have the honor to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Republic of Indonesia concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of the Republic of Indonesia, and to confirm the following understanding reached between the two Governments:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  １　七百十九億二千八百万円（七一、九二八、〇〇〇、〇〇〇円）の額までの円貨による借款（以下「借款」という。）が、ソーシャル・セーフティ・ネット計画を支援するため、国際協力銀行（以下「銀行」という。）により、日本国の関係法令に従って、インドネシア共和国政府に供与されることになる。

							

						

						

							

								
1.	A loan in Japanese yen up to the amount of seventy-one billion nine hundred and twenty eight million yen (71,928,000,000) (hereinafter referred to as "the Loan") will be extended, in accordance with the relevant laws and regulations of Japan, to the Government of the Republic of Indonesia by Japan Bank for International Cooperation (hereinafter referred to as "the Bank") to support the Social Safety Net Program.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ２(1)　借款は、インドネシア共和国政府と銀行との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。

							

						

						

							

								
2.	(1)	The Loan will be made available by a loan agreement to be concluded between the Government of the Republic of Indonesia and the Bank.  The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreement which will contain, inter alia, the following principles:

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (a)　償還期間は、十年の据置期間の後二十年とする。

							

						

						

							

								
(a)	The repayment period will be twenty (20) years after the grace period of ten (10) years.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (b)　利子率は、年一・〇パーセントとする。

							

						

						

							

								
(b)	The rate of interest will be one per cent (1.0%) per annum.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
      (c)　支出期間は、前記の借款契約の発効の日から三年とする。

							

						

						

							

								
(c)	The disbursement period will be three (3) years from the date of coming into force of the said loan agreement.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。

							

						

						

							

								
	(2)	The disbursement period mentioned in sub-paragraph (1)(c) above may be extended with the consent of the authorities concerned of the two Governments.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ３(1)　借款は、インドネシア共和国内の輸入者が調達適格国の供給者に対して既に行ったか又は行う支払で、生産物（両政府の関係当局間で相互に合意する表に掲げる生産物を除く。）の購入及び当該生産物の購入に付随する役務の購入のために当該輸入者と当該供給者との間で既に締結されたか又は締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物及びそれらの国から供給される役務について行われる。

							

						

						

							

								
3.	(1)	The Loan will be made available to cover payments already made and/or to be made to suppliers of eligible source countries by importers in the Republic of Indonesia under such contracts as have been or may be entered into between them for purchases of products, except such products as will be enumerated in a list to be mutually agreed upon between the authorities concerned of the two Governments, and for purchases of services incidental to the purchases of those products, provided that such purchases are made in such eligible source countries for products produced in and services supplied from those countries.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
    (2)　(1)にいう表には、両政府の関係当局間の合意によって修正を加えることができる。

    (3)　(1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。

  ４(1)　インドネシア共和国政府は、インドネシア共和国政府の名義でインドネシア銀行に開設される見返資金勘定に借款の円貨による支出額に等しい額をインドネシア通貨で振り替えるようにするための措置をとる。このようにして振り替えられたインドネシア通貨は、銀行、世界銀行又はアジア開発銀行より供与された借款により支援されたインドネシア共和国の開発事業計画の実施のための現地通貨需要に充てるために使用されなければならない。前記の開発事業計画に使用されない見返資金は、インドネシア共和国の低所得者に需要の多い灯油、小口の電力等に係る燃料及び電力への補助金のための現地通貨需要に充てるために使用されなければならない。

							

						

						

							

								
4.	(1)	The Government of the Republic of Indonesia will take measures to have the equivalent in Indonesian currency of the amount of yen disbursements of the Loan transferred into the counterpart fund account opened in the name of the Government of the Republic of Indonesia at the Bank Indonesia.  The amount of Indonesian currency thus transferred shall be used to cover local currency requirements for the implementation of the development projects of the Republic of Indonesia supported under loans extended by the Bank, the World Bank or the Asian Development Bank.  Any counterpart fund not required for the development projects mentioned above shall be used to cover local currency requirements for the fuel and electricity subsidies for kerosene, a small lot electricity and so forth that are much in demand among the lower income population of the Republic of Indonesia.

  ５　インドネシア共和国政府は、３(1)にいう生産物又は役務が銀行の調達のためのガイドライン（国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。）に従って調達されることを確保する。

							

						

						

							

								
5.	The Government of the Republic of Indonesia will ensure that products and/or services mentioned in sub-paragraph (1) of paragraph 3 are procured in accordance with the guidelines for procurement of the Bank, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ６　インドネシア共和国政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。

							

						

						

							

								
6.	With regard to the shipping and marine insurance of products purchased under the Loan, the Government of the Republic of Indonesia will refrain from imposing any restrictions that may hinder fair and free competition among the shipping and marine insurance companies.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ７　インドネシア共和国政府は、銀行について、借款並びにそれらから生ずる利子に対して又はそれらに関連して課されるインドネシアの財政課徴金及び租税を免除する。

							

						

						

							

								
7.	The Government of the Republic of Indonesia will exempt the Bank from Indonesian fiscal levies and taxes on and/or in connection with the Loan as well as interest accruing therefrom.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ８　インドネシア共和国政府は、借款が適正にかつ専ら３(1)にいう生産物又は役務を購入するために使用されること並びに４(1)にいう見返資金が適正にかつ専ら４(1)にいう開発事業計画並びに燃料及び電力への補助金に使用されることを確保するために必要な措置をとる。

							

						

						

							

								
8.	The Government of the Republic of Indonesia will take necessary measures to ensure that the Loan be used properly and exclusively for the purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3, and that the counterpart fund mentioned in sub-paragraph (1) of paragraph 4 be used properly and exclusively for the development projects and the fuel and electricity subsidies mentioned in sub-paragraph (1) of paragraph 4.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
  ９　両政府は、共同して借款の実施の進捗状況を随時検討し、借款の円滑かつ効果的な使用を確保するために必要な措置をとり、また、この了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。

							

						

						

							

								
9.	The two Governments will jointly review from time to time the progress of the implementation of the Loan and take necessary measures to secure smooth and effective utilization of the Loan and otherwise consult with each other in respect of any matter that may arise from or in connection with this understanding.
